Background
Best Practice to periodically review Community Governance Arrangements – LGPIHA 2007
Reviews conducted for Crewe in 2009 (and 2011) and for Wilmslow Handforth and Styal in 2010
In June 2011 decision taken to conduct a further review in Crewe followed by a review of the unparished area of Macclesfield.
A Sub Committee of 6 Members set up to conduct the Reviews
Background
Process being followed for reviews commenced as early as 2009
Different Political Landscape at that time
There was an appetite for all areas of the Borough to be parished at that time
One driving force was the issue of double taxation (e.g. parish council tax for Nantwich per Band D Property is £89.74)

Political landscape has now changed - new Leader elected in 2012
Still following the agreed “process” established in 2009

What is the purpose of a Community Governance Review ?
Opportunity to improve arrangements for :
– Community Engagement – Local Democracy – Effective and convenient delivery of local services
Can result in new community organisations, other local arrangements, or new parish / town council(s) being created Review Process
A Council Sub Committee responsible for the process:
– Determine viable options for community governance – Draw up a Consultation Plan – Consultation – Stage 1 – Stakeholders and public – Consultation – Stage 2 – Local Government Electors – Evaluation and analysis of responses – Draft recommendation formed – Consultation on draft recommendation – Stage 3 – Council decision on outcome of the review Area covered by the Review
Unparished area of Macclesfield which involves the following Cheshire East Council Wards:
– Broken Cross and Upton – Macclesfield Central – Macclesfield East – Macclesfield Hurdsfield – Macclesfield South – Macclesfield Tytherington – Macclesfield West and Ivy

Refining Options August 2013 – May 2014
Stage 2 Consultation 4 June 2014 – 28 July (5pm)
Draft recommendation Autumn / New Year

– The Council would need to agree a Re-organisation Order to bring any arrangements for any new parishes into effect
– Any elections required would take place there after
Consultation Process
Central to the Review
Includes:
– Local government electors in the area under review;
– Any person or body with an interest in the review. Criteria for the Review
Set by Local Govt and Public Involvement in Health Act 2007; and Government / Electoral Commission Guidance
Must ensure that community governance will be:
– Reflective of the identities and interests of the community in the area; and
– Effective and convenient

Should reflect distinctive and recognisable communities of interest with their own sense of identity

Summary of Options at Stage 1 Consultation A number of options were suggested including:
– Community Development Trusts
– Neighbourhood Management
– Residents’ and Tenants’ Organisations
– Community Associations
– One or more Parish/ Town Councils
– No Change
Outcome of Stage 1 Consultation
114 people attended the public meetings
94 responses were received of which 68 expressed an opinion on the 7 options
46 people wished to see a Town Council
10 people wished to see multiple parish councils
4 people wished to see No Change
No demonstrable support for the other options Options at Stage 2 Consultation
The 7 Options were refined based on the feedback received to:
– An Enhanced Macclesfield Local Service Delivery Committee; or
– Parishing:
– A Single Town Council for Macclesfield
– 7 Smaller Parish Councils (Based on Borough Ward Boundaries)
An Enhanced Macclesfield Local Service Delivery Committee
Consists of 12 Cheshire East Councillors for Macclesfield
Functions it could deliver are:
– To investigate and monitor services and make recommendations to the Cabinet on the level of service provision
– To be a Council consultee on matters and decisions relating to the area such as planning and traffic management
An Enhanced Macclesfield Local Service Delivery Committee
Functions it could deliver (cont) are:
– Liase and cooperate with local organisations to pursue the wellbeing of the area
– To make recommendations with regard to local grant aid applications and to make recommendations in relation to local car parks, markets, community centres, allotments, visitor centres and toilets
Cost: Dependant upon functions, likely to be significantly less expensive than a Parish / Town Council . However, the LSDC could, if it wished, set a special expense levy as part of the Council Tax for Macclesfield residents.
Parish (Town) Councils
Can choose to deliver services (e.g. public toilets, allotments, Christmas lighting, floral arrangements, bus shelters, litter bins, tourism, traffic calming) Localism Act 2011 gives greater powers to parish councils Charter Trustees would be dissolved Separate Legal Entity Parish Councillors would be elected There would be a Parish Council Tax – great variance in cost depending upon size and the services delivered (e.g. Nantwich Parish Precept - £89.74 – although this varies)

Consultation also open to any person or organisation with an interest in the Review to express their views
Next Steps
Sub Committee will consider representations received
Recommendation will then be made to the Council’s Constitution Committee leading to a Stage 3 Consultation
Stage 3 Consultation
The Council will publish the draft outcome for the review and will consult stakeholders before finalising recommendations
Final Decision / Outcome of the Review
Following Stage 3 Consultation, the final decision is made
Arrangements for a Macclesfield Enhanced Service Delivery Committee will then need to be put in place or a Re-organisation Order would be required should any parishes be established
