Purdue Ballroom Dance Team

Purdue Latin & Ballroom Competition Team Contract – Fall 2009 I, the undersigned, understand the requirements of the Purdue Latin & Ballroom Competition Team, hereafter referred to as "the Team" for the 2009 Fall Semester, and as a Team Member, agree to abide by those rules. I will accept the decisions of the coaches, and officers at all times in regard to attendance, practices, and competitions. I will respect the coaches and their positions, the officers as well as the other dancers on the team. In return I will receive their respect. This contract is valid for the dates of Monday August 24th, 2009 through Friday December 11th, 2009. It is understood by the undersigned that all practices are to be attended and that participation in at least one competition is expected for members above the pre-bronze level. All members are encouraged to go to the Purdue Ballroom Classic on November 7, 2009 and the Ohio Star Ball National Collegiate DanceSport Challenge on November 20-22, 2009 in Columbus, OH.

If a Team Member cannot be present for the practice or perform at a competition because of an exam or personal reasons they are responsible for contacting the team captains and their partner and making them aware of the situation before the event. It is also understood by the undersigned that he/she is responsible for conducting him/herself in a professional and mature manner when representing the Team at events.

The dues for the team are $85.00 per person and are non-refundable. The dues cover all team practices and admission to Social Parties. Additional information regarding the meeting times can be found on http://purdueballroom.org. Payment is expected in full at the time of signing the contract. In consideration of permission granted by Purdue University allowing me to participate in Ballroom Dance (the "Activity"), which will occur from August 24 th , 2009 through December 11 th , 2009, which is sponsored by the Purdue Latin & Ballroom Dance Team, I (together with my parent or guardian, if I am under the age of eighteen or under a legal disability) represent, covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under or through me, as follows:

I. I acknowledge that participating in the Activity involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or in part by the negligence or other fault of Purdue University, the Trustees of Purdue University, and/or its or their departments, affiliates, employees, officers, agents or insurers ("Released Parties").

II. I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known and unknown, which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims.

III. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties.

IV. I have carefully read and reviewed this Waiver, Release and Hold Harmless Agreement. I understand it fully and I execute it voluntarily.

V. I understand that the team reserves the right to eject any person(s) deemed unruly or unfit to stay within the activity.
