Letter of Continued Guarantee Food Contact Packaging Materials

The undersigned hereby agree to the following provisions of this Agreement, for all Food Contact Packaging Materials provided, or caused to be provided, to McCain Foods Ltd.

General Requirements: All deliveries must conform to the applicable provisions of the Canadian Food and Drug Act, and the United States Federal Food, Drug, and Cosmetic Act, and must not be adulterated, misbranded, or unsafe, within the meaning of these acts. Materials and workmanship shall meet agreed upon specifications, be of good quality, and the products must be prepared and packaged in accordance with good manufacturing practice guidelines under strictly sanitary conditions.

Hazardous Material: All food contact packaging materials must be free of defects that may compromise food safety, and free of all biological, chemical, or physical hazards that are not naturally occurring in the product. This hazardous material includes but is not limited to pieces of metal, wood, plastic, glass, or chemical residues.

Suitability Packaging to be used in direct contact with all food types, which will be packaged under fresh, chilled/frozen conditions and the packaged foods will be kept frozen. Based on the information received from McCain, we confirm the suitability of the supplied packaging for the intended end-uses.
