ADA endorsed providers Bill to cut red tape for auto dealers advances

Ongoing educational programs U.S. Representative Gary Peters (D-MI) has applauded the U.S. House Energy & Commerce Committee's unanimous passage of PDF of Fast Facts (fax version) a bipartisan bill he authored with Congressman Bob Latta (R-OH) that would eliminate redundancies and red tape and invest in Michigan auto manufacturers, dealers, and consumers.

The Peters-Latta initiative, H.R. 724, would eliminate the need for additional paperwork when selling and buying new cars and trucks. Currently auto dealers must provide consumers with a certificate confirming a vehicle's compliance with The Clean Air Act, even though all cars and trucks sold in the U.S. must comply with The Clean Air Act. The bill passed unanimously by voice vote and is expected to go to the U.S. House Floor next year.

CVR inventory count: January 10

Dealers participating in the CVR program are reminded that the count and physical verification of inventory must be taken Friday, January 10 prior to any transactions being processed for the day. The state suggests the following method to verify and report inventory. (This should take about 15 minutes.)

1.) Print a report of your current available inventory from the CVR computer.

2.) Verify the report by a physical check of the actual inventory to ensure that each plate or tab/permit is present. Sealed boxes do not need to be opened, simply check the labeling on each package.

3.) If there are no discrepancies between the printed report and the physical verification, type the requested inventory numbers into the CVR computer: beginning and ending numbers for plates and tabs and permits in inventory, as well as the total number of each (as shown on the available inventory report).

4.) Submit the report.

While dealers are given until Wednesday, January 15 to submit the report, inventory must be counted and verified on January 10 prior to any new CVR transactions being processed.

Dealers who do not submit the required information are in violation of their agreement with the Michigan Department of State and risk losing the ability to use the CVR program. If you have questions, please contact your CVR account representative or CVR support at (800) 333-6995.

Return 2013 tabs to CVR WAREHOUSE

Please note that 2013 tabs are now obsolete and must be returned by Friday, January 31. Please review these steps:

1) Log into Inventory, run an Inventory Available report.

2) Verify series numbers for 2013 tabs on the report.

3) Verify 2013 tabs in inventory match printed report. 4) Mark 2013 tabs as "obsolete" in inventory.

5) Package tabs, note dealership name and license # (or include copy of Inventory Available report) and return to:

FTC announces a nationwide sweep against deceptive auto dealer ads

The Federal Trade Commission announced on Thursday that nine auto dealers agreed to settle deceptive advertising charges, and the agency is taking action against a 10th dealer, in a nationwide sweep focusing on the sale, financing, and leasing of motor vehicles.

According to the complaints, the dealers made a variety of misrepresentations in print, Internet, and video advertisements that violated the FTC Act, falsely leading consumers to believe they could purchase vehicles for low prices, finance vehicles with low monthly payments, and/or make no upfront payment to lease vehicles. One dealer even misrepresented that consumers had won prizes they could collect at the dealership.

"Buying or leasing a car is a big deal, and car ads are an important source of information for serious shoppers," said Jessica Rich, director of the FTC's Bureau of Consumer Protection. "Dealers' ads need to spell out costs and other important terms customers can count on. If they don't, dealers can count on the FTC to take action."

"Operation Steer Clear" is the latest effort from the FTC to protect consumers in the auto marketplace.

The Federal Reserve and CFPB Announce Jan. 1 Increase in TILA and Consumer Leasing Act Thresholds The Federal Reserve Board and the Consumer Financial Protection Bureau (CFPB) announced that the dollar thresholds in Regulation Z (Truth in Lending Act) and Regulation M (Consumer Leasing Act) for exempt consumer credit and lease transactions will increase to $53,500 beginning Jan. 1, 2014. This means that beginning Jan. 1, 2014, consumer credit transactions and consumer leases at or below $53,500 are subject to the protections of the regulations. These increases are consistent with the Dodd-Frank Act amendments to the Truth in Lending Act and the Consumer Leasing Act to adjust these thresholds annually by the annual percentage increase in the Consumer Price Index.

NADA's Used Vehicle Price Index Reaches All-Time High in November After diving by 3.5% in October, the rate of used vehicle depreciation slowed substantially to 1.5% in November, pushing the NADA seasonally adjusted used vehicle price index to its highest point of 125.6. The index, which measures the change in prices for used vehicles up to eight-years-old, is up 1.8 points from October's figure of 123.8, surpassing the previous high of 125 set in December 2012. "November's decline in the rate of depreciation can be credited to favorable market conditions, lower unemployment, moderating gas prices and advantageous credit conditions, including the end of the federal government shutdown in October," said Jonathan Banks, executive automotive analyst of the NADA Used Car Guide, in the December edition of Guidelines, a monthly report on new and used vehicle sales trends and price movement.

Lake Agency Inc. - Mr. John Racine Phone (810) 694-2050 E-mail: [email protected] Offering insurance options to Michigan dealers. Outlook and estimates related to Michigan's motor vehicle industry The House Fiscal Agency recently released the Economic Outlook and Revenue Estimates for Michigan, FY 2013-14 through 2015-16. Following are the outlook and estimates related to Michigan's motor vehicle industry.

The level and composition of light motor vehicle sales is a key component of Michigan's economy. Light motor vehicle sales are expected to total 15.5 million units in CY 2013, which would be a 7.2% increase from the previous year. Light motor vehicle sales are forecast to be 16.0 million units in CY 2014, then increase to 16.4 million units in CY 2015 and 16.7 million units in CY 2016 as the national expansion continues.

Imports and transplants (vehicles with a foreign nameplate that are made in the U.S.) have steadily gained in market share over the past several years; however since 2009 the market share of these vehicles has stabilized. As shown in Figure 7, the market share of the Detroit 3 auto manufacturers hovered around 44.5% in CY 2013 and is expected to increase only very slightly throughout the forecast horizon.

The extent to which the domestic nameplates can retain market share will have a direct impact on Michigan's economy. In CY 2013, the Detroit 3 is expected to sell 6.9 million vehicles, which would translate to an 8.0% increase from the previous year. It is expected that the Detroit 3 will sell 7.1 million vehicles in CY 2014 and continue to post healthy gains in CY 2015 and CY 2016.

After significant declines since CY 2000, Michigan transportation equipment employment increased 7.6% in CY 2012 and is forecast to increase 5.7% in CY 2013, 4.5% in CY 2014, 1.5% in CY 2015, and 1.9% in CY 2016. The CY 2016 estimated level of transportation equipment employment of 178,000 is 51% of the 346,000 peak in CY 2000. If the Michigan-produced market share of motor vehicles is greater or less than anticipated, Michigan's economy and revenue growth will be higher or lower than estimated. Demo Affidavit, Form 137

As a reminder, MADA offers members a demo affidavit form for calendar year 2014, which can be used when titling demonstrator vehicles for tax exempt purposes. The form is set up to be completed electronically, then printed as a two-sided document.

NADA Guidance: Service Provider Dealer Data Access Addendum

NADA recently e-mailed guidance to its members relating to regulatory compliance in connection with dealer data access. The message included a sample Service Provider Dealer Data Access Addendum and cover memo created by NADA Legal and Regulatory Affairs for dealers to use with their third party service provider vendors. This follows an August 2013 NADA memo, which offered an overview of the primary regulatory issues surrounding Dealer Data, numerous practical tips for dealers to consider when protecting their data, as well as samples of the contract provisions required under federal law when a dealer wishes to allow access to Dealer Data with a third party service provider.

