HEARING THIS DAY, THE COURT MADE THE FOLLOWING: O R D E R The impugned order passed by the Deputy Commissioner u/s 136(3) of the Karnataka Land Revenue Act is in question. The Deputy Commissioner referred judgment of this Court in Mallegowda vs., Channaveeregowda & others (ILR 2011 KAR 4225) and 4 holds that the Deputy Commissioner lacks revision jurisdiction. 2. The judgment of the learned Single Judge in Mallegowda’s case was reviewed in Full Court judgment in W P No.67926/2011 disposed of on 21.8.2012 wherein revision power of the Deputy Commissioner has been affirmed. 3. In the circumstances, the Revision Petition No.DDS.RAP.36/12-13 is restored to file and it is directed to the Deputy Commissioner to pass fresh order in accordance with law. 4. Both the parties are directed to appear bfore the Deputy Commissioner on 26.2.2013 without awaiting any notice.
