For students of HI 2106 – Themes in modern American history and HI 2018 – American History: A survey READING LISTS General Reading: 1607-1991 Single or two-volume overviews of American history are big business in the American academic world. They are generally reliable, careful and bland. An exception is Bernard Bailyn et al, The Great Republic: a history of the American people which brings together thoughtful and provocative essays from some of America’s top historians, for example David Herbert Donald and Gordon Wood. This two-volume set is recommended for purchase (and it will shortly be available in the library). Other useful works are George Tindall, America: a Narrative History, Eric Foner, Give me Liberty and P.S. Boyer et al, The Enduring Vision all of which are comprehensive, accessible up to date and contain very valuable bibliographies. Among the more acceptable shorter alternatives are M.A. Jones, The Limits of Liberty and Carl Degler, Out of our Past. Hugh Brogan, The Penguin history of the United States is entertaining and mildly idiosyncratic. A recent highly provocative single- volume interpretative essay on American history which places war at the centre of the nation’s development is Fred Anderson and Andrew Cayton, The Dominion of War: Empire and Liberty in North America, 1500-2000 All of the above are available in paperback and one should be purchased. Anthologies of major articles or extracts from important books are also a big commercial enterprise in U.S. publishing. By far the most useful and up-to-date is the series Major problems in American History published by D.C. -

Aguirre is a trial attorney whose practice focuses on securities regulation, securities litigation, and the representation of whistleblowers in the financial industry and regulatory agencies. After a successful career in private practice, he joined the SEC in 2004 and soon headed an insider trading investigation of Pequot Capital Management. According to a joint report of two Senate committees, the SEC fired him when his e-mail questioned the decision of his supervisory chain to give “overly deferential” treatment to an influential Wall Street banker, suspected of tipping Pequot’s CEO about a pending merger. PAREDES.DOC 9/8/2006 9:12:27 AM ON THE DECISION TO REGULATE HEDGE FUNDS: THE SEC’S REGULATORY PHILOSOPHY, STYLE, AND MISSION Troy A. Paredes* In a controversial move in late 2004, the Securities and Ex- change Commission (SEC) decided to require hedge fund managers to register with the agency as investment advisers. Until then, the SEC had largely refrained from ramping up hedge fund regulation, even after the collapse of Long-Term Capital Management in 1998. Although this article takes some issue with the SEC’s decision to regulate hedge funds, its primary focus is not on the particular costs and benefits of regulating hedge funds. The inquiry is broader: what can we learn generally about SEC decision making and securities regulation from the SEC’s decision to regulate hedge funds now by subjecting fund managers to the registration requirements of the In- vestment Advisers Act? Since the SEC consciously shifted direction in deciding to regulate hedge funds—and in doing so overstepped the traditional boundary of securities regulation by looking past the abil- ity of sophisticated and wealthy hedge fund investors to protect them- selves—the hedge fund rule prompts reconsideration of SEC decision making, particularly in the aftermath of Enron and the other recent corporate scandals that marked the early 2000s. Although nobody knows for sure what motivates a regulator, the SEC’s decision to adopt its new hedge fund rule is consistent with two views—one political; the other, psychological.
