Minutes of the Council meeting of the Delhi Medical Council held on 11 th April, 2012 in Conference Room, Delhi Medical Council, New Delhi
A meeting of the Delhi Medical Council was held on 11th April, at 2.00 pm in Conference Room, Delhi Medical Council, New Delhi.
The following were present :-

The following member could not attend the meeting :-

Sharma Member 7. Dr. Vinay Rai Member 1 The meeting was adjourned at 2.00 pm due to lack of quorum. The meeting was reconvened at
2.30 pm.
The Vice-President welcomed the members and chaired the meeting due to un-availability of the President. The President subsequent joined the meeting..
The following agenda was discussed :-
1. Confirmation of the minutes of the last meeting held on 7th February, 2012 Minutes of the last Council meeting held on 7th February, 2012, which were circulated to all the members, were confirmed
2. Action taken report of minutes of the meeting held on 7th February, 2012 Action taken report, which was circulated to all the members, was approved.
3. To discuss about proposal for online registration with Delhi Medical Council.
A presentation regarding online registration was given by representative of Primus I.T. Solutions, A-1/E, 3rd Floor, Sector—16, Noida, Uttar Pradesh and Dr. Pradeep Singh Suri, Director, JAP HEALTHCARE, 198 P Sector-27, Gurgaon, Haryana. The Council directed that a Committee consisting of Dr. K.K. Aggarwal, Dr. Anil Goyal, Dr. Navin Dang and Dr. N.P. Singh should examine this issue in detail. The Committee should work out the requirement/needs of the Council in this regard and thereafter proposals from the concerned agencies may be invited. The Committee shall then revert back to the Council with its recommendations. It was further observed that this exercise be carried out in a reasonable time frame.
4. To discuss about the progress of State Medical Councils meeting scheduled for 18th and 19th February, 2012 The minutes of the State Medical Councils meeting held on 18 th February, 2012 and 19th February, 2012, were circulated to the members. The members were requested to study the same and revert back to the Council with their observations/suggestions, so that the same may be finalized.
5. To discuss about FSC report in relation to Delhi Medical Council Office.
2 The Minutes of the Finance Standing Committee dated 23rd March, 2012 were circulated to all the Council members and briefed by the Vice-President. The minutes of the Finance Standing Committee dated 23rd March, 2012 appended herewith as annexure ‘A, were confirmed.
6. To discuss cases of medical negligence and unethical conduct
1. The Order of the Disciplinary Committee in Complaint No. 751- complaint of Shri Tilak Sikri r/o. 933, New Housing Board Colony, Panipat Tehsil and District Panipat, Haryana, forwarded by Directorate of Health Services, alleging medical negligence on the part of doctors of Sri Balaji Action Medical Institute, in the treatment administered to the complainant at Sri Balaji Action Medical Institute, FC-34, A-4, Paschim Vihar, New Delhi – 110063, came up for confirmation, was confirmed.
2. The Order of the Disciplinary Committee in Complaint No. 758 - complaint of Dr. Rekha Gupta r/o. C-6/281, Yamuna Vihar, Delhi – 110053, alleging medical negligence on the part of Dr. Rakesh Gupta and Dr. Diwakar Jha, in the treatment administered to complainant’s father late Naranjan Lal Gupta at Saroj Hospital and Heart Institute, resulting in his death on 5.5.2010, came up for confirmation. The Order of the Disciplinary Committee was confirmed by the Council thorough majority decision. Dr. N.P. Singh and Dr. B. Gupta registered their dissent, as they were of the view that the opinion of expert in forensic medicine should also have been obtained for adjudicating this matter.
3. The Order of the Disciplinary Committee in Complaint No. 773 - complaint of Shri Jai Kishan r/o. H. No. 872, G.No. 21A, Sawtantar Nagar, Narela, Delhi – 110040, alleging medical negligence on the part of doctors of St. Stephen’s Hospital, in the treatment administered to complainant’s son late Sandeep Kumar at St. Stephen’s Hospital (I.P. No. 1177281/1), resulting in his death on 2.7.2010, came up for confirmation.
Whilst confirming the decision of the Disciplinary Committee, the Council observed that the following observations made in the Order of the Disciplinary Committee be expunged, as in the facts and circumstances of this case, the same were unwarranted.
3 “There appears to be a lack of awareness regarding this extremely rare entity and subsequent management. Halothane could have been avoided”.
“But unfortunately Dantrolene which is the drug of choice and most effective therapy, is not available in India”.
“The Disciplinary Committee, however, advises Dr. Farhat consultant Anesthesiologist to keep her knowledge updated in the subject of Anesthesiology”.
The Order of the Disciplinary Committee stands modified to this extent and the modified Order is confirmed.
4. The Order of the Disciplinary Committee in Complaint No. 784- complaint of Shri K.C. Singla, House No.64, Shivalik Enclave, NAC, Manimajra, Chandigarh, alleging medical negligence on the part of Dr. S.K.S. Marya, in the treatment administered to complainant’s wife Smt. Kamal Kanta Singla at Max Healthcare Hospital, Saket, New Delhi, came up for confirmation, was confirmed.
7. To discuss report of Anti quackery Committee Minutes of the Anti Quackery Committee meeting held on 14th March, 2012, which were circulated to the members, were confirmed. The same are appended herewith as annexure ‘B’
8. Any other item with permission of Chair 1. Dr. Anil Bansal, Chairman, Anti-Quackery Committee, Delhi Medical Council stated that a complaint pertaining to one Shri Jatin Chaudhary who claims, himself to be a physiotherapist but practices all sorts of medicines, is under consideration of Anti- Quackery Committee of Delhi Medical Council. On enquiry, it has come to notice that Shri Jatin Chaudhary is not registered with Delhi Council for Physiotherapy & Occupational Therapy, and in his reply to show cause notices of Delhi Medical Council, Shri Jatin Chaudhary avers to be not practicing in allopathic system of medicine.
The Council directed, in view of the facts stated by Dr. Anil Bansal that this matter be forwarded to Directorate of Health Services, Govt. of NCT of Delhi with a request that Directorate of Health Services, Govt. of NCT of Delhi may verify the 4 credential/qualification of Shri Jatin Chaudhary and take appropriate necessary action against him.
2. The Vice-President, Delhi Medical Council observed that for future Council meetings, a system will be evolved for better recording of the minutes.
