MINUTES OF MEETING HELD ON FRIDAY 8 JUNE 2012 AT 1400 HOURS IN THE COUNCIL CHAMBERS, COUNCIL HEADQUARTERS, LONDON ROAD,

CONSIDERATION OF APPLICATIONS 2. APPLICATION NO 11/0967/PP: COMMUNITY WINDPOWER LIMITED: SNEDDON LAW, MOSCOW, It was confirmed that this application had been withdrawn from the Agenda.

3. APPLICATION NO 07/0778/FL: ELPHINSTONE HOMES LIMITED: GALSTON ROAD, There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which presented for determination an application for planning permission for the erection of 37 dwellings, access roads (with the main access to the site from Galston Road), internal roads and footpaths, associated car parking and ancillary works including SUDS and landscaping and open space at land to the east of Shawhill Lodge, Galston Road, Hurlford. Fiona Finlay, Team Leader - Northern reported that 23 letters of objection had been received in respect of the application; summarised the planning considerations in respect of the application; and gave the recommendation of the Head of Planning and Economic Development: Refusal, for the reasons detailed in the report. 3.1 Planning Hearing The Committee heard Mr Stephen Park Brown on behalf of the objections from Valerie Johnson, Douglas Johnson, Elizabeth Keohone and Mrs Orla Park Brown; 2

Douglas Mobey, in respect of his own objections and those of Sharon Mobey and Nathan Mobey; and David Ellery in respect of his own objection. Members of the Committee asked questions of the objectors. The applicant was not present or represented. The Chair closed the Hearing. 3.2 Determination of Application Fiona Finlay, Team Leader - Northern and Gwen Finlay, Team Leader, Traffic & Development, provided clarification on points raised during the Hearing. It was agreed to refuse the application for the reasons detailed in the report.

APPLICATION NO 12/0064/PP: COMMUNITY DEVELOPMENT GROUP: LAND TO THE REAR OF NETHERTHIRD PRIMARY SCHOOL, There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which presented for determination an application to change the use of the land from agricultural use to form a community garden and for the erection of a polytunnel and fence at land to the rear of Netherthird Primary School, Cumnock. Craig Iles, Team Leader - Southern reported that no letters of objection had been received; summarised the planning considerations in respect of the application; and gave the recommendation of the Head of Planning and Economic Development: Approval, subject to the conditions and for the reasons detailed in the report. It was agreed to approve the application, subject to the conditions and for the reasons detailed in the report.

5. APPLICATION NO 12/0155/LB: EAST AYRSHIRE COUNCIL: DEAN CASTLE, DEAN ROAD, KILMARNOCK There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which presented for determination an application for listed building consent for the introduction of new timber gates at the main entrance to Dean Castle from Dean Road, Kilmarnock. Fiona Finlay, Team Leader - Northern advised that no letters of objection had been received in respect of the application; summarised the planning considerations in respect of the application; and gave the recommendation of the Head of Planning and Economic Development: Approval, subject to the conditions and for the reasons detailed in the report. 6. APPLICATION NO 12/0173/LB: EAST AYRSHIRE COUNCIL: TOWN HALL, 10-12 WEST MAIN STREET, DARVEL There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which 3

presented for determination an application for listed building consent for the replacement of timber casement type windows at Darvel Town Hall, 10-12 West Main Street, Darvel. Fiona Finlay, Team Leader - Northern advised that no letters of objection had been received in respect of the application; summarised the planning considerations in respect of the application; and gave the recommendation of the Head of Planning and Economic Development: Approval, subject to the conditions and for the reasons detailed in the report, and that prior to the Decision Notice being issued, the application be referred to Historic on behalf of the Scottish Ministers under the Planning (Listed Building and Conservation Areas) (Scotland) Act 1997. It was agreed to approve the application, subject to the conditions and for the reasons detailed in the report, and that prior to the Decision Notice being issued, the application be referred to Historic Scotland on behalf of the Scottish Ministers under the Planning (Listed Building and Conservation Areas) (Scotland) Act 1997 for approval.

APPLICATION NO 12/0160/PP: EAST AYRSHIRE COUNCIL: MOORFIELD NORTH INDUSTRIAL PARK, MOORFIELD, KILMARNOCK There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which presented for determination an application for planning permission for an industrial unit of 2,443 sq metres at Moorfield North Industrial Park, Moorfield, Kilmarnock. APPLICATION NO 12/0190/PP: EAST AYRSHIRE COUNCIL: ACADEMY, SORN ROAD, AUCHINLECK There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which presented for determination a planning application for permission for the installation of a full sized synthetic 3G pitch (football turf with sand and rubber fill) and erection of a 5m high fence and floodlighting at Auchinleck Academy, Sorn Road, Auchinleck. APPLICATION NO 12/0187/PP: EAST AYRSHIRE COUNCIL: LOUDOUN ACADEMY, GALSTON There was submitted an executive summary sheet and report dated 30 May 2012 (both circulated) by the Head of Planning and Economic Development which presented for determination an application for planning permission for a new synthetic pitch on the site of the existing pitch and erection of a 5m high fence and floodlights at Loudoun Academy, Galston. Fiona Finlay, Team Leader - Northern advised that no letters of objection had been received in respect of the application; further advised that Galston Community Council had been consulted on the application, but no response had been received; summarised the planning considerations in respect of the application; and gave the recommendation of the Head of Planning and Economic Development: Approval, subject to the conditions and for the reasons detailed in the report. It was agreed to approve the application, subject to the conditions and for the reasons detailed in the report.
