Streszczenie Kodeks Teodozjański zawierał liczne prawa mające na celu zapewnienie uprzywilejowanego statusu Koś cio ła i kleru. Prawa owe były elementem szerszej polityki skierowanej na umocnienie chrześcijańskiego imperium rzymskiego. Zwolnienia fiskalne grały tu znaczną rolę. Po upadku Zachodniego Cesarstwa, regna barbaro-rzymskie zachowały rzymskie dziedzictwo prawne i koncepcje prawodawcy oraz właściwego modelu relacji władzy monarszej i duchowieństwa. Utrzymano też w dużej mierze rzymskie rozwiązania skarbowe. Rozwijały się tez nowe idee i instytucje ustrojowe. Immunitety skarbowe Merowingów są tu dobrym przykładem. Królowie z tej dynastii starali sie naśladować wzorce cesarskiej polityki wobec duchownych. Jednak zmienione okoliczności polityczne i gospodarcze sprawiały, że rzy mskie instytucje przekształcały się w więzi feudalne. Roman legal heritage a). Introduction When the end of the old order had come and the new Earth was being born in pain - with those words begins a hymn in honour of Saint Benedict of Nursia 1. The epoch of saints like Benedict was a time of destruction and decay, but it was also the time of innovation and evolution. In this paper, I would like to focus on one aspect of this process, namely on the changes and accommodations of Roman ecclesiastical privileges in fiscal matters as they oc- curred in the Germanic states of Latin Europe. -

I drew this motto from the ambiance of prayer, brotherhood and renewal that dominated the Electoral Holy Synod, and from the need of our Lebanese, Eastern and Expansion societies for greater unity and love, I was as well, 5 inspired by the Synod of Bishops’ Special Assembly for the Middle East, held in Rome from October 10th till 24th, 2010 under the title “Communion and Testimony”. I proclaimed my motto during the thanksgiving prayer, which followed the electoral session in the presence of a large number of clergy and lay faithful who fled to the Patriarchal See as the announcement was heard. -

Library’s Collection Development Objectives The primary purpose of the collection is to support teaching and research studies at the undergraduate level in the area of Religious Studies. The library also seeks to support graduate level work in interdisciplinary studies involving religious studies through the MLA program. B. Elie Al Hindy1 Oригинални научни рад Notre Dame University UDK: 27(569.44) Lebanon THE NEW JERUSALEM: AN ORIENTAL CHRISTIAN PERSPECTIVE Abstract The paper is an attempt to revisit the controversial issue of the City of Je- rusalem from a new perspective. The author will benefit from his experience and background to present the view of Oriental Christians toward the issue. This view will include the spiritual understanding of the “new Jerusalem” that is completely separate from the physical city of Jerusalem but that sheds light on the Christian approach to conflicts in general. Then the paper will review the political, technical, and human challenges that are facing the current negotia- tions and any possible future solutions, based on the analysis of the literature and declared positions. Finally, the paper presents the specific view and con- cerns of the Oriental Christians and the role they ought to play, concluding with some reflections and personal remarks. In all, this paper adds to the literature a new oriental Christian spiritual and academic perspective that has been shyly presented so far. AM rr In the name of the Father, the Son, and the Holy Spirit, amen. GOD INCARNATES; THE CHURCH FOUNDED OME 2,000 years ago, our Lord Jesus Christ directly intervened in human history. Although He S is God (together with the Father and the Holy Spirit), He became a man—or, as we often put it, He became incarnate —enfleshed. Mankind, at its very beginning in Adam and Eve, had fallen away from Divine life by embracing sin, and had fallen under the power of death. But the Lord Jesus, by His incarnation, death upon the Cross, and subsequent resurrection from death on the third day, destroyed the power death had over men. By His teaching and His whole saving work, Christ reconciled to God a humanity that had grown distant from God1 and had become ensnared in sins.2 He abolished the authority the Devil had acquired over men3 and He renewed and re-created both mankind and His whole universe.4 Bridging the abyss separating man and God, by means of the union of man and God in His own Person, Christ our Saviour opened the way to eternal, joyful life after death for all who would accept it.5 Not all the people of Judea, the Hebrews, God’s chosen people (Deut 7:6; Is 44:1), were ready to hear this news, and so our Lord spoke to them mostly in parables and figures. -
Solicitation in Confession
WHEN BAD ADVICE IN CONFESSION BECOMES A CRIME The canonical crime of solicitation is likely more widespread than many may suppose. By Dr. Edward N. Peters All would agree that if a given piece of advice is bad in the confessional, then a priest's giving it to a penitent would be, at a minimum, a failure in pastoral care. Depending on circumstances, a priest's proffering of bad advice in confession might even, as a violation of charity or justice, be sinful. But, that the giving of bad advice in confession could be a crime under Church law would be startling. And yet, exactly this reading of Canon 1387 of the 1983 Code of Canon Law is required, I suggest, in light of sound canonical tradition and recent Roman curial norms. Canon 1387 states: "A priest who in the act, on the occasion, or under the pretext of confession solicits a penitent to sin against the sixth commandment of the Decalogue is to be punished, according to the gravity of the delict, by suspension, prohibitions, and privations; in graver cases he is to be dismissed from the clerical state." The image of solicitation that springs to mind here is, of course, that of a priest using the confessional to propose carnal liaisons to a female penitent.l To be sure, such reprehensible behavior is criminalized by Canon 1387. But neither the text of Canon 1387 (specifically the phrase, "solicits a penitent to sin against the sixth commandment of the Decalogue") nor the tradition behind the modern canon construes the crime of solicitation that narrowly. -

So far as can be ascertained, no complete version exists in English or any other modern language, although there are English translations or editions of some of the longer extracts [e.g, Ctesias' Indica), of some of the literary criticisms,^ of selected codices (chiefly on profane authors) in Italian by G. Compagnoni,^ a well-known Milanese literary man and states- man (1754-1834), and of the whole in Latin by the learned in Jesuit Andreas Schott^ Migne's Patrologia Graeca (vol. ciii.). * The text is unfortunately in many places unsatisfactory, and no critical edition has been attempted for nearly a hundred years — since 1824, the date of Immanuel Bekker's edition. -

Who we are? We are Christians here in Israel and at the same time we are Christians in the Middle East. We are four families of Churches, all, except one, the Assyrian Church of the East, gathered in the Middle East Council of Churches, with its seat in Beirut, Lebanon. The four families are the Orthodox family (Alexandria, Antioch, Jerusalem, and Cyprus), the Eastern family (Copts of Alexandria, Syrians of Antioch, and Armenians of Cilicia with their see in Antelias in Lebanon; the Armenians of Jerusalem, refer to Etchmiadzin in Armenia), the Catholic family, with seven patriarchates (Alexandria, the Copts; Antioch, the Greek Catholics, the Syro-Catholics and the Maronites; Baghdad, the Chaldeans; Lebanon (Bzummar), the Armenians; and Jerusalem, the Roman Catholics or Latins). In 1990, the Council of the Catholic Patriarchs of the East was established, with its seat in Beirut. The World Council of Churches (WCC), was created in the first half of the 20th century and it gathers together almost all the world Churches, including the three families of Churches in the Middle East: Orthodox, Eastern and Protestant or Evangelical. The Catholic Church is not a member, but cooperates in many fields with the Council. Church and ethnicity: one notes in the names of the Churches of the Middle East, the ethnic/linguistic root of each one of them: Greek, Copt, Syrian, Chaldean, Assyrian, Armenian, Latin or Roman.
