WAPAKONETA CITY COUNCIL OCTOBER 19, 2015

President Steve Henderson called the meeting to order at 7:30pm on October 19, 2015 at 701 Parlette Court with the following members present: Jim Neumeier, Daniel E. Lee, Chad Doll, Randy Fisher, Rachel Barber and Dan Graf. Also present were Mayor Rodney Metz and Law Director Dennis Faller. There were 4 visitors present. Service Director Bill Rains and Bonnie Wurst were absent.

Mr. Neumeier asked for the following correction to be made to the October 5, 2015 Council Meeting minutes: under New Business, paragraph should read “Ms. Barber asked why the term ‘revolving’ must be eliminated. Mrs. Wurst replied that this is being done to avoid confusion with the state program.” Motion by Fisher, second by Doll to approve the minutes of the October 5, 2015 Council Meeting as corrected. Vote – 6 yeas, 0 nays.

Streets & Alleys Committee – a meeting was held on 10-13-2015 and the following was discussed: 1. Approved minutes of July 15, 2015 on a motion by Neumeier, second by Fisher, passed 3-0 2. Reviewed a request by Dave Katterheinrich to acquire land from the city’s unimproved right-of- way of Logan Street along the east side of his property at 301 Jefferson to give him a wider side yard. The property currently approximately a 2’ setback. Code calls for 5’ setback. Committee discussed the appropriateness of the request and examined aerial photos and engineer’s drawing. The committee was in favor of reducing the 60’ right-of-way to 50’and giving the two adjoining properties an additional 5’each (Fisher/Neumeier, 3-0). Prior to recommending this action to Council, the committee request that engineering prepare a drawing of the proposal and that adjoining property owners be contacted in regards to this proposal. The committee will make a final recommendation after the drawing is reviewed and comments are received. 3. Mr. Simpson informed the committee that the weeds in the East Auglaize tree lawn were sprayed approximately two weeks ago. 4. Mary Ruck gave the following reports: a. The ODOT Gateway Beautification Program has not been funded. However the city could apply for a permit to do landscaping on the ramps areas of the I-75 intersections. The committee may look at developing a design proposal in the future. b. Phase 4 of the SRTS project will be done in 2017. Plans for the sidewalk were reviewed by the committee. Phase 4 involves placement of walk on the north side of Carnation from Laurel to Stoneybrook. Plans indicated that one mailbox would be in the path of the sidewalk. Committee requested that appropriate space be allowed for future post replacement. Mrs. Ruck also told the committee that she was working with ODOT to resolve the peculiar layout of some of the walk previously installed. c. Letters will be sent out to affected property owners this fall for the 2015-16 sidewalk inspection and maintenance program. They will be given six month to make noted repairs. d. The paving overlay project for Cherry, Wagner, and Rauthland Streets should be done the first or second week of November. The contract was awarded to Shelly Construction. The last pour of concrete for the storm drain work for this project has been completed. e. Contract for the 2015 Reclamite treatment for sections of Bellefontaine, Harrison, Plum, Woodbine, Redskin, Middle, and Glynwood Streets has been awarded and work to be scheduled yet this fall. Work around the high school will be done in consideration to the school’s schedule. f. The W. Auglaize Street project is on schedule. Trees will be planted in the fall of 2016 per the recommendations of the Tree Commission and Urban Forster, Stephanie Miller. The schedule also took into consideration of the request of Helms Construction. Remaining concrete work should be completed by end of next week. Installation of street lights will begin next week but not operational by date of Trick-or-Treat. Mrs. Ruck has requested that the Lighting Department provide temporary lighting at the intersections during the hours of Trick-or-Treat. g. A public meeting for Transportation Alternative Program (TAP) project in the Heritage/ Belcher Park areas and proposed river walk when more information is available about the grant. A previous public meeting was held on Wednesday, April 22, 6:30 PM in the Council Chambers. Committee adjourned at 4:45 PM on a motion by Neumeier, Second by Fisher, passed 3-0. Footnote: Here is a follow-up from Mary Ruck. ”The Reclamite schedule has changed due the budgeted amount of $30,000.00. To perform all streets exceeded the budgeted amount. The following streets will be performed this year: Redskin Trail (from SR 501 to Water) Woodbine (all), Bellefontaine (from Water to Wagner) and Plum from Buchanan to Logan St. Harrison St. is not ready for treatment due to the construction project. The additional streets will be placed on next year’s program. “

Ms. Barber asked for the specific location noted in item #2. Mr. Graf replied, the unimproved grass right of way in the area where Logan Street dead ends into Jefferson Street.

Ad-hoc Committee – a meeting was held on 10-14-2015 and the following was discussed: The meeting opened with a motion from Councilor Doll and a second from Councilor Graf to accept the minutes of our September 23, 2015 meeting. Motion carried 3-0. The committee next worked on a draft ordinance based on a sample from the City of Worthington that would establish a municipal lodging tax. The committee made a number of changes to the draft including the name of the Tourism Commission, the Commission’s terms and what would be acceptable uses for the funds generated. After a lengthy discussion, Councilor Graf moved that the committee recommend to council that the ordinance be prepared with an effective date of January 1. Councilor Doll seconded the motion and it carried 3-0.

Mr. Fisher provided Council with a copy of the draft ordinance, and asked Council and Law Director Faller to review it prior to any further action.