The recent addendum was drafted in an effort to clarify and simplify dealers' obligations to ensure that their applicable vendor contracts contain certain provisions required under federal law. It is a sample only, and should be used by dealers only after consultation with their legal counsel. Adoption of the addendum is not the only way dealers can meet their legal obligations and it may not be right for every situation. However, if they choose, dealers can use the addendum to amend their service provider legal agreements to satisfy the applicable contractual requirements.

If you have questions please call NADA Regulatory Affairs at (703) 821-7040.

This may mean having all ads and promotions reviewed according to BBB guidelines, Regulations Z and M, or by an attorney who specializes in advertising. As a reminder, dealers are ultimately responsible for their own advertisements. Don't automatically assume the material from manufacturers or ad agencies is compliant. And just because the competition advertises in a particular manner doesn't mean it follows guidelines set by the FTC.

Automotive News: Best Dealerships to Work For program

Dealerships are encouraged to participate in the Best Dealerships to Work For program, created by Automotive News. This third annual search will identify and celebrate the best employers among automotive dealers in the United States and Canada, as measured by satisfaction through a confidential survey of employers and employees.

To be eligible for consideration, a dealership must: 1) be a new-vehicle store, 2) have at least 25 employees working in the United States or Canada, and 3) have been in business at least a year. Each dealership must register as a single rooftop. Dealerships that are part of a group should register individually. There is a fee of $125 per dealership. The registration deadline is March 21. More information is available at www.autonews.com/bestdealerships.

Vehicle Dealer Supplemental Report (Form 92)

Due to the new law regarding sales tax on the difference, dealers have had questions regarding the Michigan Vehicle Dealer Supplemental Report (Form 92) and whether additional calculations are needed when computing and completing this form.

Form 92 is used to calculate the administrative fee or discount (.75%) on sales tax collected and remitted to the Secretary of State. It is required to be mailed in with your Discount Voucher for Sales and Use Taxes (Form 161) or Combined Return for Michigan Taxes (Form 160) on a monthly basis.

Treasury recommends that dealers continue using the current Form 92 and instructions for completing the form as you have done in the past. No changes are currently needed. If at a later time changes are needed, the state will work with affected parties in developing those changes.

We thank dealers for asking the questions and treasury for their quick response.

From the Ford Sales Bulletin for April 8, 1916

Flashes From the Front Fender By G. B. Tyler, Manager Syracuse Branch

Never judge a man's speed by the length of time between the time the whistle blows and the time they ring out at the clock. That's the only time of day that some men show any speed.

Always remember that any person who enters a Ford garage comes for a purpose; see to it that he gets what he wants, whether you are a salesman, porter or service man.

Don't look for all your prospects in the billiard room of the best hotel in town; live wires don't spend the working time of the day playing billiards. Look for them at their offices - that's where they business.

Some of your prospects may be found on the main streets of a big city, but when they are there, they are not looking for automobiles - not in this day of short skirts and white shoes.

Spend time enough around headquarters to know what you are talking about - never guess. Prospects are looking for information, and guess-work on your part won't go. The man who knows usually puts enough determination back of his argument to convince.

Eight hours of sleep, eight hours of recreation and eight hours of good faithful effort make up a pretty good day. And - don't overlook the first two.

Your prospect judges your Company by you. Make a careful inspection every morning, and see if you stack up to Company requirements for the day.

An ounce of confidence in yourself is worth a pound that the boss might have in you. Think it over.

After supper is a good time to measure yourself. Look over the day and locate the weak spots. Then determine to overcome them tomorrow.

"They say Jim Blank has a soft job," is a story often heard. If he has, it's because he made it easy by good hard work. Don't try to get Jim's job but go at it to make yours soft the way he did.

"Get up right in the morning. Go to bed right at night. Start with joy in your heart, hope in the future, kindness in your purpose. If it is a dark day, never mind, you will lighten it up. If it is a bright day, you will add to the brightness. Give a word of cheer, a kindly greeting and a warm handshake to friends. If you have any enemies, look up, pass them by, forget and try to forgive. If all of us would only think how much of human happiness is made by ourselves, there would be less of human misery. If all of us would bear in mind that happiness is from within and not from without, there would be a wellspring of joy in every heart and the sun would shine forever."

Fraudulent lien release

The Department of State is aware that many fraudulent lien releases have been provided to dealerships and private party sellers during the past few months. These releases are computer generated and appear to originate from various financial sources. The contact information printed on the forms has been found to be wrong, or forwards to a shell company set up to answer validation requests. Many of the lien releases have a notary stamp at the bottom. While some states do require a notary, in general this is an uncommon feature to see on this type of document. This level of forgery is difficult to police, but dealers are still encouraged to do their due diligence to validate the information. Questions about specific lien releases can be directed to your local branch office.

FTC Charges Arkansas Car Dealer with Not Displaying 'Buyers Guides'

The Federal Trade Commission has charged an Arkansas auto dealer with failing to display a "Buyers Guide" on used vehicles offered for sale, as required by the FTC's Used Car Rule. Each violation could result in a civil penalty of up to $16,000.

The FTC's Used Car Rule, which took effect in 1985 specifically requires used car dealers to disclose whether the car comes with a dealer's warranty or is being sold "as is." If the car is sold with a dealer's warranty, the Rule requires the Buyers Guide to list its basic terms and conditions, including the duration of coverage, the percentage of total repair costs to be paid by the dealer, and the exact systems covered by the warranty.

In January 2013, the FTC announced that its Southwest Region Office had warned 11 used car dealerships in Jonesboro, Arkansas, that their sales practices violated the Used Car Rule. All but the dealership charged subsequently came into compliance.

According to the complaint, the FTC visited the dealership in Jonesboro in November 2012, and found that none of the vehicles offered for sale displayed a Buyers Guide. The agency informed the dealership of that fact, and sent the dealership a copy of the Guide and the FTC publication, A Dealer's Guide to the Used Car Rule. In May 2013, the FTC re-visited the dealership, and an affiliated dealership, and found both dealerships were offering used vehicles for sale that did not display a Buyers Guide.

The full release from the FTC is available here.

Employment background checks: FTC and EEOC offer tips

Hiring decisions are among the most important choices for any employer, but the process can be complex. For the first time, the Federal Trade Commission (FTC) and the Equal Employment Opportunity Commission (EEOC) have co-published two short guides on employment background checks that explain the rights and responsibilities of the people on both sides of the desk.

The FTC and the EEOC want employers to know that they need written permission from job applicants before getting background reports about them from a company in the business of compiling background information. Employers also should know that it's illegal to discriminate based on a person's race, national origin, sex, religion, disability, or age (40 or older) when requesting or using background information for employment.

At the same time, the agencies want job applicants to know that it's not illegal for potential employers to ask someone about their background as long as the employer does not unlawfully discriminate.

February 2014 sales tax receipts decreased 5.2% from the prior year and were $21.9 million below the forecasted level. The declines reflected lower sales of items other than motor vehicles. February sales tax collections from motor vehicle transactions were up 0.9% from one year ago, although on a year-to-date basis sales tax collections from motor vehicle transactions are down 1.3%. Use tax collections were 5.4% above the February 2013 level.

Combined business tax collections from the SBT, Michigan Business Tax (MBT), and Corporate Income Tax (CIT) totaled $3.1 million for the month, reflecting MBT and SBT refunds that largely offset CIT collections. Net revenue from the MBT was a negative $15.4 million, while SBT revenue totaled a negative $9.7 million, both representing a net loss because refunds exceeded collections.

The state suggests the following method to verify Jun 2 * MADPAC golf outing and and report inventory. (This should take about 15 minutes.) MADA board meeting, Eagle Eye (New Location!) 1.) Print a report of your current available inventory from the CVR computer.

