INTRODUCTION On Tuesday, April 21, 1992, Robert Alton Harris became the first person to be executed in California in over 25 years. 2 It was perhaps predictable, therefore, that his execution was pre ceded by a flurry of legal activity.3 Last minute lawsuits pre empted a holiday weekend and extended into the early hours of the morning up until just 20 minutes before his 6:21 a.m. execu tion," The bulk of Harris' legal maneuvers encompassed a total of 16 habeas appeals over a 14 year period. II This article touches on only three of the many issues raised by the Harris case. 6 First, it explores the appropriateness of 1.

CERTIORARI TO THE UNITED STATES COURT OF APPEALS FOR THE ELEVENTH CIRCUIT No. 03–6821. Argued March 29, 2004—Decided May 24, 2004 Three days before his scheduled execution by lethal injection, petitioner filed a 42 U. S. C. §1983 action against respondent Alabama prison officials, alleging that the use of a “cut-down” procedure requiring an incision into his arm or leg to access his severely compromised veins constituted cruel and unusual punishment and deliberate indiffer- ence to his medical needs in violation of the Eighth Amendment. Pe- titioner, who had already filed an unsuccessful federal habeas appli- cation, sought a permanent injunction against the cut-down’s use, a temporary stay of execution so the District Court could consider his claim’s merits, and orders requiring respondents to furnish a copy of the protocol on the medical procedures for venous access and direct- ing them to promulgate a venous access protocol that comports with contemporary standards. Respondents moved to dismiss the com- plaint for want of jurisdiction on the grounds that the §1983 claim and stay request were the equivalent of a second or successive habeas application subject to 28 U.

  • URGENT ACTION PERSON with MENTAL DISABILITY FACES EXECUTION Imdad Ali, a Death Row Prisoner with a Mental Disability, Is at Imminent Risk of Execution
UA: 222/16 Index: ASA 33/4907/2016 Pakistan Date: 28 September 2016 URGENT ACTION PERSON WITH MENTAL DISABILITY FACES EXECUTION Imdad Ali, a death row prisoner with a mental disability, is at imminent risk of execution. He was convicted of the murder of a religious teacher in 2002. In 2012, he was diagnosed with “paranoid schizophrenia”. International law clearly prohibits the use of the death penalty against people with mental or intellectual disabilities. Imdad Ali was arrested for the murder of a religious teacher in 2001 and convicted in 2002 under 302(b) of the Pakistan Penal Code. In 2012, he was diagnosed with “paranoid schizophrenia”. Dr. Naeemullah Leghari, the head of psychiatry at Nishtar Hospital in Multan who examined Imdad Ali, described his condition in a medical report as “a chronic and disabling psychiatric illness” that “impairs the person’s rational thinking and decision-making capabilities.” In 2015 the Pakistani Supreme Court rejected Imdad Ali’s appeal, ruling that there was no evidence of his mental disability. However, the Supreme Court’s judgment shows that Imdad Ali’s state-appointed lawyer had not included the 2012 medical report diagnosing him with paranoid schizophrenia as evidence. This oversight raises fair trial concerns. Imdad Ali has been issued two execution warrants since 2015. The latest execution was scheduled for 20 September 2016, but he was given a stay at the last minute so the Supreme Court could consider whether his execution warrant should be suspended on grounds of his mental disability. On Tuesday 27 September, the Supreme Court dismissed the appeal.

FOR PUBLICATION UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT UNITED STATES OF AMERICA, No. 20-99009 Plaintiff-Appellee, D.C. No. v. 3:01-cr-01062-DGC-1 LEZMOND C. MITCHELL, Defendant-Appellant. OPINION Appeal from the United States District Court for the District of Arizona David G. Campbell, District Judge, Presiding Argued and Submitted August 18, 2020 Pasadena, California Filed August 19, 2020 Before: Sandra S. Ikuta, Morgan Christen, and Andrew D. Hurwitz, Circuit Judges. Per Curiam Opinion 2 UNITED STATES V. MITCHELL SUMMARY* Stay of Execution The panel denied Lezmond Mitchell’s emergency motion to stay his execution pending appeal and affirmed the district court’s order denying his motion to strike his execution warrant, vacate the execution, or enjoin violation of the district court’s original judgment. Mitchell argued that if the Bureau of Prisons follows its execution protocols, his execution will not be implemented in the manner prescribed by the law of Arizona, and thus will be in violation of the judgment and the Federal Death Penalty Act, 18 U.S.C. § 3596(a) (FDPA). The panel assumed without deciding that the Arizona Department of Corrections’s Department Order 710 (Department Order Manual) constitutes “law of the State” for purposes of the FDPA and the judgment, and held that procedures that do not effectuate death fall outside the scope of § 3596(a). The panel considered the six purported inconsistencies Mitchell identified between the BOP’s execution protocol and procedures in the Department Order Manual, and concluded that Mitchell did not carry his burden of proving a reasonable probability that his execution will be carried out in a manner inconsistent with Arizona law or that it is more probable than not that he will suffer any irreparable harm.

MacKay: The Rise of Systematic Pre-Exclusion Delay: Proposing a Solution THE RISE OF SYSTEMATIC PRE-EXECUTION DELAY: PROPOSING A SOLUTION TO DECADES ON DEATH ROW Krista MacKay* Abstract Although the claim that death row inmates’ pre-execution delays violate the Eighth Amendment has been historically unsuccessful, the decision in Jones v. Chappell paved a new path to its success. In Jones, despite the Ninth Circuit’s disagreement, a federal judge in California became the first to rule that systematic delay has rendered California’s death penalty system unconstitutional. The court in Jones defined systematic delay as delay inherent to the state’s dysfunctional administration of the death penalty. Due to increasing pre-execution delays nationwide and recent initiatives to examine and repeal state death penalty systems, other state courts may soon come to recognize and declare systematic delay unconstitutional using reasoning similar to the court in Jones.
