ORDER EXTENDING STATUTORY DEADLINE

Summary This decision extends the statutory deadline in this proceeding to May 5, 2018.

1. Background Based on the filing date of this Application, the version of Pub. Util. Code § 1701.5(a)1 then in effect, provided that ratesetting cases shall be resolved within 18 months of the date the scoping memo is issued, unless the Commission establishes an alternative timeline in the Scoping Memo or issues an order extending that deadline. As explained below, the statutory deadline for completion of this proceeding has been modified several times due to requests of parties. The completion date has also been affected by a necessity to clarify the evidentiary record. On February 28, 2014, Pacific Gas & Electric Company (PG&E) filed Application 14-02-008, its Application of Pacific Gas and Electric Company for Compliance Review of Utility Owned Generation Operations, Electric Energy Resource Recovery Account Entries, Contract Administration, Economic Dispatch of Electric Resources, Utility

Retained Generation Fuel Procurement, and Other Activities for the Period January 1 through December 31, 2013 (Application). The original Scoping Memo and Ruling of the then-assigned Commissioner issued on June 4, 2014, implying a statutory deadline of approximately December 4, 2015. Following service of testimony, evidentiary hearings were held on September 8, 2014, and briefs and reply briefs were filed on October 3, 2014 and October 17, 2014, respectively. Prior to the expiration of the December 2015 statutory deadline, PG&E and the Office of Ratepayer Advocates filed a joint motion on November 2, 2015 seeking to remove a contested issue from the proceeding. In response, an amended scoping memo was issued on November 24, 2015, removing that issue and extending the statutory deadline for completion of this proceeding to March 1, 2016. On February 25, 2016, Decision 16-02-025 was issued extending the statutory deadline for completion of this proceeding to April 30, 2016, in order to provide the Commission time to consider and issue a final decision. Prior to the expiration of the April 30, 2016 statutory deadline, PG&E filed a motion on April 6, 2016 seeking to set aside submission and to reopen the record of this proceeding. PG&E sought leave to submit a revised Root Cause Evaluation (RCE) of an unplanned outage that occurred in 2013 at Unit 2 of the Diablo Canyon Power Plant. PG&E’s management of that outage is an issue in this proceeding. In response, a second amended scoping memo was issued on May 6, 2016 and a new schedule was established for submittal of the revised RCE, followed by testimony, hearings and additional briefing. The statutory deadline for completion of this proceeding was once again extended to November 5, 2017. Finally, an additional prehearing conference was held on October 26, 2016, where the assigned ALJ informed parties of a factual discrepancy in the record that required clarification by PG&E. PG&E submitted additional information and that information, as well as the revised RCE regarding the 2013 outage at Unit 2 of the Diablo Canyon Power Plant, were both the subject of one day of evidentiary hearings

- 2 - A.14-02-008 ALJ/SCR/mln/ek4 PROPOSED DECISION conducted on August 17, 2017. At that time, this proceeding was again submitted for a decision by the Commission. The proposed decision is expected to be issued in early November, 2017. In order to provide the parties time to comment on the proposed decision and the Commission time to consider and issue a final decision, an extension of time beyond the current statutory deadline of November 5, 2017 is necessary. Therefore, the statutory deadline of this proceeding is extended until May 5, 2018.

2. Waiver of Comment Period Under Rule 14.6(c)(4) of the Commission’s Rules of Practice and Procedure, the Commission may reduce or waive the period for public review and comment of proposed decisions extending the deadline for resolving ratesetting proceedings. Accordingly, the otherwise applicable period for public review and comment is being waived.

3. Assignment of Proceeding Martha Guzman Aceves is the assigned Commissioner and Stephen C. Roscow is the assigned Administrative Law Judge in this proceeding.

Findings of Fact 1. The statutory deadline for resolving this ratesetting proceeding is November 5, 2017. 2. A proposed decision is expected to be issued early November 2017.

3. An extension of the statutory deadline is necessary to provide sufficient time for review and to issue a final decision.

Conclusion of Law Pursuant to the authority granted to the Commission under Pub. Util. Code § 1701.5(a), the statutory deadline should be extended to May 5, 2018.