Complimentary dealer webinar: NADA's Fair Credit Compliance Program

Dealers are reminded of the upcoming Fair Credit Compliance Program webinar from NADA, held April 2, 2014 at 1:00 p.m. ET. This webinar will provide a general overview of the purpose and scope of the optional NADA Fair Credit Compliance Program as well as general and specific instructions for completing the program. The first part of the webinar will focus on the information the dealer principal or general manager needs to know and the second part will provide the information needed for the senior dealership employee who will actually develop, implement, and maintain the program. Presenter: Paul Metrey, NADA.

A link with registration information is available here.

Please review your RD-108 and RD-108T paperwork for accuracy

Secretary of State branch offices have noticed some RD-108 and RD-108T forms are being submitted improperly. As a reminder, the state developed the RD-108T following implementation of sales tax on the difference (STOD). This form must be submitted with any vehicle transaction involving a trade-in.

Some of the improper submissions may be due to DMS software that needs updating. Please confirm with your DMS provider that your software is current and accurate.

The amount on Line 3 of the RD-108 (total taxable price) will be the amount calculated on Line E of the RD-108T. This will include the STOD reduction. Line 1 and Line 2 on the RD-108 will not add up to Line 3 if a STOD trade-in is involved.

It is suggested that dealers carefully review the RD-108T and instruction sheet for additional details and further instructions.

While the state understands this is still a new procedure, dealers should now be accustomed to the changes. We expect the state will begin rejecting inaccurate paperwork in the near future. If you have any questions about the forms or calculations please call MADA at (800) 292-1923.

MADA legal consultant offers business insight to Northwood automotive students

Eric Bowden, a Partner at the Colombo & Colombo law firm and legal consultant to MADA and many dealers throughout the state, recently provided business insight and legal expertise to students in the Automotive Marketing & Management program at Northwood University. Eric was invited by the Chair of the Automotive Marketing program, Professor Elgie Bright.

Mr. Bowden's presentation covered the wide range of laws impacting auto dealerships including employment and labor, government regulation, consumer protection, advertising, retail sales and dealerships' relationships with manufacturers. He also discussed many of the federal laws that impact dealerships across the USA and gave specific examples of how situations can become serious legal issues if the appropriate policies are not in place and enforced.

Northwood Night at the Palace promotion

Students in Northwood University's Entertainment, Sport & Promotion Management (ESPM) program had the unique opportunity to work in the Detroit Pistons group ticket sales program at the Palace of Auburn Hills and sell tickets against one another throughout the season.

The friendly match-up will culminate in a special celebration at the Place on April 5 during the 7:30 p.m. game between the Pistons and the Boston Celtics. The top Northwood ticket sales team will be recognized via "Palace Vision" during halftime.

Tickets for Northwood Night at the Palace cost $30 for lower level seating, $15 for upper level and can be purchased by calling (248) 377-8620. Callers should indicate they are purchasing for the Northwood Night at the Palace promotion and if there is a specific student or selling team that should get the sales credit.

ADA endorsed providers Up to April 1st we had made and sold over 300,000 cars. With Ongoing educational programs the four best selling months of the year before us, the 500,000 mark seems assured. Production is under the most vigorous PDF of Fast Facts (fax version) swing, reaching as high as 2768 cars on the 25th of March, and for the month of March, a total production of 58,329 cars. An average of 50,000 cars for the next four months will swing us by the 500,000 mark, and with nothing to check the present speed we will swing, in July, into the "home stretch," an easy winner. And still we have not caught up with demand. Of course contingencies are possible that might interrupt or reduce or even stop production, but we don't anticipate any.

We are very excited for this year's big change. We have moved the tournament to Eagle Eye Golf Course (just off Lake Lansing Road) which has been rated among the best public courses in the nation.

Thanks to the generous support of many sponsors, all registration fees again go directly to our MADPAC campaign.

National Distracted Driving Awareness month

3,328 were killed in distracted driving crashes in 2012.

In an effort to bring awareness to this problem, April has been designated as National Distracted Driving Awareness month. Research shows that high visibility enforcement works to reduce distracted driving because, with many distracted drivers, the fear of a citation and fine outweighs the fear of being injured or killed in a crash.

The National Highway Traffic Safety Administration (NHTSA) and the Michigan Office of Highway Safety Planning (OHSP) have developed materials businesses may be interested in using to help promote this campaign.

Eight definitions that will define your success...or failure!

The following is an article from Dave Anderson, president of Learn To Lead, an international sales and leadership training and consulting company. Mr. Anderson will be the keynote speaker at the December 3 MADA Annual Meeting. Prior to beginning Learn To Lead, Mr. Anderson enjoyed an extensive and successful career in the automotive retail industry. He has given over 1,000 workshops and speeches over the past decade on sales and leadership development and has spoken in fifteen countries.

To get great performance in any endeavor you must first define it. At the same time, to avoid or correct failure, you must also define and recognize it. Following are eight key words and definitions; five for success and three for failure. Understanding these eight definitions help you do two things: 1. Create a solid blueprint and strategy for success 2. Recognize, avoid, or overcome failure.

By weaving the "success" definitions into both your mindset and daily routine you will build an unshakeable foundation for accomplishment. But at the same time you must understand, avoid, and overcome the "failure" mindsets and behaviors so that your growth continues unabated.

1. Success definition: Principle: Accepted or professed rules of action or conduct. Principles of success have wide applicability that will transcend jobs and industries. Sample Principle: You reap what you sow. Lesson: If you don't like what you're reaping, sow something else.

2. Success definition: Success: A few good decisions repeated over every day. Success is not an accident. It is a culmination of choices you make throughout your life. Sample success decisions: Planning your day before it begins and then scheduling your priorities to ensure they are done first.

3. Failure definition: Failure: A few wrong decisions repeated over every day. Failure is not an accident. You set yourself up for failure with wrong decisions, and guarantee it by repeating them. Sample failure decision: Deciding not to take responsibility for your life and proceed through life like a hapless victim.

4. Success definition: Hunger: An intense or compelling desire or craving. Hunger cannot be taught. It comes from within and is fueled by a desire to both become more, and achieve more. Sample hunger example: An intense desire to not only be the best, but to also continually best what you have done previously.

5. Failure definition: Complacency: Calmly content, smugly self-satisfied. Successful people are prime targets for complacency, because prosperity drains urgency. Sample complacent example: Setting goals that make you comfortable, rather than those that would stretch you because you cannot attain them with a business-as-usual approach.

6. Success definition: Consistency: Constantly adhering to the same actions or conduct. Consistency is a character-builder, and a key differentiator between the average and excellent. Sample consistent example: Deciding to keep your commitment even when it's not easy, cheap or convenient.

7. Success definition: Diligence: To give constant attention to. Diligence in right disciplines forms healthy personal habits, and builds strong cultures. Sample diligence example: Continuing to plan, prepare, practice, prospect and train even when business is robust.

8. Failure definition: Slack: Negligent or sluggish. Slack people only execute right actions occasionally-and never execute them consistently enough to become the best at what they do. Sample slack example: Working hard only when you feel like it, only when you have to, and only when someone is watching.

This might be an appropriate time for a quick personal audit to see which of these success definitions you need greater daily doses of, along with which failure mindsets and behaviors are holding you back that you must purge from your life.

Please help promote dealers on a statewide level

Dealerships are one of the most heavily regulated businesses in America. It is critical to the continued success of the industry that dealers have the proper resources in place to assess the political and legislative arena, and respond as needed. There are many ways we do this on both a state and federal level.