Guest Petitions - Tom Stinebaugh of 1009 Hickory Circle relayed a citizen complaint regarding new homeowners having to pay a previous homeowners’ delinquent utility bill prior to having the utilities turned on. Mr. Stinebaugh asked that the City review this situation.

Mr. Stinebaugh then asked why the City does not wish to sell services outside of City limits without annexation. Mr. Stinebaugh cited examples of other cities procedures, and asked that the City review this as well.

Unfinished Business – Mr. Neumeier stated that currently, if all phone lines at the City Building are being used, the caller gets a recorded greeting but no option to be put on hold or to leave a message. Mayor Metz replied that he was not aware of this. Mr. Neumeier asked that the City fix the issue. Mr. Neumeier then stated that he received a citizen complaint that a $1000 refund has not yet been issued to them regarding a construction work project. Mr. Neumeier added that upon questioning Auditor Walter about the refunds, she advised there was not enough money appropriated to pay for all the deposit refunds. Mayor Metz agreed to meet with Auditor Walter to investigate the matter. Ms. Barber asked when the hazardous trees on West Auglaize Street will be removed. Mayor Metz advised that he will discuss this at the department head meeting this week.

President Steve Henderson asked Clerk to read Ord 2015-40 for the second time re: AN ORDINANCE TO ACCEPT THE APPLICATION FOR THE ANNEXATION OF 14.663 ACRES, MORE OR LESS, LOCATED IN THE TOWNSHIP OF DUCHOUQUET, AUGLAIZE COUNTY, OHIO TO THE CITY OF WAPAKONETA, OHIO. Mr. Graf asked if Council will have an opportunity to review the proposed subdivision before it is plotted. Mayor Metz replied, yes. Mr. Neumeier asked if there is an issue with Ord 2015-42 being read at the same time as Ord 2015-40. Law Director Faller pointed out that the 3rd readings and vote for said Ordinances are staggered to avoid any such issues. President Steve Henderson asked Clerk to read Ord 2015-41 for the second time re: AN ORDINANCE ENACTING CHAPTER 1038 UNDER TITLE FOUR OF PART TEN OF THE CODIFIED ORDINANCES OF THE CITY OF WAPAKONETA REGARDING CONNECTION TO CITY UTILITIES AND REQUIRING ANNEXATION.

President Steve Henderson asked Clerk to read Ord 2015-42 for the first time re: AN ORDINANCE ESTABLISHING THE ZONING CLASSIFICATION FOR 14.663 ACRES, MORE OR LESS, LOCATED IN DUCHOUQUET TOWNSHIP, AUGLAIZE COUNTY, OHIO, AS ANNEXED TO THE CITY OF WAPAKONETA.

President Steve Henderson asked Clerk to read Ord 2015-43 for the first time re: AN ORDINANCE AUTHORIZING THE DIRECTOR OF SAFETY AND SERVICE TO ENTER INTO A LEASE / PURCHASE AGREEMENT FOR ONE VAC-CON SEWER JET AND ROVVER X CAMERA SYSTEM THRU THE OHIO COOPERATIVE PURCHASING PROGRAM, REPEALING ORD 2015-36 AND DECLARING AN EMERGENCY.

President Steve Henderson asked Clerk to read Ord 2015-44 for the first time re: AN ORDINANCE AMENDING CHAPTER 248 “RESCUE SQUAD SERVICE” OF THE CODIFIED ORDINANCES OF WAPAKONETA, OHIO, REPEALING ORD 2015-26 AND DECLARING AN EMERGENCY. Mr. Neumeier asked what corrections were made to the Ordinance. Mr. Fisher replied that the initial numbers listed were wrong.

President Steve Henderson asked Clerk to read Ord 2015-45 for the first time re: AN ORDINANCE TO AMEND CHAPTER 890 OF THE CODIFIED ORDINANCES OF THE CITY OF WAPAKONETA REGARDING MUNICIPAL INCOME TAX. Mr. Neumeier asked what the specific changes were. Law Director Faller advised that the changes were state mandated. Mr. Neumeier added that there is a larger penalty for being late.

The Mayor gave the following report: 1. Participated in one Department Head meeting. 2. Participated in DWP monthly meeting. We are working on a fundraiser dinner held at J’Maries. DWP newsletter is out. 3. Participated in monthly Tree Commission meeting. Tree removal on Murray Street and tree planting in the downtown were the main topics. 4. Participated in monthly Wapakoneta City Council’s Streets and Alleys meeting. 5. Met with Greg Myers, Don Schnarre and Bill Rains to discuss the electric expansion plan and their development. Don is working with G.E. 6. Attended lodging tax adhoc committee meeting. 7. Participated in the monthly WEADC meeting. 8. Participated in a presentation on local government sponsored by the local Chamber’s value class held in Minister. 9. Attended ribbon cutting for Studio Hair Salon. They are new to Wapakoneta and located at 17 Willipie Street. 10. I drafted a support letter for the replacement recreation levy. Showing both mayoral candidates Tom Stinebaugh and myself signing the support letter together.

The Law Director gave the following report: Ordinance 2015-27 had other elements aside from putting the name ‘Wapakoneta’ on the bridge, and the City may need to provide another Ordinance for those items to the state. Due to the Safety Service Director’s absence, no further information is available at this time.

Miscellaneous Business – Mr. Neumeier thanked all those who have provided support for the upcoming Parks and Recreation levy. Mr. Fisher thanked those who were involved in getting the State Championship signs installed. Motion by Fisher, second by Doll to adjourn at 8:13pm. Vote – 6 yeas, 0 nays.
