Summary Report

1.0 PURPOSE OF REPORT

To seek approval to authorise the Kingdom Security Limited Officers listed to exercise the powers detailed in the Schedule to this report.

2.0 LINK TO CORPORATE STRATEGIES

The initiative links directly into one of the corporate strategic goals of the Authority to reduce waste and what is sent to landfill and to improve the cleanliness of the area.

3.0 SUMMARY/PROPOSALS

Due to staff changes in Kingdom Security Limited, it is now necessary to update the list of their staff to ensure that all their employees are duly authorised and so that any Kingdom Security Limited personnel who no longer work for the company have their authorisation formally removed.

That the Kingdom Security Ltd Enforcement Officers named in the Schedule to this report are duly authorised to enforce the powers outlined therein. This list supersedes all previous authorisation reports for Kingdom Security Limited staff.

1. BACKGROUND

1.1 In September 2011, Executive Committee gave approval for a local authority support service to work with the Council to issue fixed penalty notices for littering and dog by-law offences. Kingdom Security Ltd took over this work in April 2013.

2. PRESENT POSITION

2.1 Due to staff changes, it is now necessary to update the list of Kingdom staff to ensure that all their employees are duly authorised and so that any personnel who no longer work for the company have their authorisation formally removed. As a result of this report, the list in the Schedule will supersede all previous authorisation reports for Kingdom Security Limited staff. The list consists of permanent Blaenau Gwent based staff and, to enable business continuity/resilience, a list of reserve staff, that currently operate in other local authority areas, who could then be moved into Blaenau Gwent when staff cover is needed.

5. RISK IMPLICATIONS

5.1 Failure to properly authorise staff exercising legal duties on behalf of the Authority would leave the Authority open to legal challenge.

Page 3 of 5 7.1 There are no staff implications for the Authority associated with this report, as all staff listed within the attached schedule are directly employed by Kingdom Security Limited.

Authorisation under Section 108 Sub Section (1) of the Environment Act 1995 to exercise the powers conferred on a person so authorised contained in Section 108 Sub Section (4) (subject to Sub Sections (5) to (15)) of the Act for the proper discharge of the functions of the County Borough Council in relation to Part IV (Litter etc) of the Environmental Protection Act 1990 (as amended).

Authorised in accordance with Section 59 (11) for the proper discharge of functions of the County Borough Council in relation to Part 6, Chapter 1 of that Act (Dog Control Orders).
