The following Bills are made public in accordance toith Article 17 (1) (d) of the Palestine Order-in-Council, 1922, as amended by Article 3 of the Palestine (Amendment) Order-in-Council, 1923.

An Ordinance to amend the law with regard to Imprisonment for Debt. [In substitution for the Bill published in the Official Gazette No. 255 of the 16th March, 1930, pages 172-174].

BE IT ENACTED by the High Commissioner for Pales­ ־: tine, with the advice of the Advisory Council thereof

Short Title. 1. Tins Ordinance mav be cited as the Imprisonment for Debt Ordinance, 1931.

Definition. 2. In this Ordinance-

"Chief Execution Officer" includes any judicial officer duly appointed by the President of the District Court by an order in writing to act for him, and any Magistrate on whom the Chief Justice has by an order in writing conferred the powers of an Executive Officer.

(a) If the debtor has failed to comply with a judgment for payment of alimony or maintenance of a child of the judgment debtor, or for payment to the Moslem Orphan Fund or to a charitable. Waqf.

(b) If the debtor has failed to comply with a criminal judgment For payment of a fine, costs or Court fees.

(c) If the Chief Execution Officer is satisfied that:

(i) the debtor then has, or, since the making of the judgment or order, has had, sufficient means to pay the money directed to be ])aid or some part thereof which still remains unpaid, or any instalment of the debt due under an order of the Chief Execution Officer, and that he refuses or neglects to pay it; ' .

(ii) the debtor has made or suffered to be made any gift, delivery or transfer of any property, or has charged, removed, or concealed any property, and has actually prevented the creditor from obtaining payment of the judgment debt or any part thereof.

.(d). If the Chief Execution Officer has reason to believe that the judgment debtor who has not disclosed assets within the jurisdiction of the Courts of Palestine sufficient to satisfy the judgment debt, or given security for the payment thereof, intends to abscond.

Period of 4. (1) Save in the matters prescribed by subsection (2) imprisonment. 0f fais Section, the period of imprisonment ordered under this Ordinance shall not in any case exceed twenty-one days.

by the sentence, the Court may, in lieu of issuing a warrant of seizure and sale of the movable property of the convicted person, order his imprisonment for a period equivalent to one- day for every 100 mils or any less sum remaining unpaid, provided that, unless the Court in its sentence has fixed the period of imprisonment to be undergone in default of payment, the period shall not be less than seven days.

Provided that, where the Chief Execution Officer has made an order that the payment of the judgment debt shall be made by instalments, the Chief Execution Officer may, if he thinks fit, for the purpose of this Section treat every such instalment as a separate debt.

6. 8. (1) No order of imprisonment shall be made under Persons not this Ordinance against any person who has not attained the liable to ageLof118 or is an idiot or lunatic; nor against a pensionable imprisonment. Government officer.

(2) Imprisonment shall not be ordered in respect of a judgment debt between an ascendant and descendant or between husband and wife, except where the judgment is for alimony or maintenance of children.

9. 10. When the judgment creditor applies for a warrant Fee payable on of committal against the judgment debtor, he shall pay a fixed committal order, fee of 500 mils; provided that

(a) the fee shall be added to the judgment debt and be recoverable from the judgment debtor together with the debt and the costs without need of a fresh judgment.

(b) If the judgment debt is for alimony, maintenance, rates, taxes, fines or Court fees, or for money owing to the Moslem Orphan Fund or to a charitable Waqf, the Chief Exe­ cution Officer may in his discretion exempt the judgment creditor from paying the fee in advance. But nothing herein shall exempt the judgment debtor from liability to pay the fee in addition to the judgment debt. 4 OFFICIAL GAZETTE 1st January, 1931.

Examination of 12. On the appearance of the debtor, he may be examined

discovery. on or on behalf of the creditor, and by the Chief Execution Officer, respecting his ability to pay the money, and for the discovery of property applicable to the payment of the debt, and as to the disposal which he has made or is proposing to make of any property in order to defeat the creditor, or as to his intention to abscond. He shall be bound to produce, on oath or otherwise, his passport and all books, papers and docu­ ments in his possession or power relating to property applicable to the payment.

Evidence. 13. Whether the debtor appears or not, the creditor and all other witnesses whom the Chief Execution Officer thinks requisite may be examined, on oath or otherwise, respecting the matters aforesaid.

An Ordinance to amend the law relating to the sale and supply of Intoxicating Liquors.

