Dear Employee:

This is official notification that unless there is an enacted 2017-2019 operating budget or capital budget, beginning July 1, 2017, employees will be furloughed under the temporary layoff rules. The furlough will begin at the start of each employee’s first work shift which begins on or after July 1, 2017. The duration of this furlough is unknown. You may not perform any work during the furlough, and will not receive pay for any workday for which you are furloughed.

Basis  The basis of this furlough is lack of funds. Your agency does not have the authority to pay you unless the state has an enacted 2017-2019 operating budget or capital budget beginning July 1, 2017 to fund your position.

Return from Temporary Layoff  Once the state has an enacted 2017-2019 budget that funds your position, you will return to work at your next scheduled work shift.  The state has set up a website and toll free number to let all employees know when furloughed state employees should return to work.

Callback During Temporary Layoff  There is a possibility you will be called back to work during the temporary layoff. If this occurs, you will be compensated under the provisions of WAC 357-28-185. You will be returned to temporary layoff status upon completion of the work you were called back to perform.

Scheduled Paid Leave  Taking any form of paid leave during a furlough is not permitted.  If you are scheduled to be on any form of approved paid leave during the furlough, your leave approval is rescinded.

Overtime-Exempt Employees  If you return to work from the furlough after the start of your workweek, you are eligible for overtime if you work over 40 hours in the workweek and the following applies: o You must not work more than your scheduled work hours during that workweek without prior approval of your supervisor. o You must complete a time and attendance form for the workweek. o It is important to remember that activities related to work assignments are considered “work” and must not be done outside of your scheduled work hours during the workweek. Such activities include, but are not limited to: . Reading or sending e-mails. . Listening to or sending voice mails. . Reading or sending text messages.

Layoff Rights  In accordance with WAC 357-46-067 & WAC 357-58-554, you do not have layoff rights for a furlough and therefore will not: o Be paid any leave balance. o Bump any other position. o Be placed on the internal or statewide layoff lists.

Effect of temporary layoff  Employees’ seniority, anniversary and unbroken service dates will not be adjusted for the period of time spent furloughed.  If an employee is serving a probationary period or trial service period, it will not be extended for the period of time spent furloughed.  Time spent furloughed will not be considered time in pay status for the purpose of holiday compensation.  Time spent furloughed will not be considered time in pay status for the purpose of vacation and sick leave accruals.

Health Care Benefits and Unemployment Your PEBB benefits (medical, dental, life and long-term disability) will continue during July as long as you are in pay status for at least eight hours before the end of the month. If the furlough extends beyond one week, you may be eligible for unemployment compensation.