Michigan dealers have the Auto Dealers of Michigan, LLC to monitor activities within the state. Our legislative director regularly communicates with state legislators to keep our leaders updated about the economic benefits of this industry, but also to gauge their level of support for future issues. This open line of communication has proven successful on many issues in the past.

Dealers can individually help in the process by communicating with local legislators when important issues arise. You may also want to invite your local leaders to visit your dealership and meet the employees he or she represents. (ADM can help arrange if you are interested.) In addition, you can support MADPAC by participating in the annual golf outing (June 2), and with a personal contribution each year.

Your financial contribution to MADPAC enables us to help support the Michigan campaigns of dealer- friendly candidates. This is especially important as we lead up to an election year.

Please call Larry Parker at (800) 292-1923 to make your contribution to MADPAC .

Reminder about youth employment

As the school year comes to an end, some dealers may hire summer help from employees covered by the federal youth employment regulations. As a reminder, the U.S. Department of Labor offers the following guidelines about youth employment.

Employees 16 years of age and under may not drive motor vehicles on public roads as part of their jobs - even if they possess a valid state drivers license.

Employees 17 years of age may drive cars and small trucks on public roads as part of their jobs only if all of the following requirements are met: The driving is limited to daylight hours; The 17 year-old holds a state license valid for the type of driving involved in the job performed; The 17 year-old has successfully completed a State approved driver education course and has no record of any moving violation at the time of hire; The automobile or truck is equipped with a seat belt for the driver and any passengers and the employer has instructed the youth that the seat belts must be used when driving the vehicle; The automobile or truck does not exceed 6,000 pounds gross vehicle weight; AND Such driving is only occasional and incidental to the 17 year-old's employment. This means that the youth may spend no more than 1/3 of the work time in any workday and no more than 20% of the work time in any workweek driving.

Driving by 17 year-olds as part of their jobs may not involve:

Towing vehicles Route deliveries or route sales Transportation for hire of property, goods, or passengers Urgent, time-sensitive deliveries (such as pizza deliveries) Transporting more than 3 passengers including employees of the employer Driving beyond a 30 mile radius of the teenメs place of employment More than 2 trips away from the primary place of employment in any single day to deliver the employer's goods to a customer More than 2 trips away from the primary place of employment in any single day to transport passengers other than employees of the employer

Additional information is available within the DOL's website:

Driving Automobiles and Trucks (PDF) - General information concerning the application for the federal provisions for driving motor vehicles. Teen Driving (PDF) - Explains the child labor requirements for minors to operate motor vehicles.

When hiring youth employees, dealerships are also reminded to consult with their legal advisor and review their handbook guidelines. It is also a good idea to verify any possible coverage restrictions with your P&C provider.

NADA Dealership Workforce Study: deadline extended to June 30

To accommodate numerous requests from dealer members, the deadline to participate in the 2014 Dealership Workforce Study (DWS) was extended to June 30, 2014. Dealers are encouraged to submit their data as soon as possible in advance of the deadline to allow for the extensive data review process.

The DWS is the only NADA-ATD study that compares dealership compensation and benefits, retention and turnover and hours of operation to aggregated peer data. With the results, dealers can make data-based decisions on recruiting, hiring and motivating employees. Only NADA and ATD members are eligible to participate, and there is no cost.

It's easy to participate. There are separate processes for single dealership and dealer group enrollments. Further, participants in the 2013 study will find the survey conveniently pre-populated with their previous answers, which can be changed as necessary. Finally, this year's reports will be sent directly to the person identified as report recipient. Reports will be sent as soon as they are available.

Each participating dealership will receive a complimentary, customized Basic Report comparing its data against data aggregated on a regional and national basis-plus a complimentary, comprehensive Dealership Workforce Study Industry Report.

Participants can also purchase a customized Enhanced Report, which further compares individual dealership data against data for the franchise and state. Additional customized group reports are available, as is the Compensation and Tenure Search Tool, which enables ad hoc searches, including searches by dealership or dealer groups. Visit www.nadaworkforcestudy.com to participate.

Increase in theft of wheels

A dealer insurance specialist at Ally Financial wanted to notify dealers that certain areas of the state are currently experiencing an unusually high number of wheel thefts. Chrysler and Chevrolet vehicles seem to be a big target at the moment, but they are not the only targets. He reminds dealerships to use wheel locks when appropriate, and keep the key in a safe location away from the vehicle. Thieves can easily break a car window and grab the key from the glove box.

If you have any information to report or pass along to dealers please contact MADA at (800) 292-1923 or e- mail [email protected].

More about youth employment

In addition to the federal youth employment driving regulations we included in the May 2 Fast Facts, we would also like to remind dealers about work/time regulations relating to youth employment.

A minor 14-15 years of age must perform all work outside school hours. These minors may not work more than: (a) 6 days per week; (b) a combined school and work week of 48 hours when school is in session (c) 3 hours on a school day; (d) 18 hours per week when school is in session; (c) 8 hours per day when school is not in session; (e) 40 hours per week when school is not in session. In addition, they may not work before 7 a.m. or after 7 p.m. on any day, except from June 1st through Labor Day, when nighttime work hours are extended to 9 p.m.

Except as provided in certain agricultural situations, a person shall not employ a minor 16-17 years of age for more than any of the following periods: (a) 6 days in 1 week; (b) An average of 8 hours per day in 1 week; (c) 10 hours in 1 day; (d) 48 hours per week when school is not in session; (e) If the minor is a student in school and school is in session, 24 hours in 1 week. In addition, a minor cannot work between the hours of 10:30 p.m. and 6:00 a.m. (Except on Fridays and Saturdays, school vacation periods, or when the minor is not regularly enrolled in school; in these situations the minor can work until 11:30 p.m.)

All minors shall not be employed for more than 5 hours continuously without an interval of at least 30 uninterrupted minutes for a meal and rest period.

Michigan's Youth Employment Standards Act requires employers to have work permits for minors under the age of 18. The permit certifies the age and compliance with labor laws prior to the minor starting work. Employers must also have posted the appropriate labor law poster and keep an adequate time record of the number of hours worked by the minor including start/end times and meal/rest periods.

Furthermore, a minor shall not be employed in, about, or in connection with an occupation that is hazardous or injurious to the minors health or personal well-being.

The law also requires a minor to be supervised by the employer or another employee 18 years of age or older. In addition, a minor shall not be employed in an occupation that involves a cash transaction after sunset or 8 p.m., whichever is earlier, at a fixed location unless an employer or other employee 18 years of age or older is present at the fixed location during those hours.

This is only a very brief overview of the federal and Michigan laws regulating youth employment. As we previously noted, when hiring minors, dealerships are reminded to consult with their legal advisor and review their handbook guidelines. It is also a good idea to verify any possible coverage restrictions with your P&C provider.

Scam alert: calling to confirm credit card information

MADA has been informed about a scam that has affected other dealers in the Midwest.

A suspect goes to a dealership to buy a car and uses a pre-paid credit card. The card does not go through so the dealership calls the number on the back of the credit card. The dealer gets a code number from the suspect's co-actor who plays the part of a representative of (in this instance) Green Dot Bank located in California. Once the employee has the code, he enters a 6 digit number manually into his credit card machine terminal. The merchant can use any 4 or 6 digital combination to do an offline transaction. At the close of business the dealer completes a batch entry to link the offline transactions completed on the credit card terminal. Credit card offline transactions are electronically processed through the Automatic Clearing House (ACH). When Green Dot Bank receives the electronic information they charge back the transaction to the dealer's business account.

