Section VIII. Special Conditions of Contract

Section VIII. Special Conditions of Contract for Supply of goods Contracts The following Special Conditions of Contract (SCC) shall supplement and / or amend the General Conditions of Contract (GCC). Whenever there is a conflict, the provisions herein shall prevail over those in the GCC.

GCC 1.1 (o) The Project Site(s)/Final Destination(s) is/are: By air on DDP to VD warehouses specified by the beneficiary and abided by supplier. Unless inconsistent with any provision of the contract, the meaning of the Trade GCC 4.2(a) terms, the rights and obligations there under shall be as prescribed by Incoterms. GCC 4.2(b) The last version edition of Incoterms shall be [Incoterms 2010] The language shall be: Arabic & English. The expressions and conditions in GCC 5.1 Arabic form are depended in case of dispute.

The contract shall be subject to the Iraqi law, and the purchaser is entitled to apply GCC 9.1 the Act of collecting the governmental debts No. (56) in 1977 or any other superseding law to obtain his rights outstanding upon supplier.

In case of dispute arises between the purchaser & the supplier, and amicably GCC 10.1 solution far to be effected then the competent Iraqi courts at Baghdad will be the field pursuant to purchaser's country regulations.

Details of shipping and other Documents to be furnished by supplier are:- First:- Presentation of the shipping documents listed below if the delivery by air on DDP to VD warehouses: 1- A commercial invoice in original giving in details the goods origin, unit price and the total value of the goods authenticated by Iraqi Commercial Attaché or Embassy in the country of producer or exporter in case of not existing Commercial Attaché & three copies. 2- A certificate of goods origin in original authenticated by Iraqi Commercial Attaché or Embassy in Country of Origin, in case of not existing this Attaché GCC 13.1 & three copies. 3- Insurance policy or document against all risks including the excluded risks issued by accredited Insurance Company and not a broker. 4- A full set of clean and negotiable bills of lading issued to the order of Ministry of Agriculture (MOA) / State2 Company for Agricultural Supplies (SCAS). The bills should be marked "freight charges prepaid". 5- Vaccine Inspection Certificate issued by referential or regional reference Lab. approved by (OIE) for vaccine effectiveness (Immunity strength) shows the