BE IT ENACTED by the High Commissioner for Pales­ tine, with the advice of the Advisory Council therof:-

Short Title. 1. This Ordinance may be cited as the Intoxicating Liquors (Sale on Credit) Ordinance, 1931.

Definition. 2. For the purpose of this Ordinance -

"Intoxicating liquors" means spirits, arak, cognac, wine, beer, cider, perry, and any other fermented or alcoholic liquors which contain more than 2% alcohol.

Restriction of 3. It shall not be lawful for any licence holder under sale on credit the Intoxicating Liquors and Public Entertainments Ordinance, of liquors for consumption on 1922, to supply any intoxicating liquor for consumption on his the premises. premises, or for any person to consume any such liquor on the premises in which it is purchased, unless either- 1st January, 4931. (a) the intoxicating liquor is paid for in ready money / before or at the time at which it is sold or supplied; or (b) the intoxicating liquor is ordered and consumed at the same time as a meal is ordered and consumed, and is paiid for together with the price of such meal on the completion of such meal. Provided that nothing in this Section shall be deemed to prohibit or restrict the sale or supply of intoxicating liquor to or in any canteen, mess or institute maintained or carried on under lawful authority for the use of His Majesty's Forces in Palestine. And provided further that nothing herein shall be deemed to restrict the sale or supply of intoxicating liquor to any bona /?^resident at a hotel. 4. Every holder of a licence who either by himself or Penalty for by a servant or agent shall supply, and every person who shall contravention, consume, any intoxicating liquor in contravention of this Ord• inance shall be liable on conviction to a fine not exceeding £P.20; and, in any case, if the person convicted is a licence holder, the conviction shall be recorded on his licence.

(2) IMMIGRATION ORDINANCE, 1925. Appointment of Immigration Officers. Notice is hereby given that the High Commissioner has appointed the following Officers to be Immigration Officers for the purposes of the Immigration Ordinances, 1925-1928:- The Officers irom time to time discharging the duties of Inspectors of Immigration and Travel at , Haifa and Kantara, and the Police Officers from time to time in Charge of Gaza Police Division, and of the Police Posts at Ras el Nakurah, Roshpina and Samakh. 2. NOTICE OF APPOINTMENT.

In exercise of the powers vested in him by Section 5 (2) of the Orthodox Patriarchate Ordinance, 1928, the High Commissioner has appointed Major H. F. Key to act as Chairman of the Financial Commission, with effect from the 20th October, 1930, during the incapacity of the Chairman, Mr. H. F. Smallwood, C.M.G., by reason of absence from Palestine.

In exercise of the powers vested in him by Section 2 of the Land Settlement Ordinances, 1928-1930, the High Commissioner has authorised Mr. Jonathan Blumenfekl, Assistant Settlement Officer, to act for the Settlement Officer of the Settlement Area of the Jaffa Sub-District for the purpose of exer­ cising the powers vested in and discharging the duties laid upon the Settlement Officer by paragraph 4 (2) (a) and (b) of the Order under Section 33 of the Principal Ordinance, published in the Official Gazette of the 16th December, 1930.

(5) LAND SETTLEMENT ORDINANCES, 1928-1930. ׳• .Order by the High Commissioner under Section 33 J. R. CHANCELLOR High Commissioner.

In exercise of the powers vested in him by Section 33 of the Land Settlement Ordinances, 1928-1930, the High Commissioner has ordered that within the boun­ daries of the village of Safriye in the Settlement Area of theJaffa Sub-District no registration of land held in separate ownership by any claimant shall be effected where the area or the breadth of a parcel is less than the following minima, provided that two or more minor heirs represented by a single guardian.shall, for the purpose of the Order, be considered as one claimant.

MINIMA.

Category of Land. Area. Breadth.

(a) Arable land not included in any of the following categories: 1 dunum 5 metres.

(b) Orchards: 1/9dunum 5 metres.

(c) Gardens and enclosures for the custody of animals in the vicinity of a village site within an area to be defined by the Settlement Officer: '*/* dunum 21/2 metres. 1st January, 1931. OFFICIAL GAZETTE 7

2. Registration of the following may be effected without regard to the area or breadth of a parcel:

Buildings.

The site on which a building is erected, or which is reserved for a building.

Private or party roads.

The yard appurtenant to a house.

Wells and land appurtenant to wells.

Private streams and irrigation channels.

. Private threshing-floors.

Private quarries.