As we have mentioned before, scammers are getting more creative and their scams can be more difficult to detect. If you have fraud related information that may help other dealers please let us know. Call MADA at (800) 292-1923 or e-mail [email protected].

U.S. Senate passes bill dropping emissions certification; now goes to president

In a joint effort led by U.S. Representative and Congressional Auto Caucus Co-Chair Gary Peters (D- MI) and U.S. Senator Debbie Stabenow (D-MI), Co-Chair of the Bipartisan Senate Manufacturing Caucus, the U.S. Senate unanimously passed their bipartisan bill to cut red tape for Michigan auto dealers and consumers. The bill eliminates a redundant and outdated provision of The Clean Air Act requiring auto dealers to provide consumers with a certificate confirming a vehicle's compliance with the law even though every new model meets that standard. The bill now goes to President Obama for his signature.

We would like to thank Congressman Peters and U.S. Senator Stabenow for their continued support of dealers in Michigan and the country.

The 2000 Dodge Caravan once again topped Michigan's list of most stolen vehicles in 2012, and thieves' top color preferences for vehicles to steal remained black, followed by white and red. Bounced check scam: suspects caught

A west Michigan dealer alerted us to a check scam other dealers should be aware of. Two individuals visited the dealership to look at a vehicle, negotiated a deal and signed a bill of sale. They provided a check, but asked that it be held. When they returned to take delivery of the vehicle the check was cashed, state work completed and the individuals received the title to the vehicle. The check later bounced.

The individuals also visited a boat dealership on several occasions - in a beat up car the first time and the first dealership's stolen 2014 vehicle the next. The police believe the male is the ringleader of a national scam and after the suspects obtain vehicles they skip town and start the scam over in a new location.

We are pleased to say that observant employees at the dealerships helped catch the suspects this week. However, it is also very likely that others will quickly fill in where these scam artists left off.

Please continue to be vigilant and keep MADA updated as needed.

Dealers can go online and print a copy of their renewed status (which is often requested by finance companies)

Fraudulent business-vehicle purchase

A Battle Creek dealer would like others to be aware of a potentially fraudulent situation. The dealership was recently visited by an individual interested in purchasing two new trucks for his business. Something about the scenario didn't sound right so the dealership researched the issue online and ended up speaking with the Sanilac County Sheriff's Office when additional red flags were raised. It was determined that the "customer" was a repeat offender from Sanilac County and had been released from jail a few weeks prior for issues related to fraudulent use of financial information.

The suspect is very convincing and knows what to say and how to work the situation. He gave a real Michigan business name as his business and even went as far as to contact an automobile vendor in his area to order "graphics" for the trucks. It is believed he intended to gain dealership bank information in this instance. If you have information that may be related to this case please contact Detective Darrin Siemen with the Sanilac County Sheriff's Office at (810) 648-8360 or call MADA at (800) 292-1923.

As always, we appreciate your efforts in passing potentially fraudulent information along to MADA. Please continue to e-mail MADA at [email protected] if you have information to share.

Advertising: new times, new media, new rules

The following article was provided by MADA member, DealerTrack, written by Randy Henrick.

Complicated new rules and aggressive FTC oversight requires a disciplined approach in the review and application of advertising.

Advertising the sale or financing of motor vehicles has become increasingly complicated with an aggressive Federal Trade Commission (FTC) and the need to reach consumers (especially Millennials) through social media, which was never thought of when advertising laws and regulations were written. It certainly makes a dealer's life more complex.

The FTC has launched a new automotive program since the Dodd-Frank Act gave it streamlined authority to write regulations. It has also become much more active in pursuing dealers for deceptive advertising under Section 5 of the FTC Act. (Since 2012, the FTC has brought 16 cases against auto dealers for deceptive advertising.) . The FTC's Head of its Bureau of Consumer Affairs said the FTC believes that deceptive dealer advertising is a "significant problem," many automotive dealer investigations are "in the pipeline," and that this is a "priority area" for the FTC.

The FTC's definition of deception

The FTC defines "deceptive" as any representation, omission, or practice that is likely to mislead a consumer acting reasonably under the circumstances. The representation, omission, or practice must be "material" which generally means whether it is likely to affect a consumer's conduct or decision with regard to a financial product or service, such as automotive financing. A recent FTC consent order was based on an advertisement that held in big bold print "2013 KIA Sportage. $0 down and $99 per month." Buried in small faint-gray type with the background of a white and silver wheel were a series of disclosures that included noting that only the first two months were at $99 - with the remaining 70 monthly payments being $521. Another dealer advertised a low vehicle price but buried in the inconspicuous footnote was a $5,000 down payment requirement.

Another deceptive advertisement listed favorable financing terms for a vehicle but failed to disclose that in order to qualify, consumers must have met numerous other criteria which few, if any, could collectively meet.. This is called "rebate stacking" and the FTC considers it to be deceptive as well.

Clear and conspicuous

Qualifications must be "clear and conspicuous" and small print type at the bottom of a page apparently doesn't do it. Nor do disclosures on a different page in a multi-page flier from where the qualified term is advertised. It is the overall impression of the ad that the FTC evaluates and it looks at what is not said as well as what is said. Remember, no consumer actually has to be misled by the advertisement. If the FTC determines it is "likely to mislead," a 20-year consent decree may be in the offing as occurred with these dealers. Any violation by running another ad the FTC deems to be deceptive could incur penalties of up to $16,000 per piece mailed or per viewing of a printed or online ad.

In determining whether an advertisement is deceptive, the FTC has described the four "P"s that are necessary for dealer advertising. "Prominence" and "proximity" refer to where the qualifications are placed in type size, visibility, and location relative to the qualified term. "Placement" is whether the language is located in a place where the reasonable consumer is likely to notice and comprehend it. Finally, "presentation" refers to whether or not the wording is clear and simple enough to be understood by a reasonable consumer. When the FTC audits a dealer, it will look at sales training material to ascertain what type of language and statements your sales people are trained to make to a consumer as well. The FTC has said that all sums to be paid must be disclosed in the advertisement, except that a dealer can say generally that tax, tags and title fees are additional. Again, all statements must be clear and conspicuous.

The FTC has stated that the following phrases are acceptable: "No downpayment" (however this phrase triggers other required disclosures under Federal Truth in Lending as discussed in the next paragraph); "easy monthly payments;" "low downpayments;" and "terms to fit your budget."

Additional violations

When the FTC comes upon what it believes to be a deceptive advertisement, it doesn't stop there. It looks for other violations in both advertising and in your dealership. A failure to disclose Truth in Lending (Regulation Z) or Consumer Leasing Act (Regulation M) triggered terms is an example of an additional advertising violation.

Protecting - and growing - your bottom line Straightforward steps to a stronger dealership

The following is an article provided by MADA member, Rehmann, written by Mark DeMara.

The dealership market is extremely competitive, with approximately 17,000 franchised new vehicle dealers in the United States - not including the many used vehicle, boat and recreational vehicle dealers. That competition poses constant challenges to your bottom line. But outside of striving to provide top sales and support service to your customers, there's not much you can do about it: your competition isn't likely to shutter just to make things easier for you.

Fortunately, you DO have control over the following four ways to protect your bottom line ... and one key way to improve it:

PROTECT

Fraudulent banking transactions. Your CFO, controller or accounting manager should review your bank account on a daily basis. Thieves are constantly looking for ways to steal your money and fraudulent online transactions are on the rise. Diligently monitoring your bank account(s) is the only way to minimize potential loss.

Your accounting management should review every bank transaction daily to assess their validity. It can be very easy, for example, for an employee to make their car payment online and bury the payment in your general ledger.

