KRISTAL HAIL NETTING WARRANTY

GREY HAIL NETTING WARRANTY 1/3

This document states that the 2.8x8 KRISTAL 0.32 coloured hail netting (SINGLE THREAD HDPE KRISTAL 0.32 warp and weave) and 2.8x8 GREY coloured hail netting (SINGLE THREAD HDPE KRISTAL 0.32 warp for SINGLE THREAD HDPE NERO 0.32 weave), is produced by us with substances (both in composition and pigmentation) for which its natural deterioration, shared by all plastic materials due to outdoor exposure in your geographical area (see zone/solar radiation table appendix 1 page 3/3), will never jeopardise efficiency for at least ten years from the date of delivery.

This allows us to guarantee the 2.8x8 KRISTAL coloured and GREY coloured hail netting for a minimum of ten years (one hundred and twenty months) from the date of delivery, during which time TESRETE S.R.L., as netting manufacturer, shall be solely liable for any netting problem not due to the following points.

The product warranty is null and void in the following cases:

 Damages of mechanical nature, obviously due to incorrect handling, loading/unloading, transport (i.e.: cuts or tears due to dragging the netting on the ground, improper tools and/or devices used on the netting that produce cuts, tears, scratches, burns, etc.) and/or any extraordinary strains beyond normal netting handling procedures.

 Damages during netting installation and/or fitting to the plant (i.e.: netting contact with sharp or abrasive areas such as, for example, the tops of poles not covered with specific pole caps; dragging and/or rubbing the netting against branches), with standard plant installation, the netting will be considered efficient as long as its threads have an average tension resistant on each single thread not under 1.00 kg for the entire warranty period, etc.;

 Damages caused by direct netting installation on resinous wooden poles and/or treated with substances that can deteriorate the mechanical netting features, such as naphtha, tar, sulphurous solutions, solvent paints, etc.;

 Damages obviously due to couplings (sharp plates, incorrect seams, etc.);

 Damages caused by phenomena of extraordinary and exceptional nature: tornados, hurricanes, storms, burns due to contact with metallic surfaces or extraordinary hail storms;

 Damages due to direct netting reel/roll exposure to the sun, without covering (and packaging), for a period over four hours;

Viale Friuli, 8 - 24049 VERDELLO (BG)  Oxidising chemical attacks to the netting structure due to acid, halogenated or sulphured substances (pesticides, acid rain, pollution), or due to exceeding the following maximum limits for the substances indicated below: S 1.000 ppm (parts per million); Cl 60 ppm and Fe 45 ppm. 1/3

Note: while currently used and known normal pesticides are, if used in the correct doses, harmless to the netting, we cannot guarantee the use of any other active ingredients, not commonly and currently used, in advance. Should early netting deterioration be attributed to aggression due to new chemical substances, proven by suitable laboratory analyses, the warranty shall be null and void.

However, it is hereto agreed that, even if, due to concealed defect and/or any other problem, not due to unexpected or exceptional events, early netting deterioration occurs in that period of time, the warranty shall cover the sole free replacement of no longer suitable material and thus no claims can be filed for other direct or indirect damage compensation.

This replacement shall always be proportionate to the time remaining on the warranty period and, therefore, a 10% yearly netting depreciation shall be considered.

Please also note that the netting replacing damaged netting under the warranty and recognised by TESRETE S.R.L. as remelted, shall extend the warranty for a period proportionate to the warranty period remaining on the first and damaged netting, from the time of the damage and for the entire original warranty period.

Please also note that TESRETE S.R.L. shall not be held liable for any direct, indirect or consecutive damages due to early netting deterioration, under this warranty, compared to its declared service life.

Lastly, please note that this warranty is exclusively governed by Italian law and that any disputes shall be submitted to the court of Bergamo (exclusively).
