The Essex County Council (Braintree District) (Permitted Parking Area and Special Parking Area) (Consolidation) Order 2007

The Essex County Council in exercise of its powers under Sections 1(1), 2(1) to (3), 4(2), 32(1), 35(1), 45, 46, 49 and 53and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (“the Act”) and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act, hereby make the following Order:-

PART I

CITATION AND INTERPRETATION

1. This Order shall come into operation on 31 August 2007 and may be cited as The Essex County Council (Braintree District) (Permitted Parking Area and Special Parking Area) (Consolidation) Order 2007.

2. In this Order, except where the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them:-

“the Regulations” means the Traffic Signs Regulations and General Directions 2002.

“ambulance” has the same meaning as in the Vehicle Excise and Registration Act 1994;

“authorised taxi rank” means any area of carriageway which is comprised within and indicated by a road marking complying with diagram 1028.2 in Schedule 6 to the Regulations;

“authorised parking place” means any parking place on a road authorised or designated by an Order made or having effect as if made under the Act;

“bus” has the same meaning as in Regulation 22 of the Regulations;

“bus stop” means any area of carriageway, intended for the waiting by buses, which is comprised within and indicated by road markings complying with either diagram 1025.1, 1025.3 or 1025.4 and incorporating the words “Bus Stop” in Schedule 6 to the Regulations;

“carriageway” means a way constituting or comprised in a highway being a way (other than a cycle track) over which the public have a right of way for the passage of vehicles;

“delivering” and “collecting” in relation to any goods includes checking the goods for the purpose of their delivery or collection;

“disabled person’s badge”, “disabled person’s vehicle” and “parking disc” have the same meanings as in the Local Authorities’ Traffic Orders (Exemption for Disabled Persons) (England) Regulations 2000;

“doctor” means a “fully registered person” as defined in Section 55 of the Medical Act 1983;

“dual purpose vehicle” has the same meaning as in Schedule 6 to the Act;

“driver” in relation to a vehicle waiting in a parking place or on a road or length of road, means the person driving the vehicle at the time it was left in that parking place or road or length of road;

“enactment” means any enactment, whether public general or local, and includes any order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment and any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment;

“goods” means goods or burden of any description and includes postal packets of any description;

“goods vehicle” means a motor vehicle which is constructed or adapted for use for the carriage of goods or burden of any description but shall not include a trailer so constructed or adapted;

“hackney carriage” means a hackney carriage as defined in Section 38 of the Town Police Clauses Act 1847;

“hackney stand” means an area of carriageway which is comprised within and indicated by road markings complying with diagram 1028.2 in Schedule 6 to the Regulations;

“layby” means an area of carriageway intended for the waiting of vehicles and bounded partly by a traffic sign of the type shown in diagram 1010 of Schedule 6 to the Regulations, and partly by the outer edge of that carriageway on the same side of the road as that on which the sign is placed;

“loading” means the loading or unloading of goods to or from a vehicle;

“loading place” means any area on a highway designated by this Order;

“main carriageway” means any carriageway used primarily by through traffic and includes any carriageway of a slip road but excludes any layby;

“motor car” means a mechanically propelled vehicle not being a motor cycle or a disabled persons’ vehicle which is constructed itself to carry a load or passengers and the weight of which unladen does not exceed two tons;

“motorcycle” and “invalid carriage” have the same meaning as in Section 136 of the Act;

“owner”, in relation to a vehicle means a resident who is named in the vehicle registration document as the registered keeper of a goods or passenger vehicle or who has the use of such a vehicle in the course of his employment and who is entitled to use such a vehicle as though he were the registered keeper thereof;

“parking attendant” means a person authorised by or on behalf of Braintree District Council to supervise and carry out enforcement in respect of any parking area;

“parking bay” means an area within a parking place marked out for the leaving of a vehicle;

“parking permit” means a device issued by Braintree District Council showing the date up to which the said permit is valid and registration mark issued pursuant to the Vehicle Excise and Registration Act 1994 of the vehicle in respect of which the said permit was issued and parking place in respect of which the said permit is valid;

“passenger vehicle” means a motor vehicle (other than a motor cycle or invalid carriage) constructed solely for the carriage of passengers and their effects and adapted to carry not more than twelve passengers exclusive of the driver, and not drawing a trailer;

“penalty charge” and “reduced penalty charge” mean a charge set by Braintree District Council under the provisions of Section 66 of the Road Traffic Act 1991 and with the approval of the Secretary of State for Transport which is to be paid to Braintree District Council within 28 days beginning with the date of the notice, or 14 days in the case of a reduced penalty charge, following the issue of a penalty charge notice;

