Our MC for the evening will be Kelly Higgins-Devine with a panel of speakers including Kathleen Noonan, Professor Cindy Shannon and Diane Fingleton. Joan Hendriks will offer the Welcome to Country. Kelly Higgins-Devine loves seeking out the extraordinary in the ordinary. The 2007 ABC Local Radio Broadcaster of the Year, Kelly's career in radio began at 4VL in Charleville. She has worked all over Australia and came back to Brisbane where she found her way into the soft, warm arms of 612 ABC Brisbane. Starting her ABC career with a stint in News Radio in 1999, Kelly was picked up by the radio newsroom where she spent five years wonderful years as a journalist, senior sub-editor and newsreader. She was offered the statewide Afternoons program in 2004, moved to 612 ABC Brisbane Drive in 2006 and is now back on her home turf of Afternoons. Kelly can be heard on 612 ABC Brisbane and ABC Coast FM from 1-3pm weekdays. " I relish what I do because I'm able to explore the issues of the day with the major players, and then to open up discussion with an audience that is opinionated, insightful and intelligent". Kathleen Noonan is a journalist and columnist. She writes the Last Word column in The Courier-Mail each Saturday, feature stories, and arts & music interviews and reviews. Born in north Queensland, Kathleen did her early reporting in the Mackay district, before moving to Brisbane.

    The Administrative Authority of Chief Judicial Oficers in Australiat Kathy Mack and Sharyn Roach Anleu*' I Introduction Many aspects of judicial independence support the core judicial function of 'independent, impartial . adjudication'.' This paper particularly considers the concept of internal judicial independence, which requires that a judicial officer's adjudicative functions must be free from control by other judicial officers, including the presiding or most senior judicial ~fficer.~Just as the independence of judges would be undermined by executive influence on judicial decision-making, improper direction from the presiding judicial officer -or any other judicial officer -would also This research was initially funded by a University-Industry Research Collaborative Grant in 2001 with Flinders University and the Australian Association of Magistrates (AAM) as the partners with additional financial support from the Australian Institute of Judicial Administration.     AUSTRALIAN LAWYERS & SOCIAL CHANGE CONFERENCE Faculty of Law, ANU and National Institute of Social Sciences & Law 22-24 September 2004 Margaret Thornton Professor of Law and Legal Studies La Trobe University [email protected] THE LEGAL PROFESSION Session 3: Diversity in the Profession Gender, Legality and Authority Abstract The concept of diversity signifies the postmodern ‘turn’ in the way that it suggests inclusiveness, adaptability and tolerance. But the legal profession is also a paradigmatically modernist institution that embodies exclusivity, uniformity and conservatism. This presentation focuses on the contradictions that inhere within the social justice imperative to render the legal profession more diverse. Each time that there has been an attempt to do so, there have been counter moves to rein back and neutralise the effects of diversification. The point is clearly illustrated by the entry of women into the profession in large numbers, which has occurred since the 1970s. Technologies of resistance include the domination of the profession by corporate lawyering, the long hours culture and the maintenance of the ‘glass ceiling’. -------o0o------- Diversity should not be understood as an unqualified good; nor should progress be understood as a linear thread running from uniformity to diversity. Sometimes diversity is the desirable state, sometimes uniformity. Furthermore, each pole contains the seeds of its antinomy. There cannot be one without the other so that each time there is a propulsion in one direction, it is corroded by its opposite. The development of a single regime for the Australian legal profession illustrates the point. The move towards a national regime, unification, rationalisation, consistency and homogeneity, and a single identity is viewed as a good against the diversity of multiple State regimes.

  • The Separation of Powers Between the Executive and the Judicary
    THE SEPARATION OF POWERS BETWEEN THE EXECUTIVE AND THE JUDICIARY Dr John Alvey Research Assistant, UQ Business School [email protected] Paper presented to the Australasian Study of Parliament Conference Parliament House, Hobart, Tasmania 27-29 September 2017 1 Abstract The Australian version of the Westminster system of government requires periodic revisiting and reassessment and this includes the Executive’s role in relation to the other branches of government, that is, the legislature and the judiciary. In Australia the doctrine of the separation of powers is well-known at the federal government level but this doctrine has had little impact at the state government level, especially in Queensland. The main problem is that Australian democracy is based on responsible government and the Westminster parliamentary system and is not based on the separation of powers. The paper outlines of the main writers on the doctrine of the separation of powers. Next, the paper looks at the state of Queensland where the executive infringes on the functions of the legislature and the judiciary. Finally, the paper looks at a suggested contribution to the SOP doctrine with a legislative or constitutional recognition of the separation of powers. There is no formal or constitutional separation of powers at the state level, however is an implied separation of powers in practice at the state level in Australia. The Queensland Constitution does not specifically outline the separation of powers particularly the separation of the judicial power. This paper also looks at the historical record of the separation of powers in Queensland under various Queensland Governments. In Queensland the powers of the executive have encroached on the functions of the other two branches, that is, the legislature and the judiciary.
