CERTIORARI TO THE SUPREME COURT OF NEVADA No. 03–5554. Argued March 22, 2004—Decided June 21, 2004 Petitioner Hiibel was arrested and convicted in a Nevada court for re- fusing to identify himself to a police officer during an investigative stop involving a reported assault. Nevada’s “stop and identify” stat- ute requires a person detained by an officer under suspicious circum- stances to identify himself. The state intermediate appellate court affirmed, rejecting Hiibel’s argument that the state law’s application to his case violated the Fourth and Fifth Amendments. The Nevada Supreme Court affirmed. Held: Petitioner’s conviction does not violate his Fourth Amendment rights or the Fifth Amendment’s prohibition on self-incrimination. Pp. 3–13. (a) State stop and identify statutes often combine elements of tra- ditional vagrancy laws with provisions intended to regulate police behavior in the course of investigatory stops. They vary from State to State, but all permit an officer to ask or require a suspect to disclose his identity.

Argued January 9, 2019—Decided May 13, 2019 Respondent Hyatt sued petitioner Franchise Tax Board of California (Board) in Nevada state court for alleged torts committed during a tax audit. The Nevada Supreme Court rejected the Board’s argument that the Full Faith and Credit Clause required Nevada courts to ap- ply California law and immunize the Board from liability. The court held instead that general principles of comity entitled the Board only to the same immunity that Nevada law afforded Nevada agencies. This Court affirmed, holding that the Full Faith and Credit Clause did not prohibit Nevada from applying its own immunity law. On remand, the Nevada Supreme Court declined to apply a cap on tort liability applicable to Nevada state agencies. This Court reversed, holding that the Full Faith and Credit Clause required Nevada courts to grant the Board the same immunity that Nevada agencies enjoy. The Court was equally divided, however, on whether to over- rule Nevada v. Hall, 440 U.

JURISDICTION OF THE PROPOSED NEVADA COURT OF APPEALS Institute for Court Management Court Executive Development Program 2008-09 Phase III Project May 2009 Robin L. Sweet Deputy Director Supreme Court of Nevada Administrative Office of the Courts Carson City, Nevada ACKNOWLEDGMENTS The list of people who should receive my heartfelt thanks for their support, understanding, and encouragement throughout this process could drag on for pages. So, I will try to specifically note those who helped with the report while noting generally that many family, friends, and colleagues offered words of support, encouragement, and inquiry throughout the process and I am grateful to and for each and every one of you! Your questions about my progress and success helped me stay on target and on track! The Nevada Supreme Court Justices were supportive throughout the research, including answering my questions at the beginning of the research idea. Clerk of the Court Tracie Lindeman helped with data for the Nevada Supreme Court as well as regular checkup and encouragement throughout the process. Ted Xie also provided Supreme Court data. Additional support and assistance were provided by Kathleen Harrington, Ann Whitney, Mary Berger, and Paula Doty of the Nevada Supreme Court Law Library. The heads of our Central Staff criminal and civil divisions, Phaedra Kalicki and Sarah Moore, also provided insight when asked. My thanks to Ron Titus, State Court Administrator, for his support of my pursuing this certification. Fortunately for me, Dr. David Rottman of the National Center for State Courts agreed to be my advisor for this project. I am grateful, too, for his encouragement and reviews of this report and its components.

  • The Pinkerton Problem
The Pinkerton Problem Bruce A. Antkowiak* I. INTRODUCTION In the unlikely event that any junior faculty member should ever ask me for advice about how to write a law review article, I would give them this highly non-academic bit of counsel. First, find a real problem in the law, one that affects real people and one that can be addressed by judges and practitioners in the area. Second, help them find a way to solve it. Granted, this flies in the face of the conventional wisdom that law review articles should be laborious expositions of exhaustive research into esoteric points, grandiosely displayed, and targeted solely for other academics in a display reminiscent of peacocks flashing their plumage at the zoo. But as I am neither peacock nor traditional academic, my advice stands, and I seek to follow it here. Indeed, if I am any animal, I am an old criminal law warhorse who cares deeply that the system do its vital work in the way the Constitution intended. The problem addressed in this article strikes at these concerns. It was first brought to my attention when a member of a Committee I chair to draft and revise the Pennsylvania Criminal Jury Instructions complained that the current Pennsylvania instruction on the liability of a conspirator for substantive crimes committed by a co-conspirator (something we all know as the Pinkerton1 charge) was wrong or, minimally, incomplete.2 The Committee had to conclude, however, that since that instruction accurately reflects the teachings of the * Program Director, Criminology, Law, and Society, St.

  • 12-694 Nevada V. Jackson (06/03/2013)
Cite as: 569 U. S. ____ (2013) 1 Per Curiam SUPREME COURT OF THE UNITED STATES NEVADA, ET AL., PETITIONERS v. CALVIN O’NEIL JACKSON ON PETITION FOR WRIT OF CERTIORARI TO THE UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT No. 12–694. Decided June 3, 2013 PER CURIAM. In this case, the Court of Appeals held that respondent, who was convicted of rape and other serious crimes, is en- titled to relief under the federal habeas statute because the Supreme Court of Nevada unreasonably applied clearly established Supreme Court precedent regarding a crim- inal defendant’s constitutional right to present a defense. At his trial, respondent unsuccessfully sought to introduce evidence for the purpose of showing that the rape victim previously reported that he had assaulted her but that the police had been unable to substantiate those allega- tions. The state supreme court held that this evidence was properly excluded, and no prior decision of this Court clearly establishes that the exclusion of this evidence violated respondent’s federal constitutional rights. The decision of the Court of Appeals is therefore reversed. I Respondent Calvin Jackson had a tumultuous decade- long romantic relationship with Annette Heathmon. In 1998, after several previous attempts to end the relation- ship, Heathmon relocated to a new apartment in North Las Vegas without telling respondent where she was mov- ing. Respondent learned of Heathmon’s whereabouts, and on the night of October 21, 1998, he visited her apartment. What happened next was the focus of re- spondent’s trial. Heathmon told police and later testified that respondent 2 NEVADA v.