“penalty charge notice” means a notice issued or served by a parking attendant pursuant to the provisions of Section 66 of the Road Traffic Act 1991;

“permitted hours” means the hours identified on the plans attached to this Order;

“prohibited area” means any area of carriageway shown as intended for the waiting of public service vehicles on the plans attached to this Order which is comprised within and indicated by a road marking complying with either diagram 1025.1, 1025.3 or 1025.4 in Schedule 6 of the Regulations;

“relevant position” in respect of:

(a) a disabled person’s badge or a parking permit, means:

(i) in the case of a vehicle fitted with a front windscreen, that the badge or permit is exhibited on the nearside of and immediately behind the windscreen with the front facing forward so as to be visible and legible from the outside of the vehicle; or

(ii) the case of a vehicle not fitted with a front windscreen, that the badge or permit is exhibited on the front or nearside of the vehicle;

(b) a disabled person’s parking disc, means that the side showing the time is facing forward or outward and immediately behind the windscreen or side window nearest to the kerb;

“specified position” a vehicle left in a parking place during the permitted hours in accordance with the foregoing provisions of this Order shall cause it so to stand:

(a) in the case of the parking place in relation to which special provisions as to the manner of standing of a vehicle in that place are specified in an item specified in a Schedule as to be in accordance with those provisions;

(b) in the case of any other parking place:

(i) if the parking place is not in a one-way street, that the left or nearside of the vehicle is adjacent to the left-hand edge of the carriageway;

(ii) that the distance between the edge of the carriageway and the nearest wheel of the vehicle is not more than 300 millimetres;

(c) so that every part of a vehicle is within the limits of a parking place;

d) that no part of the vehicle obstructs any vehicular means of ingress to or egress from any premises adjacent to the side of the road on which the vehicle is waiting;

“specified hours” means the hours identified for parking or unloading places on the plans attached to this Order;

“telegraphic line” has the same meaning as in the Telecommunications Act 1984;

“timing point” means a recognised timing point which is the location where a public service vehicle may wait to ensure adherence to a published timetable or local service registration, and includes departures and terminal points; provided that the location has been approved in writing by the Chief Constable and the Highway Authority;

“trade licence” and “trade plate” have the same meaning as in the Road Vehicles (Registration and Licensing) Regulations 1971;

“traffic sign” means a sign of any size, colour and type prescribed or authorised pursuant to or having the effect as though prescribed or authorised pursuant to Section 64 of the Act;

“vehicle” means a mechanically propelled vehicle intended or adapted for use on roads (motor vehicle as defined in Section 136(1) of the Act) and a vehicle drawn by a motor vehicle (trailer as defined in Section 136(1) of the Act);

“verge” means any part of a road which is not a carriageway;

3. (a) Except where otherwise stated, any reference in this Order to a numbered Article is a reference to the Article bearing that number in this Order.

(b) Insofar as any provision of this Order conflicts with a provision which is contained in an Order made or having effect as if made under the Act and existing at the time when this Order comes into operation and which imposes a restriction or prohibition on waiting by vehicles other than buses in a bus stop clearway or grants an exemption from such restriction or prohibition, that provision of that Order shall prevail.

4. The prohibitions imposed by this Order shall be in addition to and not in derogation of any restriction, prohibition or requirement imposed by any Regulations or Orders made or having effect as if made under the Act, or by or under any other enactment.

5. Save where the contrary is indicated, any reference in this Order to:-

(a) This Order or another Order shall be construed as such a reference to this Order or, as the case may be, such other Order, as the same may have been or may from time to time be amended, varied or supplemented;

(b) A Statute or Regulation shall be construed as reference to such Statute or Regulations as the same may have been, or may from time to time be amended or re-enacted.

PART II PROHIBITION AND RESTRICTION OF WAITING

6. Save as provided in Articles 7 to 12 of this Order no person shall, except upon the direction or with the permission of a police constable in uniform, traffic warden or a parking attendant, cause or permit any vehicle to wait on the roads or sides of the roads identified and for the periods identified (or, in the case of a road or side of road where limited waiting is permitted, otherwise than during the period identified) on the plans attached to this Order.

7. Nothing in Article 6 of this Order shall render it unlawful to cause or permit any vehicle to wait so long as it may be necessary for the purpose of enabling goods to be loaded on or unloaded from the vehicles on the roads identified and for the periods identified on the plans attached to this Order.