Additionally, consider utilizing a separate bank account for electronic cash transfers only. Use this account as a "sweep account" to prevent unauthorized electronic withdrawals from your general checking account.

Company credit cards. Develop and enforce strict policies stating what types of expenditures are permitted on company credit cards. Prohibit any personal use on these cards. Monitor transactions and enforce timely submission of receipts.

Receivable status reports. Your accounting department should provide frequent receivable status reports detailing outstanding balances, account aging and problem accounts that have not been collected. These reports should be reviewed with departmental management to ensure timely collection and improved cash flow.

Financial statement trend analysis. Review your monthly financial statements with your CFO, controller, and/or accounting manager and compare the current month and year-to-date activities with prior months and prior year statements to determine upward and downward trends. These trends will aid your dealership in assessing areas that are improving or are in need of improvement. Additionally, by recognizing trends early corrective action can be taken on a timely basis.

IMPROVE

20 Groups. Profitability and operational metrics are frequently discussed at "20 Group" meetings - meetings that provide dealerships with the opportunity to share ideas among their peers from across the nation. Typical areas of focus at the meetings include economic trends, operational policies and procedures that can improve sales and profitability, and manufacturer relations. Consider involving your accounting and departmental management in your 20 group meetings to gain their input regarding your operations and profitability. If you have questions about 20 Groups or would like to join, please call your association.

Updated rental vehicle agreement

Colombo & Colombo, P.C. recently updated the model Rental Vehicle Agreement, which MADA also makes available through our office. This revised agreement incorporates changes in Michigan law. The major changes and reasons for the changes to the Agreement are as follows:

1. The term "narcotics" as used in former paragraph 4 has been changed to "controlled substances or other substances that impair your ability to operate the vehicle." This change reflects current terminology used in Michigan courts and in the Michigan criminal legal system today. 2. Former paragraph 7, now paragraph 5, on the "Reverse Side" includes various updates related to vehicle damage and recovery in the case of theft of a rented vehicle while in the possession of the renter. 3. A provision is added to what is now paragraph 8 providing that the renter is liable for any damage to a vehicle returned to the dealership after business hours and until the dealership reopens and confirms no damage. 4. A provision is added to what is now paragraph 10 defining what constitutes adequate consideration for the rental of the vehicle. This addition was precipitated by recent Michigan court cases. 5. Former "Page 2," now "Front Side," includes updates to paragraphs (A) and (C). Paragraph (F) and the "Caution" paragraph were removed and their provisions are now covered on the "Reverse Side" of the updated Agreement.

Additional details about these updates are available in this dealer notice, prepared by Colombo & Colombo.

If you engage in the vehicle rental business, it is recommended that you contact your insurance carrier to verify your insurance coverage and conditions for rental. To minimize your risk of loss, you should consider adopting policies similar to those of major vehicle rental companies. For example:

1. Verify the renter's driver's license, and make a copy for your records. 2. Verify the renter's insurance. 3. Require a major credit card to rent, with sufficient credit, in the form of a refundable deposit, to cover the cost of the rental.

Dealers may choose to use the updated form now, or wait until your supply of the older version runs out. The updated version of the form will be available from MADA next week. Our office offers packs of 25 (in triplicate). Please e-mail [email protected] or call (800) 292-1923 for information.

Senate Fiscal Agency, The Economy and State Revenue

The Senate Fiscal Agency recently released the August 2014 State Budget Overview. Following are a few vehicle-related bullet points from the report.

The Great Recession

Light vehicle sales started dropping earlier, and fell from a 17.6 million unit annual rate in January 2006 to a 9.0 million unit rate in February 2009 (a 48.7% decline), the largest decline on record back to 1976.

Recent U.S. Economic Highlights

Light vehicle sales have improved, and are near pre-recession levels. Light vehicle sales totaled 15.5 million units in 2013, up 7.5% from 2012 and 34.4% from 2010. Since June 2013, light vehicles sales have averaged 15.7 million units, below the 16-17 million unit rate experienced between 1998 and 2007, but well above the 10.4 million units in 2009. March 2014 sales, at an annualized rate of 16.3 million units, tied November 2013 as the highest rate since May 2007.

Despite the weather, Michigan motor vehicle production in January and February 2014 was up 9.7% from the year-ago level.

Michigan minimum wage increase now in effect

The following notice about the minimum wage increase has been provided by Colombo & Colombo, P.C.

Effective September 1, 2014, the Michigan minimum hourly wage rate is now $8.15. All employees must receive at least the minimum wage for all hours worked. It is recommended that dealers review the compensation of all employees, hourly and those exempt from overtime, to ensure compliance with the new wage increase for all hours worked by employees on and after September 1, 2014. According to the new Michigan minimum wage law, the minimum wage is set to increase as follows:

1. Beginning September 1, 2014, $8.15; 2. Beginning January 1, 2016, $8.50; 3. Beginning January 1, 2017, $8.90; and 4. Beginning January 1, 2018, $9.25.

Commission-based Employees Commission-based employees, which may include salespeople, are still entitled to receive the minimum wage. It is suggested that dealers advance certain sums, or "draws," to these employees weekly and then settle with the employees as to their commissions on a regular biweekly or monthly basis. Dealers should be sure that either weekly draws are sufficient to meet minimum wage or that the dealer makes up the difference at the end of the "washout" period when an employee's commissions are less than the minimum wage.

Overtime Notwithstanding the minimum wage increase, the overtime rate is still 1-1/2 times an employee's regular rate. Certain classes of employees are exempt from the overtime pay rate, but for most hourly employees of dealerships, the overtime rate applies. So, hours worked in excess of 40 hours per week should be paid at a rate of 1-1/2 times the hourly rate at which the employee is employed.

Violations It is important for dealers to keep a record of the hours worked by each employee and statements of all wages paid. Requiring employees to clock in and out each day is the best way to ensure that the dealer has records of the hours worked. Always keep records of hours worked and wages paid, and always provide statements of hours and wages to your employees on a weekly, bi-weekly, or monthly basis. Violation of the new minimum wage laws can result in fines, payment of wages due, liquidated damages, attorney's fees, and the time and burden of defending a civil lawsuit under the Fair Labor Standards Act. However, minimum wage violations are among the easiest to avoid by keeping track of the hours worked by the salespeople and staff.

Printer friendly version of this notice.

New minimum wage poster required

Dealers must now have the updated Michigan minimum wage and overtime poster on display. A copy of the individual poster is available online here.

Those who use the AutoComply Service through the Federal Wage and Labor Law Institute (FWLLI) should have automatically received the new all-in-one poster. If you still need a poster and would like an all-in-one version, you may choose to order online through FWLLI at www.fwlli.com/ada. BFS-4 temporary registrations: new log requirement

The Secretary of State has been monitoring the use of BFS-4 temporary registrations and found some inconsistencies among all dealer types. Currently when the state investigates dealers, or when law enforcement requests a dealer's copy of the BFS-4, there is often extensive time and dealer resources required to find and provide the copy. This is inconvenient for the dealer as well as the state.

To help verify proper use of temporary registrations, the state will implement a new process for recording these forms, effective January 1, 2015. As of this date, all dealers will be required to complete a Temporary Registration Log of every BFS-4 issued. This new requirement will make it easy for dealers to comply, and help avoid misuse of the temporary registrations purchased from the state and issued to customers.

The state will be e-mailing a notice to dealers regarding this issue shortly. The Dealer Manual will also be updated accordingly. Additional information will be forthcoming as the Dealer Manual revision is finalized and an example Temporary Registration Log is available.

If you have any questions or comments regarding this new process please contact MADA at (800) 292-1923 or contact the SOS.

