Brown County Sheriff’s Office - Sheriff Sale Information for Attorneys
Filing a Notice Brown County Sheriff Sales are held on Wednesdays (unless otherwise noted) at 10 a.m. in the Truttman Room of the Brown County Law Enforcement Center, 300 E. Walnut, Green Bay, Wisconsin.
How do I obtain a sale date? Contact Anita at the Civil Processing Unit to find out when the next available Sheriff Sale date would be. You can contact Anita at (920) 448-4244 or [email protected] .
What is the cost for a sheriff sale? Posting fees are $75 and sale fees are $75. Please make checks payable to the Brown County Sheriff’s Office. If the sale is adjourned more than two weeks beyond the original sale date, a new notice must be prepared for posting including a $75 posting fee.
Is there any wording that needs to be included in the notice? Yes, with the other information in the notice, Sheriff Dennis N. Kocken will only sign Notice of Sheriff Sales that includes the wording: “Buyer to pay applicable Wisconsin Real Estate Transfer Tax from the proceeds of the sale.”
How many copies of the notice should I provide? Along with your original, please provide 5 copies for posting.
NOTICE: Please provide a copy of the foreclosure judgment when submitting the notice of sale.
Suggested Notice of Sale Format. Although many different formats for Notice of Sheriff Sales are acceptable, the Brown County Sheriff’s Office has attached a suggested format to help insure all the information requested is included.
Do I need to be present at the sale? The Sheriff’s Office will accept opening bids, adjournment requests or cancellations of sale for properties via fax. Faxes should be sent to (920) 448-4206 on company letterhead and received no later than 8:30 a.m. on the designated sale date.
Sale Follow Up Effective July 1, 2009, the following documents need to be submitted, within a timely manner, to complete a sheriff’s sale on foreclosed properties:
1. Deed 2. Electronic Wisconsin Transfer Return & Receipt (3 pages) 3. Report of Sale 4. Original Certificate of Posting 5. Original Notice of Sale 6. Original Proof of Publication
When this packet is submitted, reviewed and signed, the Brown County Sheriff’s Office will forward the paperwork to the Brown County Clerk of Courts Office for the Confirmation of Sale hearing. PLEASE NOTE INCOMPLETE PACKETS WILL NOT BE SUBMITTED.