8. (1) Nothing in Article 6 of this Order shall render it unlawful to cause or permit any vehicle to wait in any of the roads, lengths of road or on the sides of road specified therein for so long as may be necessary to enable:

(a) a person to board or alight from the vehicle;

(b) the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:-

(i) building, excavating or demolition work whilst lawfully and actively engaged on those duties;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of the said lengths or sides of road; and

(iv) the laying, erection, alteration or repair in or on land adjacent to the said lengths or sides of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line;

(v) the vehicle, if it cannot conveniently be used for such purposes in any other road, to be used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;

(d) the vehicle of a universal service provider (as defined in Section 4(3) and (4) of the Postal Services Act 2000) to be used for the purpose of delivering and/or collecting mail;

(e) to enable the vehicle to be used for fire brigade, ambulance or police purposes;

(f) in any case where the person in control of the vehicle:

(i) is required by law to stop;

(ii) is obliged to stop so as to prevent an accident; or

(iii) is prevented from proceeding by circumstances outside his control.

(2) Nothing in Article 6 of this Order shall render it unlawful to cause or permit any vehicle:

(a) to wait upon an authorised parking place; or

(b) being a hackney carriage, to wait upon a hackney stand.

9. Nothing in Article 6 of this Order shall render it unlawful to cause or permit a disabled person’s vehicle which displays in the relevant position a valid and legible disabled person’s badge and a parking disc, on which the driver or other person in charge of the vehicle has marked the time at which the period of waiting began, to wait in any of the roads, lengths of road or on any of the sides of road identified on the plans attached to this Order, except designated clearways or where loading is prohibited, for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle in the same length of road or on the same side of road on the same day). Provided that in respect of the roads identified in the plans attached to this Order when loading is permitted at all times or limited to certain times such period lies entirely within the period during which loading is permitted.

10. Nothing in Article 6 of this Order shall render it unlawful to cause or permit a disabled person’s vehicle which displays in the relevant position a valid and legible disabled person’s badge to wait at the sides of the roads identified on the plans attached to this Order where limited waiting is permitted.

11. Insofar as any provision of this Order conflicts with a provision which is contained in an Order made or having effect as if made under the Act and existing at the time when this Order comes into operation, and which imposes a restriction or prohibition on waiting by vehicles other than a public service vehicle in a bus stop clearway area or grants an exemption from such restriction or prohibition, that provision of that Order shall prevail.

12. Nothing in Article 6 to this Order shall render it unlawful for the driver of a public service vehicle to cause that vehicle to wait at a recognised timing point.

PART III PROHIBITION OF LOADING AND UNLOADING

13. Save as provided in Article 14 of this Order no person shall, except upon the direction or with the permission of a police constable in uniform, traffic warden or a parking attendant, cause or permit any vehicle to be loaded or unloaded in the roads or sides of road identified and for the periods identified on the plans attached to this Order.

14. Nothing in Article 13 of this Order shall render it unlawful to cause or permit any vehicle to wait in the lengths of road for so long as may be necessary to enable:-

(a) a person to board or alight from the vehicle;

(b) the vehicle, if it cannot conveniently be used for such purposes in any other road, to be used in connection with any of the following operations, namely:-

(i) building, excavating or demolition work;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of the said lengths or sides of road; or

(iv) the laying, erection, alteration or repair in or on land adjacent to the said lengths or sides of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line;

(c) the vehicle, if it cannot conveniently be used for such purposes in any other road, to be used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;

(d) the vehicle of a universal service provider (as defined in Section 4(3) and (4) of the Postal Services Act 2000) to be used for the purpose of delivering and/or collecting mail;

(e) to enable the vehicle to be used for fire brigade, ambulance or police purposes.

PART IV CLEARWAYS

15. Save as provided in Article 16 of this Order no person shall, except upon the direction or with the permission of a police constable in uniform or of a traffic warden, cause or permit any vehicle to wait on any of the main carriageways and verges comprised in the roads identified and for the periods identified on the plans attached to this Order.

16. Nothing in Article 15 of this Order shall apply:

(a) so as to prevent a vehicle waiting on any main carriageway or verge referred to in that Article for so long as may be necessary to enable the vehicle to be used in connection with

(i) any building or demolition operation;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of the road comprising or including that carriageway; or

(iv) the laying, erection, alteration or repair in or near such road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line;

(b) to a vehicle being used for fire brigade, ambulance or police purposes;

(c) to a vehicle being used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;

(d) to a vehicle being used for the purpose of delivering or collecting postal packets as defined in Section 125(1) of the Postal Services Act 2000;

(e) to a vehicle waiting on any main carriageway referred to in that Article while any gate or other barrier at the entrance to premises to which the vehicle requires access or from which it has emerged is opened or closed, if it is not reasonably practicable for the vehicle to wait otherwise than on that carriageway;

(f) to a vehicle waiting when the person in control of the vehicle:-

(i) is required by law to stop;

(ii) is obliged to stop to avoid an accident; or

(iii) is prevented from proceeding by circumstances outside his control;