NADA webinar: maximize aftermarket profit

September 24 at 1:00 p.m. ET

NADA's upcoming webinar will offer guidance on what steps to take to set up a successful aftermarket department. In today's tight retail market, new- and used-car dealers want to know the best ways to pump up their profit per vehicle. A mostly untapped opportunity for increasing profit per vehicle is aftermarket-accessory sales. Dealers who have followed these steps see an average increase of $250 to $300 profit per vehicle sold!

MADSIF article: inspection preparedness

Following is an article from MADA endorsed provider MADSIF.

Imagine you've just walked into your workplace. Your employees are actively in production. Everything seems to be in its usual working order. A compliance officer comes in and orders an inspection. They find multiple areas that are worthy of a sanction. How did you miss that? How were you not prepared for an inspection of your workplace? Who is to blame here, the employees or yourself?

According to the Occupational Safety and Health Administration, an inspection can happen at any time without warning. The only way to be prepared is to ensure safe workplace conditions and policies that adhere to compliance standards.

Here are five ways to protect your employees and workplace while staying prepared for an inspection:

1. Have a safety plan prepared This plan should be reviewed and discussed with employees on a regular basis whether it is done monthly or quarterly. All written agreements such as emergency evacuation plans, assessments, and training information should be made available to all employees and easily assessable. See how you can increase safety and cut back on claims here.

2. Conduct Safety Audits Whether internal or external, a safety audit can act as a dress rehearsal and potentially save time and money. Safety audits not only allow you to address potential risks associated with your work environment, but they also allow you to inform and educate your employees about prior OSHA warnings and the steps taken to prevent and monitor potential unsafe conditions. By conducting audits such as these, your workforce can learn from prior mistakes, which can make an inspection much easier.

3. Keep work spaces clean and materials in plain sight Food and beverages should not be visible in work areas. Maintaining a clean and professional workplace makes an inspection easier for everyone involved. In addition, in case of a fire, you should not have to search for an extinguisher, have all necessary materials in their respective area as listed in your safety plan. Take preventative measures to ensure everyone in your workplace is safe. Learn how you can prevent slip and fall accidents here.

4. Keep Workplace Communication Open Any employee should be prepared to answer questions from an inspector because they have been well trained on a consistent basis. Discussing variables that could take place in an inspection can help to prepare all employees, not just supervisors and managers.

5. Review Operations/ Safety Manuals Manuals that have been provided to instruct inspectors can help to prepare you for any inspection. Learn about the process and check out OSHA's Field Operations Manual for inspectors here.

For more information about MADSIF please visit www.madsif.com.

Reminder: complimentary workshop for MADA dealers and staff

Reminder: employer information report due by Sept. 30

The EEO-1 Report, which is required to be filed with the U.S. Equal Employment Opportunity Commission, requires certain employers to provide a count of employees by race/ethnicity, gender and job category. Reports must be submitted and certified by September 30, 2014 at the latest.

The report must be filed by companies or "affiliated companies" with 100 or more employees. Affiliated companies are those owned by or corporately affiliated with another company and the entire enterprise employs a total of 100 or more employees.

Additional information is available online at www.eeoc.gov/employers/eeo1survey.

Since Senate Bill 101 was signed into law in December of last year, Senator Anderson has been working with the Secretary of State's office to finalize the preparation of Michigan's Pink Ribbon license plate.

The specialty fundraising license plate is available to order through any Michigan Secretary of State's office. Money raised by the sale of this plate helps support the Michigan Breast & Cervical Cancer Control Program administered by the Michigan Department of Community Health. November 4 statewide ballot proposals

On Tuesday, November 4, Michigan voters will have the opportunity to place their vote for many governmental and legislative seats in Michigan. In addition, two statewide ballot proposals will be presented for your consideration. Following is language that will appear on the ballot.

Proposal 14-1. A referendum of Public Act 520 of 2012, establishing a hunting season for wolves and authorizing annual wolf hunting seasons. Public Act 520 of 2012 would:

Designate wolf as game for hunting purposes and authorize the first wolf hunting season. Allow the Natural Resources Commission to schedule annual wolf hunting seasons. Provide criminal penalties for the unlawful possession or taking of wolves, but shield a person who lawfully captures or destroys a wolf from prosecution. Require a person who wishes to hunt wolves to obtain a wolf hunting license. Create a Wolf Management Advisory Council for the purpose of making nonbinding recommendations to the legislature regarding the proper management of wolves.

Should this law be approved? Yes / No

Proposal 14-2. A referendum of Public Act 21 of 2013, granting the natural resources commission the power to designate wolves and certain other animals as game without legislative action. Public Act 21 of 2013 would:

Allow the Natural Resources Commission (NRC) to designate certain animals as game for hunting purposes and establish the first hunting season for game animals without legislative action. Continue the NRC's designation of wolves as game and allow the NRC to set a wolf hunting season. Grant the Legislature sole authority to remove a species from the list of designated game animals. Eliminate the $1.00 hunting and fishing licensing fee for members of the military, whether stationed inside or outside of Michigan, subject to any lottery. Give the NRC sole authority to regulate fishing.

Should this law be approved? Yes / No

MADA applauds Gov. Snyder and Legislature for standing up for Michigan law

MADA applauds Governor Snyder for signing Public Act 354 of 2014 into law this week. We also thank the bill sponsor, Aric Nesbitt, and the Michigan House and Senate for passing the final version of HB 5606. We appreciate that Governor Snyder and the Michigan Legislature took the time to thoroughly analyze existing Michigan law and stood up for the true language and meaning of that law.

As the Governor stated in his letter, PA 354 of 2014 clarifies application of the current law to all manufacturers. It does not create new restrictions within the law. Under current Michigan law, which has been in place for more than 30 years, a manufacturer cannot "own or operate" a dealership nor sell to consumers at retail (with limited exceptions). These provisions were not added into HB 5606 - they are existing law.

The Michigan Legislature and Governor Snyder recognize the significance of local dealer businesses that consistently follow Michigan law. Auto manufacturers doing business in Michigan have been successfully complying with the Michigan law for years. These laws have served manufacturers, customers and dealers well and have created a competitive marketplace in Michigan. We look forward to continuing to do business in Michigan within the franchise laws of our state.

Dealer alert: state investigating unemployment insurance fraud scheme

MADA has recently received reports from several members of an increase in fraudulent unemployment insurance (UI) benefit claims. We have also heard about this issue from other https://ui.constantcontact.com/visualeditor/visual_editor_preview.jsp?agent.uid=1118988423519&format=html&print=true 1/4 10/31/2014 MADA Fast Facts - October 31, 2014 organizations; this scam is not limited to dealerships.

The problem typically involves someone filing a UI claim under the name and/or social security number of a current employee but the employee never actually filed his/her own claim. We have heard from other organizations that this matter is currently under investigation by the UIA and that the problem emanates from an unemployment fraud scheme out of Florida.

We are told that the majority of these fraudulent claims are "underemployment claims," which require the employer to verify with the employee on whether or not they filed a claim. Once a dealer receives a "monetary determination" form from UI, the account will be charged for benefits unless the business responds to the department disputing the claim within 10 days. The scammers are hoping the business does not check these requests and the claim is paid.

Employers should pay close attention to claims filed against them in the coming weeks and months and report anything suspicious to the UIA and/or MADA.

Election Day: Nov. 4

Reality rebuttal to "conventional" nonsense

Following is a small portion of an article from MADA Annual Meeting speaker Dave Anderson.