3. Where the breadth of a parcel is less, but the area is not less than any of the prescribed minima, the Settlement Officer may at his discretion order the adjustment of the boundaries of a parcel or parcels with the boundaries of an adjoining parcel or parcels by the exchange of land of equal value.

4. (1) A fragment of land which under the terms of this Order may not be registered, shall be added to the land of an adjoining owner who shall pay to the owner of the fragment compensation which shall be assessed by the Settlement Officer.

(2) Where there are two or more adjoining owners, the addition of the fragment shall be effected by the Settlement Officer in one of the ־: following ways

(a) where only one adjoining owner desires the transfer to him of the fragment, it shall be added to his parcel;

(b) where more than one of the adjoining owners desire the transfer : ! to them of the fragment, it shall be added to the parcel of such adjoining ;owner as may be decided by lot ־.־•־.

(c) where none of the adjoining owners desires the transfer of the ;]> fragment, it shall be added to the parcel of such adjoining owner as the Settlement Officer may direct.

Provided that no fragment shall be added to any parcel unless the parcel resulting from such addition is capable of registration under the terms of this Order.

(3) Where more than one fragment of land are incapable of regist­ ration under this Order, the Settlement Officer may combine a sufficient number of such fragments to form a parcel which is capable of registration under the terms hereof. The person in whose name the parcel resulting from such addition shall be registered, shall be decided by the Settlement Officer in one of the following ways:

(a) where only one of the owners of the parcels desires the com­ bined parcel resulting from such addition, it shall be registered in his name;

(b) where more than one of the owners of the parcels desire the combined parcel resulting from such addition, it shall be registered in the name of such owner as may be decited by lot;

V (c) where none of the adjoining owners desires the combined parcel׳; resulting from such addition, it shall be registered in the name of such one of the owneis as the Settlement Officer may direct. 8 OFFICIAL GAZETTE 1st January, 1931.

(6) URBAN PROPERTY TAX ORDINANCES, 1928-1929. Order bv the High Commissioner. J. R. CHANCELLOR High Commissioner.

In exercise of the powers vested in him by Section 3 (1) of the Urban Property Tax Ordinances, 1928-1929, the High Commissioner has declared that the Urban Property Tax Ordinances, 1928-1929, shall apply to the Urban Area of Jenin, and that in place of the house and land tax payable at the date hereof, there shall be payable annually from the 1st day of April, 1931, by the reputed owners of house property and land within the Urban Area of Jenin a tax which shall be assessed and paid in accordance with the provisions of the said Ordinances. For the purpose of the Ordinances, the Urban Area of Jenin shall be the area comprised and outlined in red on the Survey Department map of Jenin and environs on the 1/1.250 scale. Copies of the map and of a schedule giving the full description of the boundaries of the said Area signed by the Commissioner of Lands are exhibited at the District Office, Jenin, the Land Registry, Jenin, Jenin Municipal Office, and the Office of the Commissioner of Lands, Jerusalem, and are open for inspection by any member of the public at any of these places between the hours of 10 a.m. and noon. (10) PORTS ORDINANCES, 19264930. Regulation with regard to Light Dues. J. R. CHANCELLOR High Commissioner. In exercise of the powers vested in him by Section 4 of the Ports Ordinance, 1926, the High Commissioner in Executive Council has varied as follows the Regulation with regard to Light Dues which was published in the Gazette of the 1st July, 1930. k'With effect from the 1st January, 1931, the total payment on account of light dues in respect of any one vessel shall not exced £P. 35." In exercise of the powers vested in him by Section 14 (p) of the Road Transport Ordinance, 1929, His Excellency the High Commissioner has made the following Regulation: 10 OFFICIAL GAZETTE 1st January, 1931.

(12) DISEASES OF ANIMALS ORDINANCE, 1926. Notice by the High Commissioner under Section 16. J. R. CHANCELLOR High Commissioner. In exercise of the powers vested in him by Section 16 of the Diseases of Animals Ordinance, 1926, the High Commissioner has declared that the villages of Mansura and Balfouriah in the Sub-District of Ramleh and , respec­ tively, and the lands belonging thereto, are infected areas for the purposes of the said Ordinance, so far as poultry.are concerned, on account of the exis­ tence of fowl pox therein. It is further notified that the French Government has intimated to •His Majesty's Government that the formality of visas may be dispensed with in the case of British subjects proceeding to the French Zone in Morocco.