17. No person shall cause or permit any vehicle to wait on any verge immediately adjacent to any of the main carriageways comprised in the roads specified in the Schedule to this Order for the purpose of selling goods from that vehicle unless the goods are immediately delivered at or taken into premises adjacent to the vehicle from which the sale is effected. PART V EXEMPTIONS FOR DISABLED PARKING BAYS

18. Nothing in this Order shall render it unlawful to cause or permit any vehicle to waiting in a disabled parking bay identified on the plans attached to this Order for so long as may be necessary to enable:

(a) a person to board or alight from the vehicle;

(b) the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:-

(i) the maintenance, improvement or reconstruction of the said lengths or sides of road; and

(ii) the laying, erection, alteration or repair in or on land adjacent to the said lengths or sides of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line;

(c) to enable the vehicle to be used for fire brigade, ambulance or police purposes.

PART 1

Definition and Interpretation

1. General

Any reference in this Order to a numbered Part or Clause is a reference to the Part or Clause bearing that number in this Order and any reference in this Order to a map is a reference to the map attached to this Order

2. Definitions

In this Order the following words shall have the meanings stated:-

2.1 “Concessionary Travel Scheme” – the current Concessionary Travel Scheme operated by Braintree District Council

2.2 “Disabled Person’s Badge” – as defined by The Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000

2.3 “Driver” – the person driving a Vehicle at the time it is left in the Parking Place

2.4 “Goods” – postal packets and items of any description which require delivery

2.5 “Notice” – a penalty charge notice issued in accordance with Part 3

2.6 “Owner” – a person being the registered keeper of the Vehicle

2.7 “Parking Attendant” – a person appointed by Braintree District Council who is authorised to enforce the provisions of this Order

2.8 “Parking Place” – an area of highway specified by name in column 1 of the Schedules and by dimension in column 2 of the Schedules being an area which is provided for the leaving of a Vehicle as indicated by markings on the surface of the highway

2.9 “Penalty Charge” - £60.00 charge payable upon certain contravention’s of this Order

2.10 “Permit” - an annual parking permit issued in accordance with Part 2 Clause 2

2.11 “Permit Fee” - the annual fee payable to Braintree District Council for the purchase of a Permit or a Visitors Permit as set out in Part 2 Clause 8

2.12 “Permit Holder” - a person being a Qualifying Resident to whom Braintree District Council has issued a Permit or a Visitors Permit

2.13 “Qualifying Resident” - an owner or occupier of a residential property whose usual place of abode is as follows:

For Zone 1 Permits - Mount Road

For Zone 2 Permits - Woodfield Road

For zone 3 Permits- Victoria Street and Nos. 8 – 86 inclusive (evens only) and Nos. 3 – 103 inclusive (odds only) Manor Street

For Zone 5 Permits - Collins Close, Coronation Avenue, Kenworthy Road and Nos. 14 – 74 inclusive (evens only) and Nos. 1 – 43a inclusive (odds only) Notley Road

For zone 6 Permits- Nos. 8 – 16 inclusive (evens only) Bocking End

2.14 “Reduced Charge” - £30.00 charge which Braintree District Council will accept in lieu of the Penalty Charge in the circumstances detailed in Part 3 Clause 1

2.15 “Relevant Position” - affixed immediately behind the front windscreen of the Vehicle on the near side with the obverse side facing forwards and in the case of a Vehicle not fitted with a front windscreen affixed in a conspicuous position on the front or near side of the Vehicle

2.16 “Vehicle” - a motor vehicle including a car motorcycle and light van not exceeding a mass of 3.5 tonnes 5.5 metres in length or 2.5 metres in width and excluding for the avoidance of doubt heavy vehicles trailers caravans and vehicles adapted to carry more than 8 persons

2.17 “Visitors Permit” - an annual parking permit for the benefit of bona fide visitors to Qualifying Residents issued in accordance with Part 3 Clause 3

2.18 “Zone 1” - the Parking Places as indicated on the plan attached to this order

2.19 “Zone 2” - the Parking Places as indicated on the plan attached to this order

2.20 “Zone 3” - the Parking Places as indicated on the plan attached to this order

2.21 “Zone 5” - the Parking Places as indicated on the plan attached to this order

2.22“Zone 6” - the Parking Places as indicated on the plan attached to this order

PART 2

Application for Permits and Residents Parking Regulations

1. Parking Places

1.1 Each area of highway detailed in column 2 of the Schedules is designated as a Parking Place for the purposes of this Order

1.2 Each Parking Place may be used only by Vehicles displaying a valid Permit or Visitors Permit issued by Braintree District Council in respect of that Vehicle

