Background The Academic Senate of Cal Poly Pomona passed a set of procedures for selecting faculty representatives to the Presidential Selection Advisory Committee in 1990 that were subsequently approved by President La Bounty. In the intervening thirteen years both the Trustees policies and the laws of the State of California changed. These changes supersede the procedures passed by the Academic Senate. The procedures must be modified to conform to these changes.

In 1990, Trustees policy called for the election of three faculty representatives to the Advisory Committee. Currently the Trustees require the chair of the Academic Senate serve on this committee and two other faculty be elected. The procedure must be modified to reflect this change.

At the time of the original procedures, one could require nominees to list their gender, ethnicity, and disabilities on the nomination form. Such a requirement is no longer legal. Therefore, the Academic Senate cannot explicitly use these criteria in its decisions. As a result, the definition of constituency is now restricted to Colleges, Schools, and Centers.

Discussion The committee determined through faculty consultation that the only revisions of the procedure for electing faculty representatives to the Advisory Committee to the Trustees Committee for the Selection of the President should be those changes deemed necessary to bring the procedure up to compliance with Trustees policy and state law.

PROCEDURES FOR SELECTING FACULTY REPRESENTATIVES TO THE PRESIDENTIAL

SELECTION ADVISORY COMMITTEE

BACKGROUND

The procedures for the selection of Presidents within the CSU System requires the establishment of a Presidential Selection Advisory Committee (PSAC). The committee is composed of the Chair of the Board of Trustees, three Trustees, the Chancellor, a President from another CSU campus; and from the affected campus, the chair of the Academic Senate plus two three faculty members, one administrative and support staff person, one student, one alumnus/alumna, and one member from the Campus Advisory Committee. The Chair of the Board of Trustees, the three Trustees and the Chancellor are the only voting members of the PSAC.

The procedures for selecting the two three faculty members are not specified, other than that they are to be selected by the faculty. Therefore, the Steering Committee is presenting to the Senate and seeking Senate approval of a procedure by which the two three faculty members will be selected at Cal Poly Pomona. for the Presidential search that will occur this academic year.

RECOMMENDATIONS

I. The Senate will put out a request for nominations. Each faculty member wishing to serve will be required to obtain five nominating signatures from other faculty members and to complete the attached form. The faculty members who will be eligible to serve include all Unit 3 tenured and probationary full-time faculty.

II. The Steering Committee will review the qualifications of those who have been nominated. The following criteria will be used in evaluating the nominations:

1. The faculty member must have significant experience and knowledge of the numerous constituencies at Cal Poly so that they can responsibly represent university-wide needs. 2. The faculty member must have leadership skills and the ability to represent faculty concerns in a clear and assertive manner. 3. The faculty member must understand the polytechnic history of Cal Poly and have a clear vision of the uniqueness of Cal Poly’s future within the CSU system. 4. The Steering Committee in its deliberations will consider the ethnic and gender diversity of the campus in selecting nominees.

From all the nominations, the Steering Committee will then select six to nine candidates (at the discretion of the Steering Committee) who will run in a campus-wide election. The faculty who will be eligible to vote in the campus-wide election include all unit 3 tenured and probationary full- time faculty. III. The results of the campus-wide election will be determined as follows:

1. The two candidates who place first and second from ballots cast will be appointed to the PSAC. If two candidates tie for the greatest number of ballots cast, they shall be designated as co-winners. If a candidate places first but more than one candidate ties for second place, a runoff election for the second seat on the PSAC will be held.

1. Any candidate who receives a majority of votes cast will automatically be on the PSAC with the exception that three faculty members from the same constituency* receive majorities. In that case, the candidate with the smallest majority will not be eligible and a second election among not more than three candidates will be held to determine the third committee member. The candidates for the second election will be those nominees from unrepresented constituencies with the most votes in the first election. The candidate with the most votes in the second election will be declared the winner. 2. If the first election does not produce three majority winners, a runoff election will be held. a. In the event that no candidate receives a majority in the first election, the runoff election will be among the five candidates with the most votes with no more than two candidates from anyone constituency. The three candidates with the most votes in the second election will be declared the winners. b. In the event that one candidate receives a majority in the first election, the runoff will be among the four candidates with the most votes in the first election with no more than two candidates from anyone constituency. The two candidates with the most votes in the second election will be declared the winners.

*Constituency is defined as college, school, or center. center, ethnicity, gender and/or disability.

c. In the event that two candidates receive majorities in the first election, two cases are poss1ble: i. If the two candidates are from the same constituency, the runoff election will be among the three candidates from unrepresented constituencies with the most votes. ii. If the two nominees are from different constituencies, the runoff election will be among the three candidates with the most votes regardless of constituency.

The candidate with the most votes in the second election will be declared the winner.

3. In the event the procedures outlined above do not constitute the Faculty representation on the PSAC, the Steering Committee will fill any remaining positions. 4. In the event a faculty vacancy arises on the PSAC, the Steering Committee will select a replacement from eligible faculty as defined above.
