concerning policy analysis, monitoring and evaluation units within specialized central public administration bodies

* * * For the purpose of consolidating strategic planning, analysis, monitoring and evaluation capacities concerning policies oriented towards accomplishment of objectives of the Economic Growth and Poverty Reduction Strategy (2004 – 2006), approved through Law no.398-XV of December 2nd, 2004 (Official Gazette of the Republic of Moldova, 2005, no.5-12, art.44), Government Activity Programme for 2005 – 2009 “Country Modernization – Welfare of Population”, Republic of Moldova – European Union Action Plan, approved through the Government Decision no.356 of April 22nd, 2005 (Official Gazette of the Republic of Moldova, 2005, no.65-66, art.412), Strategy for Central Public Administration Reform, approved through the Government Decision no.1402 of December 30th, 2005 (Official Gazette of the Republic of Moldova, 2006, no.1-4, art.9), as well as other development strategies / programmes, the Government DECIDES: 1. Ministry of Agriculture and Food Industry, Ministry of Industry and Infrastructure, Ministry of Transportation and Roads Management, Ministry of Education and Youth, Ministry of Health and Social Protection and Ministry of Justice shall establish policy analysis, monitoring and evaluation units. 2. To approve the Template – Regulation of policy analysis, monitoring and evaluation units from within the specialized central public administration bodies (attached hereto). 3. The policy analysis, monitoring and evaluation unit from within the specialized central public administration unit shall be granted the status of an autonomous structural subdivision. 4. Ministries mentioned in point 1 of this present decision shall: elaborate, together with the Public Administration Reform Coordination Unit (Experts Group within the Government Office) and present to the Government for approval, within 15 days, the modifications to the Government Decisions concerning the structure and the functioning regulation of the respective ministry, within the limit of the approved maximum number of personnel on the staff; approve, within 10 days after modifying the structure of the ministry, the regulation of the policy analysis, monitoring and evaluation unit, based on the Template – regulation mentioned above; organize the policy analysis, monitoring and evaluation unit activity pursuant to the provisions of the regulation approved. 5. Ministry of Economy and Trade shall: elaborate, together with ministries mentioned, methodological indications concerning the process of monitoring, evaluating and reporting on policy implementation; contribute to initial consolidation of institutional and functional capacities of the respective units; analyze efficiency of these units’ activity and the impact of their functioning and elaborate, together with the Government Office, proposals concerning creation, in 2007, of similar units within the other specialized central public administration units. 6. Control over execution of this present decision shall be delegated to Mr. Valeriu Lazăr, Minister of Economy and Trade.

TEMPLATE - REGULATION of the policy analysis, monitoring and evaluation unit from within the specialized central public administration body

I. GENERAL PROVISIONS 1. The template regulation of the policy analysis, monitoring and evaluation unit from within the specialized central public administration body establishes the organization and functioning principles of the respective subdivision. 2. The purpose of the policy analysis, monitoring and evaluation unit from within the specialized central public administration body (hereinafter – unit) is to contribute to the improvement of public administration authority’s activity through the following: a) ensure coordination of sector policy elaboration activities; b) examine comprehensively the social, economic, financial, environmental etc. impact of policies elaborated; c) create and consolidate an efficient and durable interaction system of policy elaboration process with budgetary process; d) consolidate capacities for policy strategic planning, analysis, monitoring and evaluation. 3. The unit shall contribute to the development of policy documents, elaborated by other subdivisions of the body in which it activates, by ensuring compliance of these policies with national concepts, strategies, programmes and plans. 4. In its activity, the unit shall observe the legislation of the Republic of Moldova, the decrees of the President of the Republic of Moldova, the decisions, dispositions and ordinances of the Government, the Regulation on the organization and functioning of the public administration authority, Minister’s orders, as well as this present Regulation.

II. ATTRIBUTIONS OF THE UNIT 5. The unit shall have the following attributions: a) participate to the elaboration of national concepts, strategies, programmes and plans, developed by the structural subdivisions of the body in which it activates; b) analyze and examine policy documents elaborated by the body in which it activates, including for the purpose of ensuring: compliance of policies with provisions of national concepts, strategies, programmes and plans; interaction between policy elaboration process and budgetary process; alignment of policies to European integration priorities and necessities of the country; c) coordinate, together with the author – subdivision, the policy elaboration process with other central and local public administration authorities and other stakeholders; d) analyze the drafts of normative acts in the respective field, elaborated by other structural subdivisions to ensure their compliance with existent policies; e) carry out diverse studies in the field; f) monitor and evaluate implementation and impact of sectorial and intersectorial policies elaborated by the body in which it activates; g) suggest adjustment and updating of existent policy documents based on evaluation of national, regional and local development programmes; h) manages the database necessary for policy monitoring and evaluation; i) facilitates participation of all stakeholders to policy elaboration, analysis, monitoring and evaluation processes.

III. RESPONSIBILITIES OF THE UNIT 6. The unit shall be responsible for the following: a) analyze policy options and present recommendations concerning the optimal option to the manager; b) analyze costs and benefits of policy options; c) analyze policy impact; d) elaborate reports concerning policy implementation, including in the field of European integration, based on the unique monitoring and evaluation system for these; e) present to the management board of the body in which it activates proposals for improving quality of documents elaborated by other structural subdivisions.

IV. MANDATE OF THE UNIT 7. The unit is empowered to: a) solicit, under law provisions, from other internal subdivisions of the public administration authority, from its territorial structures and from other bodies subordinated to it information and other documents necessary for the exercise of its mandate; b) attract collaborators of other internal subdivisions of the public administration authority in the policy analysis, monitoring and evaluation process; c) collaborate with similar units from within other authorities to exchange experience in the field; d) participate to training courses, conferences, seminars, round tables and other activities, organized in the Republic of Moldova and in other countries, on a subject relevant to its field of activity; e) exercise the rights stipulated in the legislation of the Republic of Moldova.