2. Application for a Permit

2.1 A Qualifying Resident who is the Owner of a Vehicle may apply to Braintree District Council for a Permit in respect of that Vehicle such application to be made on the current standard form issued by and obtainable from Braintree District Council

2.2 On making such an application a Qualifying Resident will:-

2.2.1 produce such evidence to Braintree District Council as it may reasonably require to substantiate that the information and particulars given in the application are correct

2.2.2 pay to Braintree District Council the Permit Fee

2.3 On receiving an application and the Qualifying Resident complying with Clause 2.2 Braintree District Council shall if it is satisfied that the information is correct issue a Permit to the Qualifying Resident

2.4 The Permit Holder may leave the Vehicle to which the Permit relates in a Parking Place specified in the relevant Schedule providing that the Permit is displayed in the Relevant Position on the Vehicle

2.5 If there is more than one Qualifying Resident being the Owner of more than one Vehicle at the same postal address then each Qualifying Resident shall make a separate application to Braintree District Council and pay the appropriate Permit Fee provided that not more than four Permits shall be issued to any one postal address

2.6 The Permit shall remain the property of Braintree District Council at all times and may be withdrawn by Braintree District Council in accordance with the Part 6 Clause 3

3 Application for a Visitors Permit

3.1 A Qualifying Resident may apply to Braintree District Council for a multiple of ten Visitors Permits such application to be made on the current standard form issued by and obtained from Braintree District Council

3.2 On making such an application a Qualifying Resident will:-

3.2.1 produce such evidence to Braintree District Council as it may reasonably require to substantiate that the information and particulars given in the application are correct

3.2.2 pay Braintree District Council the Permit Fee

3.3 On receiving an application and the Qualifying Resident complying with Clause 3.2 Braintree District Council shall if it is satisfied that the information is correct issue a Visitors Permit to the Qualifying Resident

3.4 Each Visitor Permit shall enable the Driver of a Vehicle who is the bona fide visitor of a Qualifying Resident to leave their Vehicle in a Parking Place specified in the relevant Schedule for a maximum period of 24 hours provided that the Visitors Permit is correctly completed and displayed in a conspicuous position on the Vehicle

3.5 The Visitors Permit shall remain the property of Braintree District Council at all times and may be withdrawn by Braintree District Council in accordance with Part 6 Clause 3

4 Form of Permit and Visitors Permit

4.1 A Permit shall be produced by Braintree District Council only and shall contain the following details :-

4.1.1 the registration number of the Vehicle

4.1.2 the expiry date of the Permit

4.1.3 the Zone to which the Permit relates

4.1.4 an authentication that it has been issued by Braintree District Council

such Permit shall not be altered or defaced by the Qualifying Resident or any other person

4.2 A Visitors Permit shall be produced by Braintree District Council only and shall make provision for the following details:-

4.2.1 the registration number of the Vehicle

4.2.2 the date and time at which the Vehicle was left in the Parking Place

such details shall be entered on the Visitors Permit by the Qualifying Resident or the Driver of the Vehicle provided however that it shall be the responsibility of the Driver to ensure that the details are correct and that the Visitors Permit shall not be valid without such details

4.2.3 an authentication that it has been issued by Braintree District Council

5 Application for Issue of Duplicate Permit or Visitors Permit

5.1.1 If a Permit or a Visitors Permit is mutilated or accidentally defaced or the particulars therein have become faded or altered the Permit Holder shall apply to Braintree District Council for a duplicate such application to be made on the current standard form issued by and obtainable from Braintree District Council

5.1.2 On making such application the Permit Holder will be required to surrender the original Permit or Visitors Permit to Braintree District Council and until such time as the same shall be surrendered no duplicate shall be issued

5.2.1 If a Permit is lost or destroyed the Permit Holder shall apply to Braintree District Council for a duplicate such application to be made on the current standard form issued by and obtainable from Braintree District Council

5.2.2 On making such application the Permit Holder shall pay to Braintree District Council the Permit Fee in Clause 8.3 and Braintree District Council shall be satisfied of the circumstances referred to in the application before the duplicate is issued

6 Display of Permits and Visitors Permits

6.1 The Driver of a Vehicle shall display a valid Permit or Visitors Permit in the Relevant Position on the Vehicle at all times when the Vehicle is left in a Parking Place and if the Driver shall fail to so display a valid Permit or Visitors Permit he shall be liable to receive a Notice in accordance with Part 3 Clause 1

6.2 A Driver shall not display more than one Permit or Visitors Permit at any one time

6.3 A Visitors Permit may not be transferred from one Vehicle to another Vehicle within a period of 24 hours

7 Manner of Standing

7.1 A Vehicle left in a Parking Place shall be positioned with every part of the Vehicle within the Parking Place and in accordance with the signs and surface markings and every Driver shall use his best endeavors not to obstruct any gates or driveways belonging to any property adjacent to a Parking Place