Business is filled with common complaints, cop outs, clichés, conventional wisdom, and excuses that will keep you average if you buy into them. As you read over the following list determine how many you have heard, said, or bought into. Then consider the reality rebuttal, offered with the intent to create a healthier perspective on each issue.

There's a shortage of talented people in my area. Reality rebuttal: It's unlikely the Creator got ticked off at your area and stopped putting talented people there. In reality, the most talented people already have jobs, but you have no strategy for recruiting passive job candidates into your enterprise. Get one.

We can't fire him; we have no one to replace him with. Reality rebuttal: It's better to be strategically shortstaffed than foolishly filled up. And, if you had an ongoing recruiting discipline you'd have someone in the pipeline.

He's loyal; he's been here a long time. Reality rebuttal: Loyalty is defined as "faithfulness to one's duties or obligations"; the definition says nothing about being somewhere a long time. That would be tenure or seniority. At the end of the day, loyalty is performance.

I've been in the business thirty years. Why should I have to attend training? Reality rebuttal: Just because you show, doesn't mean you grow. Growth isn't automatic, and it is not a synonym of experience. Since intellectual capital depreciates, keep training or lose your relevance.

It's the manufacturer's fault our sales are down. Reality rebuttal: Quit whining and focus on the many things you can control each day but don't: your attitude, work ethic, discipline, where you spend your time, with whom you spend it, whether you're going to train, recruit, hold people accountable, and the like. You're not a victim of your circumstances; you're a product of your choices.

My managers work a ton of hours; there's no way you can call them complacent. Reality rebuttal: Complacent is defined, "calmly content, smugly selfsatisfied." Your managers can work eighty hours per week and still be so complacent they don't train regularly, recruit proactively or hold others accountable Complacency is more about what someone puts in the hours than the hours someone puts in.

My managers are fine. I need salesperson training. Reality rebuttal: If your managers were fine, they'd already be training your salespeople. Besides, it's foolish to take live eggs, stick them under dead chickens and then wonder why they don't hatch. Train your managers first.

Dave Anderson has more examples of reality rebuttals to conventional wisdom. Read them here.

Dealers and their managers are also invited to attend Mr. Anderson's presentation on December 3rd in Battle Creek: Stay Hungry with a Red Belt Mindset. In many martial arts the red belt is the rank prior to black belt. Red belts are known for being hungry, humble, teachable, and with the desire to prove themselves daily. Unlike the black belt, who may believe he's "arrived", the red belt in business continues to challenge the status quo, overcome complacency and stir up hunger within themselves and others to achieve bigger goals. This presentation will present four keys to stirring up and/or sustaining hunger, and discuss how to overcome hunger's number one extinguisher: complacency.

State allowable fees for computerized vehicle registration

Dealers have recently asked about the maximum, state allowable fee that may be charged to consumers who choose to take advantage of the convenience of computerized vehicle registration and plating through the dealership. The state maximum fee dealers may charge to consumers is $24, which has been in place since the beginning of the program. This fee has not changed, and as you know, this is a voluntary fee.

Questions have arisen since CVR announced an increase in their operational fee last month. CVR has noted that this was their only increase in the fee since its inception over nine years ago.

Dealers are welcome to contact CVR, MADA or the State of Michigan if they have any questions or concerns with this issue.

From Plante & Moran: tangible property regulation compliance

On Sept. 13, the IRS released final regulations on the proper tax treatment of expenditures related to tangible property. The final regulations will apply to tax years beginning on or after Jan. 1, 2014. They affect business owners in almost all industries, particularly those in manufacturing or with substantial real estate portfolios. The IRS will be looking for these new rules to be addressed and properly communicated to the IRS with the filing of the 2014 tax return.

In addition to consulting with your tax professionals, dealers may wish to review the Plante & Moran alert regarding the tangible property regulations, which provides an overview of the changes. A brief video overview is also available here: www.plantemoran.com/services/Tax/tangible property/Pages/Videos.aspx.

FTC takes further action against two dealership chains

The FTC has announced additional action against two auto dealer chains for deceptively advertising the cost of buying or leasing a car. These actions follow consent orders the FTC entered into with the same dealer chains in 2012 to resolve allegations that they engaged in deceptive advertising related to negative equity and failed to satisfy the disclosure requirements that apply to credit and/or lease ads containing "trigger terms."

These cases represent the fourth set of advertising enforcement actions brought by the FTC against auto dealers since 2012.

The FTC continues to monitor dealership advertising for misrepresented or deceptive advertisements this includes all forms of dealership advertising, including print, radio, TV, YouTube videos, dealer websites, etc.

MADA reminds dealers to review their advertising practices to ensure FTC compliance.

U.S. Rep Peters recognized for his work on behalf of dealers

The staff at Serra Chevrolet in Southfield invited U.S. Rep. Gary Peters to visit the dealership this week. Dealer/Operator Greg Brown thanked Rep. Peters for his work on H.R. 724, legislation that eliminated a redundant and outdated provision of the Clean Air Act requiring auto dealers to provide consumers with a certificate confirming a vehicle's compliance with the law even though every new model meets that standard. Rep. Peters also thanked DADA and MADA for their participation and assistance in accomplishing this change.

We appreciate the work Rep. Peters has done for dealers and look forward to working with him in 2015 in his new position as U.S. Senator.

Michigan Dealer Manual: updates to chapters 5 and 9

The Department of State recently updated chapters five and nine of the Michigan Dealer Manual. The updates deal with distressed vehicles and foreign salvage dealers. The state has distributed a change announcement providing an overview of the most significant changes. Dealers are encouraged to review the updates for information that is pertinent to your business operations.

57.1 Recertification Inspection. Before a salvagetitled vehicle may be registered for road use, it must be inspected by a certified salvage vehicle inspector, who is a specially trained police officer. This section has been amended to reflect updates to the website accessible to dealers with links providing names, and telephone numbers of certified salvage vehicle inspectors in their region.

512.1 Proof of Ownership and Record Keeping Requirements. Dealers must have a properly assigned title, a salvage title, a scrap title, or other properly assigned ownership document for every vehicle in inventory. This section has been amended to identify pertinent ownership forms germane to distressed vehicles.

512.2 Scrap Processor Exception. A Vehicle Scrap Metal Processor (Class F) is not required to obtain a title for each vehicle purchased from another licensed dealer. This section has been revised to reflect which dealership classification uses a TR9 Scrap Vehicle Inventory form to convey ownership to a scrap metal processor.

512.3 Police Book Requirements. When dealers acquire whole vehicles to be dismantled, the vehicles are logged into the Police Book. As the individual major component parts removed, they are logged into the Major Component Parts Record (SOS426). The Major Component Parts Record must be maintained in or attached to the Police Book. Class F Vehicle Scrap Metal Processors are required to make Police Book entries only for vehicles purchased not acquired on TR9 forms.

94.2 Major Component Parts Record. Late model major component parts purchased in Michigan, brought to Michigan for resale, or removed from vehicles acquired in Michigan must be entered in a Major Component Parts Record SOS426. This section has been enhanced to provide more information regarding major component parts and how records are to be maintained.

Sales tax tradein credit: 2015 forms now available

The State of Michigan has finalized the RD108T and FAQ documents relating to the tradein sales tax credit change for 2015. These files are posted within the Publications and Forms section of the SOS website at www.michigan.gov/sos.

We again remind dealers that the delivery date determines which sales tax tradein credit amount to apply (NOT purchase date). The state looked into this issue and, in following Michigan law, confirmed that delivery date must be used as the determining factor for the credit amount.

We have heard that some DMS providers are making updates to their systems to comply with the delivery date requirement. Dealers may want to discuss this with their DMS providers to ensure they are prepared for the January 1st change.
