MAHONING TOWNSHIP BOARD OF SUPERVISORS MEETING MINUTES October 25, 2017

CALL TO ORDER: Franklin Ruch called the meeting to order at 6:00 PM at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

PLEDGE OF ALLEGIANCE: Franklin Ruch led the Pledge of Allegiance

PRESENT: Franklin Ruch, Chairman; John Wieczorek, Vice Chairman; Bruce Steigerwalt, Supervisor; Robert Slaw, Supervisor; Patricia Snyder, Supervisor; Thomas Nanovic, Solicitor and Natalie D. Haggerty, Secretary-Treasurer

PUBLIC COMMENT: Jay Barthel was present to be sworn in as a fire police member

APPROVAL OF MINUTES: John Wieczorek made a motion to approve the Minutes of the October 11, 2017 Board of Supervisors Meeting. Seconded by Patricia Snyder. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Robert Slaw, yes and Patricia Snyder yes 5-0 vote. Motion carried.

NEW BUSINESS: KIA: Discussion took place regarding the clarification on one last issue related to site work which is fencing along the back. There is some confusion regarding the original land development plan “heavy requirement” for screening. This went before the Zoning Hearing Board and relief was eventually granted and a land screening “light plan” became valid. The fencing in the northeast corner is the area with the requirement of four-foot solid high fence of PVC or wood.

Carbon Dack: KFC project is dead. Discussion took place of the still marketed space. Send a proposal to Mr. Jaffee that until he can determine the type of use, specific on size and square footage as well as number of seats we will not be able to provide a number related to parking spaces.

Salerno Subdivision Request an Extension of Time until December 31, 2017 MOTION Bruce Steigerwalt made a motion to grant the Salerno Subdivision a time extension until December 31, 2017. Seconded by John Wieczorek. Franklin Ruch, yes; John Wieczorek, yes, Bruce Steigerwalt, yes; Robert Slaw, yes and Patricia Snyder, yes 5-0 vote. Motion carried.

Springdale Estates Came before the Planning Commission wanting to change use and build it out. They will need to come before the Board of Supervisors and tell us exactly what they want to do.

Neal Easement Agreement MOTION Bruce Steigerwalt made a motion to approve Neal Easement Agreement. Seconded by Robert

Civil War Plaque MOTION Franklin Ruch made a motion to send a letter to Lehighton Area School District advising Mahoning Township wants the Civil War Plaque located in the basement of the Mahoning Township Elementary School. Seconded by John Wieczorek. Franklin Ruch, yes; John Wieczorek, yes; Bruce Steigerwalt, yes; Robert Slaw, yes and Patricia Snyder, yes 5-0 vote. Motion carried.

Motion to pay Bruce George Paving & Excavating for 2017 Paving Projects MOTION Bruce Steigerwalt made a motion to pay Bruce George Paving & Excavating for completed 2017 paving projects. Seconded by Franklin Ruch. Franklin Ruch, yes; John Wieczorek, yes; Bruce Steigerwalt, yes; Robert Slaw, yes and Patricia Snyder, yes 5-0 vote. Motion carried.

OLD BUSINESS: Rex Road Bridge Commissioners accepted the bid for the bridge.

Summit Ridge and Sage Meadows MOTION Patricia Snyder made a motion to send a letter saying that he is in default of not completing improvements agreement for Summit Ridge and Sage Meadows. Seconded by Bruce Steigerwalt. Franklin Ruch, yes; John Wieczorek, yes; Bruce Steigerwalt, yes; Robert Slaw and Patricia Snyder, yes 5-0 vote. Motion carried.

COMMITTEE REPORTS: Police Committee: John Wieczorek advised they did not have a meeting. Frank Ruch broke the meeting for a brief executive session announced for personnel at 8:00 PM and returned at 8:07 PM.

ENRAD: Chief Mertz asked that we table the concept of the purchase to see where it is going in the future. He shared information regarding a future purchase of a thermal camera. Currently the police department contacts the fire department to borrow theirs in situations where there are foot races in the woods. ATN provided a cost of $2,428 and has a high-quality rating. The thermal imaging camera is battery operated, weight of three pounds, day or night, identify up to 600 feet away. MOTION Bruce Steigerwalt made a motion to purchase thermal imaging camera at a cost not to exceed $2,428.00. Seconded by Franklin Ruch. Franklin Ruch, yes; John Wieczorek, no; Bruce Steigerwalt, yes; Robert Slaw, yes and Patricia Snyder, yes 4-1 vote. Motion carried.

Officer in Charge (Nov 30- Dec 31) MOTION John Wieczorek made a motion to appoint Officer James Danner to Officer in Charge from November 30, 2017 to December 31, 2017. Seconded by Patricia Snyder. Franklin Ruch, no; John Wieczorek, yes; Bruce Steigerwalt, no; Robert Slaw, yes and Patricia Snyder, yes 3-2 vote. Motion carried.

Chief Contract Expires December 31, 2017 Will be discussed in executive session for personnel.

Nevin Frey: Information from Brent Green and plate for zipper are all wrong. Not a municipal plate.

OFFICIALS: Franklin Ruch: Received and provided to the township check for items sold at the COG sale.

Patricia Snyder: New England Motor Freight has a light that is shining on the highway, the light should stay in their lot.

Robert Slaw: Thirty blocks purchase for an area in the Packerton dip.

Carl Faust: Hearing on Monday for skate board park.

Franklin Ruch: There will be an executive session at conclusion of meeting for personnel and legal.

ADJOURNMENT: MOTION Bruce Steigerwalt made a motion to adjourn the meeting at 8:45 PM. Seconded by Robert Slaw. Franklin Ruch, yes; John Wieczorek, yes; Bruce Steigerwalt, yes; Robert Slaw, yes and Patricia Snyder, yes 5-0 vote. Motion carried.
