ANTI-CORRUPTION Ppolicies in NIGERIA
DISCUSSION PAPER Anti-Corruption was the declared number one policy aim of the Olusegun Obasanjo administration. The success of this policy was, however, for various reasons not too impressive. Obasanjo's successor, President Umaru Yar'Adua came to power promising to reform and continue the anti-corruption policy. But while the anti-graft agencies continued to arrest and arraign more individuals, including highly placed officials, for corruption, the general public expressed the view that the fight against corruption became increasingly inefficient under Yar'Adua. This paper shows that the positive measures taken by the Yar'Adua government were overshadowed by other observed lapses. The first one has been that the government was patronizing some ex-public officials accused of corruption by the EFCC, especially former governors, who played key roles in his election. Secondly, Yar'Adua also presided over the purge and persecution of popular anti- corruption crusaders, especially Nuhu Rubadu, the former chairman of the EFCC. Thirdly, President Yar'Adu was not forceful enough, notably in his speeches, with his anti-corruption program. For the incoming administration, the paper recommends to make anti-corruption a strong priority and to reduce political intereference in the work of anti-corruption agencies. Having lost the immunity conferred on them by Section 308 of the Constitution, the Economic and Financial Crimes Commission (EFCC) invited them for investigation on the basis of several petitions alleging diversion of public funds running to billions of naira. Some reported for interrogation while others sought interlocutory and perpetual injunctions restraining the EFCC from arresting, investigating or prosecuting them in any manner whatsoever and howsoever. Among those who were charged to court only two have been convicted and given light sentences. The majority of the defendants have continued to manipulate the criminal justice system to frustrate their trial. To the eternal shame of the country one of the ex-governors who got a clean bill of health by a Nigerian court was later convicted and jailed by a British court. Out of the two, who jumped bail in the United Kingdom, one is now a Senator of the Republic. Not unexpectedly, the Nigerian people have justifiably blamed lawyers and judges for frustrating the anti-graft agencies from successfully prosecuting politically exposed persons and other members of the ruling class accused of corrupt practices and money laundering. -

Abstract It is a truism that an average Nigerian does not view politics as an act of social administration, but that of self administration having seen the series of insanity exhibited by our leaders’ tagged administration. To worsen the situation, the judiciary and the media whom are viewed as the last hope of the common man pass ridiculous judgment in political litigations as well as praise sing the government of the day. The case of the legislatures is even terrible because the entire fund that would have been invested in social development goes into their kitty. This paper examines the dimensions of corruption by our leaders in social administration. It marvel's at the way politicians treat citizens generally whom for their sake they claim to be in power. It however submits that for the country to experience meaningful development there is the need to re–discuss our democracy for the common man to enjoy the dividends of democracy. ACTA UNIVERSITATIS DANUBIUS Vol. 11, no. 2/2018 An Appraisal of the Activities of Economic and Financial Crime Commission (EFCC) on the Administration of Criminal Justice in Nigeria Osayemwenre Blessing Omoroghomwan1 Abstract: The Economic and Financial Crime Commission has been perceived as an ivory tower in both the fight against corruption in Nigeria and repositioning the financial mal-adjustment in the Nigeria economy. Since its establishment in 2004, the commission has wielded enormous power in tackling corrupt practices stemming from several convictions of alleged corrupt political officers, tales of trials but with little charges and sentence. The activities of the Commission have become increasingly complicated as a result of it dislodged external structural and functional influence in the administration of criminal justice. Governmental interference, poor leadership of the various successive leaders of the commission and the widespread belief that the disposition and manifestation of the leadership of the commission are politically motivated to favor all time ruling parties in Nigeria have created lacunas in their administration of criminal justice in Nigeria. This study which was anchored on the Structural Functionalist theory stressed that because the leadership of the commission is considered ineffective and lacks the confidence to fight corruption, there is a tendency that Nigeria survival cannot be sustained and for the activities of the commission to be effective and help achieve the survival of Nigeria, there must be a conscious effort by the commission to set aside leadership and ethnic sentiment and objectively fight corruption as it should be. The study concluded that the commission cannot solely fight corruption or ensuring a smooth administration of criminal justice in Nigeria because of the high political interference of the elite, poor leadership and the un-enabling environment of the commission to function and recommended that for the commission to achieved and surpass her current achievements, some level of independence is required.