7.2 If a Vehicle is left in a Parking Place in a position other than in accordance with the provision of Clause 7.1 a person authorised by Braintree District Council or Essex County Council may alter or cause to be altered the position of the Vehicle so that its position is in accordance with the said provisions

7.3 If a Vehicle is left in a Parking Place in contravention of any of the foregoing provisions of this Order a person authorised by Essex County Council or Braintree District Council may remove the Vehicle from the Parking Place or arrange for such removal

7.4 For the purpose of meeting the requirements of an emergency a person authorised by Braintree District Council or Essex County Council or a police constable in uniform may alter or cause to be altered the position of a Vehicle in a Parking Place or remove or arrange for the removal of a Vehicle from a Parking Place

7.5 Any person altering or causing the alteration of the position of a Vehicle under Clause 7.2 or removing or causing the removal of a Vehicle under Clause 7.3 or 7.4 may do so by towing or driving the Vehicle or in such other manner as are reasonably necessary to enable the position of the Vehicle to be altered or for the Vehicle to be removed

7.6 Any person removing or arranging for the removal of a Vehicle under Clause 7.3 or 7.4 shall make such arrangements as are reasonably necessary for the safety of the Vehicle in the place to which it is removed and shall use all reasonable means to notify the Owner of the place to which it has been removed

8 Permit Fee

The Permit Fee shall be as follows :-

8.1 Permit first Permit £ 30.00 second Permit issued to the same £ 30.00 postal address as the first Permit third Permit issued to the same postal £ 50.00 address as the first and second Permits fourth permit issued to the same £100.00 address as the first, second and third Permits 8.2 Visitors Permit Multiple of 10 @ £0.30 £ 3.00 8.3 Duplicate Permit £ 2.00

8.4 Notwithstanding the provisions of Clauses 8.1 and 8.3 if Braintree District Council is satisfied that the Qualifying Resident is a person who qualifies for its Concessionary Travel Scheme or holds a Disabled Persons Badge then no fee shall be payable for a Permit

9 Zones

9.1 A Permit Holder who has a valid Permit or Visitors Permit for Zone 1 shall only be eligible to leave his Vehicle in a Parking Place in Zone 1

9.2 A Permit Holder who has a valid Permit or Visitors Permit for Zone 2 shall only be eligible to leave his Vehicle in a Parking Place in Zone 2

9.3 A Permit Holder who has a valid Permit or Visitors Permit for Zone 3 shall only be eligible to leave his Vehicle in a Parking Place in Zone 3

9.4 A Permit Holder who has a valid Permit or Visitor Permit for Zone 5 shall only be eligible to leave his Vehicle in a Parking Place in Zone 5

9.5 A Permit Holder who has a valid Permit or Visitor Permit for Zone 6 shall only be eligible to leave his Vehicle in a Parking Place in Zone 6

9.6 A Permit Holder failing to comply with Clause 9.1 to 9.5 shall be liable to receive a Notice in accordance with Part 3 Clause 1

PART 3

Penalty Charge Notices

1. Issuing Notices

1.1 If a vehicle is left in a Parking Place:-

1.1.1 without having displayed in the Relevant Position on the vehicle a valid Permit or Visitors Permit in accordance with Part 2 Clause 6

1.1.2 displaying a Permit or Visitors Permit the validity of which has expired

1.1.3 in contravention of any other provision of this Order

then the Penalty Charge shall be payable by the Driver of the vehicle within 14 working days of a Notice being attached to the vehicle in accordance with Clause 1.2 provided that if payment of the Reduced Charge is made within 7 working days of the Notice being attached as aforesaid Braintree District Council will accept the Reduced Charge in lieu of the Penalty Charge

1.2 It shall be the duty of a Parking Attendant or such other person as may be authorised by Braintree District Council to attach to a vehicle left in a Parking Place to which Clause 1.1 applies a Notice in a conspicuous position which shall include the following particulars:-

1.2.1 the registration number of the vehicle and the number of the trade plate where the vehicle is being used under a trade licence;

1.2.2 the date and time at which it was first observed that the Driver had failed to comply with Part 2 Clause 6 or had displayed a Permit or Visitors Permit the validity of which had expired;

1.2.3 a statement of the nature of the alleged contravention;

1.2.4 a statement that the Penalty Charge is required to be paid within 14 working days or the Reduced Charge may be paid within 7 working days;

1.2.5 the time and manner in which the Penalty Charge should be paid; and

1.2.6 a statement that is an offence under Section 47 of the Act for the Driver of a vehicle who has left the vehicle in a Parking Place to fail to pay the Penalty Charge or the Reduced Charge

