ORDER Sri V. David has filed 2nd appeal dated 08-01-2018 which was received by this Commission on 09-01-2018 for not getting the information sought by him from the Public Information Officer / Deputy Tahsildar, Jakranpally Mandal, Nizamabad District and the 1st Appellate Authority/ Revenue Divisional Officer, Armoor Division, Nizamabad District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 23-10-2017 before the Public Information Officer requesting to furnish the information under Sec. 6(1) of the RTI Act, 2005 on the following points mentioned: 1. The certified copy of village map (Revenue Survey map) of Thorlikonda village. 2. The certified copy of G.O.Ms.No. 2295, Rev., dated 30-09-1935. 3. Certified copy of pahani of whole of Sy.No. 342/1 for the year 1983 of Thorlikonda village and more (16) items. The Public Information Officer through Lr.No. C/1170/2017 dated 07-11-2017 forwarded the application to the Assistant Director, Survey & Land Records, Nizamabad to furnish the sought information to the appellant directly. The Public Information Officer through Memo No. C/1170/2017 dated 07-11-2017 informed to the appellant that the information for item no. 1 and 18 is readily available in their office andTSIC applicant can come and collect the sought information in any Government working days. Stating that the appellant was not satisfied with the reply of the Public Information Officer, he filed 1st appeal dated 27-11-2017 before the First Appellate Authority/ Revenue Divisional Officer, Nizamabad requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. The Assistant Director, Survey and Land Records, Nizamabad through Lr.No. RTI/175/2017 dated 05-12-2017 informed to the appellant that to pay the requisite amount of Rs. 100/- to furnish the certified copies. The First Appellate Authority through Lr.No. C1/3684/2017 dated 12-12-2017 directed the Public Information Officer to furnish the sought information to the appellant and submit compliance report to their office. Stating that the appellant was not satisfied with the reply of the Public Information Officer and the First Appellate Authority, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. PTO Note: This is system generated copy and no signature is required. : 2 : Basing on the material papers available on record, the appeal is taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 08-08-2019 at Hyderabad. The case is called on 08.08.2019. The appellant is absent. On behalf of the Public Information Officer / O/o Tahsildar, Jakranpally Mandal, Sri B. Dhananjaya, Senior Assistant is present. Heard the authorised representative of the Public Information Officer and perused the material papers on record. On perusal of the material papers available in the case file, it is noticed that 6(1) application was filed by the appellant on 23.10.2017. The authorised representative of the Public Information Officer, submitted an affidavit, wherein the Public Information Officer / O/o. Tahsildar, Jakranpally stated that he received 6(1) application filed by the appellant on 01.11.2017 under Section 6(3) of the R.T.I. Act from Panchayat Secretary, Tarlikonda. In this regard he informed the appellant on 07.11.2017 that out of 19 points, the information pertaining to Point No. 1 and 18 only available in their office and it will be provided to the appellant in any Government working days from their office, under Rule 4(b) (ii) & (iii) of RTI Act of 2005. The Public Information Officer further submitted that for remaining information for point Nos. 2 to 17 and 19 he informed to the Assistant Director, Survey Land Records, Nizamabad to provide further information and the same was informed to the appellant. Notice sent to the appellant for attending the hearing on 08.08.2019, was returned to this office with an endorsement by the postal department that “no such person”. In view of the above the Public Information Officer /O/o the Tahsildar, Jakranpally Mandal and Assistant Director, Survey Land Records, Nizamabad are directed to allow the appellant for personal inspection of records on 31.08.2019 and 03.09.2019 respectively at 11.00 AM to enable him to obtain the required information as sought in the 6(1) application. In this regard, the Tahsildar, Jakranpally Mandal and Assistant Director, Survey Land Records, Nizamabad are also directed to give advance intimation to the Complainant in writing for inspection of the record and report the compliance of the order to this Commission. With the above direction the appeal is closed.
