Dignified Care & Responsibility Training 4 Day Train the Trainers Course Managing Challenging Behaviour in Educational Settings Including After Schools Services Staff /Care Homes
Discover how you can safely and legally manage difficult pupils within a “duty of care” framework. This course will enable Schools / after Schools Services to have there own highly trained member of staff to cover all aspects of section 550a of the Education Act 1996. This new section came into force on the 1st September 1998, and applies to all schools; it restates principles derived from common law and statute which have, in the past, been misunderstood. For example there is a common misconception that, since the Children’s Act 1998, any physical contact with a child is in some way unlawful. That is not true. Where necessary reasonable force can be used to control or restrain pupils. Physical contact with pupils may also be appropriate or necessary in other circumstances. As a teacher you are expected in law to exercise a “duty of care” towards your pupils. Definition An obligation to take reasonable care to avoid causing foreseeable harm to another person or their property. (Dulhaimes Law Dictionary) Schools Teachers” Pay and Conditions Document: “Teachers are required to maintain good order among the pupils and to safeguard their health and safety, both when they are authorised to be on school premises and when they are engaged in authorised school activities elsewhere” Duty of care is the same protection as a caring parent would extend to his/her own children, in the sense that you have a large family, and that at least some of your children can be expected at times to act unpredictably and in an unruly manner. It is possible for a teacher to become involved in court proceedings in a claim for damages if a parent / guardian claims: 1. A duty of Care existed. 2. There was a breach of that duty. 3. Injury to a pupil resulting from that breach. Circular 10/98 Major points of guidance; . Restraint is a last resort . Schools should have a policy on the use of force to control or restrain pupils . The policy should be communicated to the whole school community . The policy should refer to any guidance from the LEA ( maintained schools) . Where it is known or anticipated that a pupil’s behaviour might require physical control or restraint, a specific plan should be drawn up for that pupil and communicated to all involved (parents/carers, staff, pupils and other agencies if involved). Reasonable Force may be used by teachers and other persons authorised by the head teacher in the following circumstances where pupils are: 1. Committing a criminal offence; 2. injuring themselves or others 3. causing damage to property 4. Engaging in any behaviour prejudicial to maintaining good order and discipline at the school or among its pupils, whether that behaviour occurs in the classroom during a teaching session or elsewhere. . Day 1 Registration Course Aims and Objectives for the week Section 550a of the Education Act / the use of force to control or restrain Pupils. Health and Safety Legislation / Environmental Risk Factors Introduction to Theories of Aggression / de-escalation Techniques Policy Development for Schools this will include dealing with irate Parents, plus enforcing a Zero tolerance approach to violence against any staff working in Education
. Day 2 Introduction to Last resort Physical Interventions Techniques shown will be specific to the Education Act (550a). Holds shown are duty of care and specific to children for example Children’s A&E staff also use holds during any treatment process The course covers situations teachers have previously raised concerns about in the past. 1: Removing a disruptive pupil from the classroom 2: Injuring themselves or others 3: Causing damage to property (including the pupils own property) 4: Separating children who may be assaulting each-other
. Day 3 Re-cap previous days training This days training will cover disengagement and control techniques On the following scenarios Teaching staff have raised concerns about 1: Hair pulls either child on child or on staff member 2: Clothing grabs safely opening grip to gain release 3: Discuss and how to deal with bites 4: Punches Kicks how to control a situation and defuse safely 5: Throwing objects in classroom i.e. chairs / dangerous materials
. Day 4 Reporting recording Staff / Pupil support Following an incident staff need to address the following points Witness statements Evidence gathering Effective post incident support for both staff and the child. Rebuilding of the therapeutic process as soon as possible Ensuring the correct terminology is used when completing records. On completion successful candidates will be issued with certificates
Students on completion will have the following knowledge and materials 1. Clear policy in relation to any incidents of aggression 2. A precise reporting and recording form for the organisation 3. Will have addressed the 5 stage risk assessment as required 4. Heads of Schools / Homes will have at hand a bound document on the shelf to produce proof that you have met the legal requirements. 5. Successful staff will receive the D.C.R.T. level 1 certificate 6. D.C.R.T. is an N.C.F.E. Approved training centre.
THE COST OF THIS TRAINING WILL BE £1300 PLUS V.A.T. THIS CAN BE HELD AT YOUR VENUE IF THERE IS 4 OR MORE MEMBERS OF STAFF Venues: This course organised by D.C.R.T. is limited to twelve delegates per course please book early to avoid disappointment.

Rationale for provision of training . The Health and Safety at Work 1974 “This act places a duty of care on employers and employees to ensure, so far as is reasonably practicable, the health, safety and welfare at work of its employees, visitors and contractors. In addition, employees also have, under section 7 of the Act, individual responsibilities to work in an appropriate and safe manner.”