2. Method of payment of the Penalty Charge or the Reduced Charge

2.1 The Penalty Charge shall be paid to Braintree District Council at any of the following offices :-

Causeway House, Bocking End, Braintree, Essex CM7 9HB Halstead Area Office, Trinity Street, Halstead, Essex CO9 1JF Witham Area Office, 1 Freebournes Court, Newland Street, Witham, Essex CM8 2FE

or by post to arrive at Braintree District Council by not later than 16.00 hours on the fourteenth working day following the day on which the Penalty Charge was incurred subject to the provisions of Clause 2.2

2.2 the Reduced Charge may be paid in lieu of the Penalty Charge in accordance with Clause 2.1 save that references in Clause 2.1 to the fourteenth day shall be read as the seventh day

4. Restriction of Removal of Notices

When a Notice has been attached to a vehicle in accordance with this Order no person other than the Driver or a person authorised by the Driver shall remove the Notice from the vehicle

PART 4

Exceptions

1 Notwithstanding the provisions of this Order any motor vehicle of any description may wait at any time in any Parking Place (other than a Parking Place the use of which has been suspended under Part 5) for so long as may be reasonably necessary if:-

1.1 the vehicle is waiting to enable a person to board or alight from the vehicle;

1.2 the vehicle is waiting to enable Goods to be loaded or unloaded from the vehicle;

1.3 the vehicle is waiting owing to the Driver being prevented from proceeding by circumstances beyond his control or in order to avoid an accident;

1.4 the vehicle is being used by an emergency service a local authority or in connection with providing medical attention to any person in the neighboring area

1.5 the vehicle is recovery vehicle and is waiting to enable it to be used in connection with the removal of a traffic obstruction or a vehicle which has broken down

1.6 the vehicle is in the service of or employed by a postal or parcel delivery business and is being used in conjunction with the delivery of Goods

1.7 the vehicle is in actual use as a removal vehicle in connection with the removal or delivery of furniture to or from an office or dwelling house in the neighboring area

1.8 the vehicle is being used for any of the purposes referred to in Part 5 Clause 1.3 and cannot conveniently be used for that purpose in any other neighboring road

PART 5

Power to Suspend Parking Place

1. Any person authorised by Braintree District Council or a Parking Attendant may suspend the use of a Parking Place or a section thereof if the suspension is considered reasonably necessary for:-

1.1 the purpose of facilitating the movement of traffic or in the interest of safety

1.2 the convenience of a removal vehicle actually used in connection with the removal or delivery of furniture to or from an office or dwelling house in the neighboring area

1.3 the purpose of any building operation demolition or excavation in or adjacent to the Parking Place or the laying erection alteration removal or repair in or adjacent to the Parking Place of any sewer service conductor or apparatus

1.4 the convenience of occupiers of premises adjacent to the Parking Place at times of weddings funerals or other special occasions

1.5 any special attraction or event 1.6 facilitating the cleaning of the Parking Place

2 A Police Constable in uniform may suspend the use of a Parking Place if he considers it so reasonably necessary to do so for a period not exceeding 24 hours

3 Any person may apply to Braintree District Council to have the use of a Parking Place or a section thereof suspended for any reason contained with Clauses 1.2 to 1.6 inclusive such application to be made on the current standard form issued by and obtainable from Braintree District Council

4 Any person suspending the use of a Parking Place in accordance with Clause 1 or 2 shall place or cause to be placed at the suspended part of the Parking Place a sign indicating that waiting by vehicles is prohibited

5 No person shall cause or permit any vehicle to be left in any area of a Parking Place the use of which has been suspended by Clause 1 or 2 and if a vehicle is so left the Driver shall be liable to receive a Notice in accordance with Part 3 Clause 1 provided however that nothing in this Order shall render it unlawful for an emergency vehicle or a vehicle being used for any purpose specified in Part 4 Clauses 1.3 to 1.5 inclusive to wait in an area of a Parking Place the use of which has been suspended

PART 6

Surrender Withdrawal and Validity of Permits and Visitors Permits

1 A Permit shall cease to be valid at midnight on the expiry date stated thereon or on the occurrence of any provision of Clause 2 to 4 of this part inclusive whichever is the earlier

2 A Permit Holder may surrender his Permit or Visitors Permit at any time and shall surrender his Permit or Visitors Permit if:-

2.1 the Permit Holder ceases to be a Qualifying Resident

2.2 the Permit Holder ceases to be the Owner of the Vehicle in respect of which the Permit was issued

and on surrender under Clause 2.1 or 2.2 Braintree District Council shall refund a relevant proportion of the Permit Fee

