Appellant has filed a memo dated 10.04.2013 stating that the appellant and the 1 st respondent have entered into a compromise in E.P.No.46/1993 which is pending before the Additional Civil Judge (Sr.Dn.) at Puttur, D.K. It is also stated in the memo that both the parties have filed a Joint Memo before the Court below in the execution proceedings reporting settlement reached between them. The copy of the joint memo filed in E.P.No.46/1993 is also enclosed to the memo filed. 2. Counsel for the appellant is not present. However, in the light of the memo filed and the settlement reached between the parties, consideration of the appeal on merits is rendered unnecessary.
