NON-DETAINED PETITIONS

This is advise staff that the CSWs should consider the use and appropriateness of filing a non- detained petitions as a case strategy to support the reduction of the number of youth that enter out-of-home care.

Non-detained petitions may be filed at any time when the assessment of a family leads to the conclusion that the safety and protection of a child requires judicial intervention, but immediate detention is not warranted.

Whenever possible and when available in the office/SPA CSWs are to utilize the Family-Centered Team Decision Making approach to determine if filing a non-detained petition is appropriate in lieu of court intervention. In addition, CSWs should also consult with the County Counsel assigned to the case or the County Counsel designated to that SPA/Area Office to determine the appropriateness of filing a non- detained petition and when applicable, consult with County Counsel regarding the contents of the non- detained petition.