2.3 the Vehicle has been adapted to such extent that it ceases to fall within the definition in Part 1 Clause 2.16

2.4 the Permit or Visitors Permit is withdrawn by Braintree District Council in accordance with Clause 3

2.5 a duplicate Permit or Visitors Permit has been issued under Part 2 Clause 5

and on surrender under Clauses 2.3 to 2.5 inclusive Braintree District Council shall not be obliged to refund the Permit Fee or any part thereof

3 Braintree District Council may withdraw a Permit or a Visitors Permit at any time by written notice to the Permit Holders address or by notice attached to the Vehicle such written notice having immediate effect if at any time:- 3.1 the Permit Holder ceases to be Qualifying Resident

3.2 the Permit Holder ceases to be the Owner of the Vehicle in respect of which the Permit was issued

3.3 the Vehicle has been adapted to such extent that it ceases to fall within the definition in Part 1 Clause 2.16

3.4 the Permit Holder fails to satisfy Braintree District Council that he remains eligible for a Permit or a Visitors Permit

3.5 In relation to a Visitors Permit the Qualifying Resident has allowed a person who is not a bona fide visitor to use the same

3.6 the provisions of this Order are revoked

and on such withdrawal Braintree District Council shall not be obliged to refund the Permit Fee or any part thereof

4 If a Permit or a Visitors Permit is issued by Braintree District Council on receipt of a cheque and that cheque is subsequently dishonored the Permit or Visitors Permit shall cease to be valid and the Permit Holder shall be required to surrender the same to Braintree District Council within 48 hours of the receipt of written notice from Braintree District Council

5. A Visitors Permit shall not be valid if the details referred to in Part 2 Clause 4.2.1 and 4.2.2 are not correctly and accurately completed

PART 7

Other provisions

1 The Driver of a Vehicle shall not permit that Vehicle to wait in a Parking Place unless the Vehicle is licensed in pursuance of the provisions of the Vehicle Excise and Registration Act 1994 and unless there is in relation to the use of the Vehicle by the Driver such a policy of insurance as complies with the requirements of Part VI of the Road Traffic Act 1988

2 A Driver using a Parking Place shall stop the engine of the Vehicle as soon as the Vehicle is in position in the Parking Place and shall not start the engine except when about to change the position of the Vehicle in or to depart from the Parking Place

2.1 No person shall use a Vehicle in a Parking Place in connection with the sale of any article to persons in or near the Parking Place or in connection with the selling or offering for hire of his skill or services without the prior consent of Braintree District Council’s Car Parks Manager

2.2 No person shall use any part of a Parking Place or any Vehicle left in a Parking Place:-

2.2.1 for sleeping, camping or cooking without the prior consent of Braintree District Council’s Car Parks Manager

2.2.2 for the purpose of servicing any Vehicle or any part thereof other than is reasonably necessary to enable that Vehicle to depart from the Parking Place 3 No person shall drive or permit to be driven any Vehicle in a Parking Place for any purpose other than the purpose of leaving that Vehicle in the Parking Place in accordance with the provision of this Order or for the purpose of departing from the Parking Place

4 A Qualifying Resident may be required by Braintree District Council at any time to produce such evidence as may be reasonably required to verify any particulars or information given to Braintree District Council in order to ascertain that the Permit or Visitors Permit is valid

PART VII

CONTRAVENTION OF ORDER

19. If a vehicle is left in contravention of any provisions of this Order, a penalty charge shall become payable in respect of each day or part thereof that the vehicle is left and in the case of a vehicle in respect of which a penalty charge has been incurred, the parking attendant shall attach to the vehicle in a conspicuous position a penalty charge notice which shall indicate the following particulars:-

(1) The date and time of the alleged offence.

(2) The vehicle registration number.

(3) The make and colour of the vehicle.

(4) The location of the vehicle.

(5) Details of the alleged offence.

(6) Details of the penalty payable.

(7) Instructions on how and where to pay.

(8) Instructions on how and when an enquiry and/or a formal representation against the issue of the penalty may be made.

(9) The reference number of the penalty charge notice.

20. Where a penalty charge notice has been attached to a vehicle in accordance with the provisions of Article 51 of this Order, no person shall remove the notice from the vehicle other than the driver of the vehicle or a person duly authorised to do so by the driver.

21. The penalty charge shall be paid to Braintree District Council in accordance with the instructions contained on the penalty charge notice

PART VIII

REVOCATIONS AND ORDERS TO BE MADE

22. The provisions of the Orders specified in Schedule 1 to this Order are hereby revoked

23. The provisions specified in Schedule 2 to this Order are hereby made.

24. The map tiles referred to in Schedule 3 to this Order display the current restrictions on the date of operation of this Order.
