1 - Conditions relating to applicant eligibility: The Applicant states that: a) He/she has resided in New Brunswick for at least 12 months prior to application and pays income taxes to the province of NB; b) If it is a private company in New Brunswick, i. it is incorporated federally or in New Brunswick; ii. its head office and principal place of business are in New Brunswick and; iii. a majority of the voting shares are beneficially owned by New Brunswick residents. c) If it is a partnership or a sole proprietorship in New Brunswick, i. it is registered in New Brunswick; ii. its head office and principal place of business are in New Brunswick and; iii. a majority of those exercising voting control are New Brunswick residents.

2 - Warranties and Agreements: The Applicant states that: a) He/she is not in default with the Department (final reports have been filed and all of the required information was provided); b) He/she is not in default of payment to a third party; c) He/she is not eligible for financial assistance programs in other provinces; d) He/she has carefully read the eligibility requirements relating to the component for which funding is being requested as defined in the Program’s Guidelines; e) He/she certifies that the information given in this application for funding assistance is, to his/her knowledge, true, accurate and complete in every respect; f) He/she agrees to provide all requested information as well as any other supporting documents needed to evaluate this application and; g) He/she understands that the application may be disqualified if it is incomplete, or if the activity or parts of the activity are started or completed before application is received, as projects will not be funded retroactively; h) He/she recognizes that applications are approved subject to availability of funds and beyond the provision of a grant, the Province of New Brunswick has no further commitment to the applicant. The Province will not be held responsible for the completion of an activity; i) He/she understands that the funds must be used as specified in the application and for the approved activity, and that the applicant will reimburse the funds to the Province in the case of a cancelled activity; j) Will accept the Department’s final interpretation of the guidelines.

Revised: January 2018 Page 9 of 11 3 - Conditions relating to the application: The applicant: a) Agrees to save harmless the Department from any expenses, professional fees, loss, or damage arising directly or indirectly from any claim, action, or cause of action resulting from the present application; b) Agrees to acknowledge the financial contribution of the Government of New Brunswick in all publicity related to the proposed activity c) Agrees to acknowledge the financial participation of the Province of New Brunswick in all publicity related to the activities of the proposed project. Most current provincial logos can be downloaded HERE; d) Hereby acknowledges and agrees that, if awarded a grant, the name of the grant recipient, the recipient’s community, the program name, and the amount of the grant, will be published by the Department Tourism, Heritage and Culture on its website and in the Department’s Annual Report e) Confirms that he/she will complete the project by March 31st of the fiscal year in which funding was received, and that a final report will be submitted to the Department after the activity is completed; f) Confirms that he/she has sufficient funds to complete the project as outlined in the budget within a 10% shortage and agrees that any portion of the grant (over $50) not spent will be returned to the Province of New Brunswick in the form of a cheque made out to the “Minister of Finance”.
