This Addendum dated the day of , 20 , by and between , Hereinafter referred to as

“Lessor and the undersigned Lessee(s):``

W I T N E S S E T H:

In consideration of their mutual covenants and agreements, the Undersigned Lessee(s) and lessor hereby agree as follows:

a. Subparagraph B of Paragraph 3 entitled “Possession and Occupancy” is hereby modified to delete in its entirety all of said subparagraph and in substitution in lieu thereof the following shall be applicable: The premises shall be used only as a family residence by lessee and by members of lessee’s immediate family. The premises will not be used or allowed to be used for any unlawful purposes or for any purposes deemed hazardous by lessor or lessor’s insurance company because of fire or other risk. Lessee will conform with and obey the laws, ordinances, rules, regulations, requirements and orders of all governmental agencies having jurisdiction on said premises and the use and occupancy thereof. Notwithstanding any term or condition of the Real Property Possession and Lease Agreement, the l e ss e e sh a ll be e ntitl e d to o cc up a n c y and possession of the premises beginning the latter of execution of this Addendum and the Real Property Possession and Lease Agreement or . Lessee fully

understands and agrees the property needs repairs and agrees to occupy the property in its present condition as a condition of this agreement, while completing said repairs as described below. If for any reason the property cannot be occupied prior to an inspection by the city or any other governmental agency it will be the responsibility of lessee to complete repairs necessary at his/her expense prior to occupancy and acquire a certificate of occupancy as required. No waiver of rent will be granted during this process.

The following repairs to will be the full responsibility of lessee at lessee’s expense and all repairs on this addendum will be completed by or the entire

agreement may be terminated at lessor’s discretion and all earnest money or option deposits will be forfeited.
