MINUTES OF THE REGULAR MEETING HELD November 12, 2014

The Britannia Municipal Council convened their Regular Meeting in the Council Chambers of the Rural Municipality of Britannia Office at 9:00 a.m. Wednesday, November 12, 2014 with Reeve John Light presiding.

Delegations Rural RCMP Sergeant John Eneas and Constable Brenda Diachuk attended the meeting from 9:10 – 9:35 a.m. to review with Council the 2014 Mid-Year Stats for the Maidstone Detachment.

Adopt Minutes 653-14 TIPPE – That the Minutes of the October 23, 2014 Regular Meeting of Council be adopted as presented. CARRIED

Statement of Financial Activities 654-14 SCHINDEL – That the Statement of Financial Activities & the Cash Flow Statement for October 2014 be accepted as presented. CARRIED

List of Land w/Tax Arrears 655-14 FORLAND – That Council acknowledges receipt, in accordance with applicable legislation, the List of Land with Tax Arrears, labeled as Appendix ‘A’ and attached hereto forming a part of these minutes. CARRIED

Outstanding Accounts Receivables 656-14 COLLINS – That the Municipality transfer the following outstanding Accounts Receivables to the applicable tax cards: Roll # Arrears Interest Total 390 000 $ 370.00 $ 7.40 $ 377.40 463 000 $ 127.50 $ 12.42 $ 139.92 4846 000 $1,185.00 $ 87.00 $1,272.00 CARRIED

Rescind Resolution 657-14 CRUSH – That Resolution No. 634-14, passed at the October 23, 2014 Regular Meeting of Council, be rescinded and the following Resolution be adopted:

“That the Application to Subdivide one parcel from NE 28-52-27-W3, identified as Community Planning File #R0977-14S, be approved and recommended for approval by the Ministry of Municipal Affairs – Community Planning subject to the following conditions: - Applicant will be required to provide an expanded road right-of-way of an additional 17 feet along the east boundary of the proposed “Parcel A” adjacent to Range Road #3273. - The R.M. to acquire the right-of-way agreements along the remainder of the east boundary of NE 28-52-27-W3 and along the west boundary of NW 27-52- R.M. of Britannia #502 November 12, 2014 Regular Meeting 2

NE 28-50-27-W3 Application to Subdivide 658-14 COLLINS – That the Application to Subdivide three parcels from NE 28-50-27- W3, identified as Community Planning File #R1003-14S, be approved and recommended for approval by the Ministry of Municipal Affairs – Community Planning subject to the following conditions:  Applicant shall provide Cash-in-Lieu of Municipal Reserve in the amount of $2,100.00 (10% of the subdivided land x $1,000/acre). - Applicant will be required to provide an expanded road right-of-way of an additional 17 feet along the east boundary of NE 28-50-27-W3 adjacent to Range Road #3273.  The cost to construct the approaches will be that of the developer. CARRIED

SW 36-50-28-W3 Subdivision Proposal 659-14 COLLINS – That the proposal to subdivide three parcels from SW 36-50-28-W3 be tabled until the next Regular Meeting of Council. CARRIED

Council recessed the meeting for a lunch break from 11:50 a.m. – 12:45 p.m.

Crown Land Purchase 660-14 NOBLE – That the request of Ms. Rosemarie James (Lessee) to purchase the Crown land located at SE 11-50-25-W3, SW 11-50-25-W3, and NW 11-50-25- W3 be approved. CARRIED

Road Signage 661-14 COLLINS – That the Municipality place a 30km/hr. sign and a cautionary “Winding Road Ahead” sign on the road allowance running through Sec. 35-50- 27-W3, from Range Rd. #3272 to Range Rd. #3271, and that the Municipal Engineer inspect the road allowance to provide recommendations on improving traffic safety. CARRIED

Fencing 662-14 TIPPE – That the Municipality send letters to Mr. Michael Oestreicher and to Mr. Len Oestreicher regarding the rules for fencing road allowances. CARRIED

Public Works Scheduling 663-14 SCHINDEL – That approval be given to implement a 7-on/4-off and a 7-on/3- off work schedule for the Public Works employees utilizing a total of three crews and that the schedule be reviewed at the April 22, 2015 Regular Meeting of Council. CARRIED

Purchase Equipment 664-14 CRUSH – That the Municipality purchase a BearCat Oil Distributor from Redhead Equipment for a price of $115,000.00 (plus applicable taxes). In favour: Light, Noble, Collins, Schindel, Tippe, Crush Opposed: Forland CARRIED

Public Hearing – Bylaw Amendments 665-14 CRUSH – That the Council Meeting be suspended at 2:00 p.m. to open a Public Hearing on the proposed changes to the Lloydminster Planning District Official Community Plan and the Lloydminster Planning District Zoning Bylaw as proposed in Bylaw No. 17-2014 and Bylaw No. 18-2014. The Public Hearing was held from 2:00 – 2:10 p.m. with no one from the public in attendance.

Resume Regular Meeting 666-14 CRUSH – That the Public Hearing be closed and the Council Meeting resume at 2:10 p.m. CARRIED

Bylaw 17-2014 LPDC - Official Community Plan 667-14 COLLINS – That Bylaw No. 17-2014, being a bylaw to adopt the Lloydminster Planning District Official Community Plan, be read a second time. CARRIED Bylaw 17-2014 LPDC - Official Community Plan 668-14 SCHINDEL – That Bylaw No. 17-2014, being a bylaw to adopt the Lloydminster Planning District Official Community Plan, be read a third time, adopted, sealed, and signed by the Reeve and Administrator. CARRIED

Bylaw 18-2014 LPDC - Zoning Bylaw 669-14 NOBLE – That Bylaw No. 18-2014, being a bylaw to adopt the Lloydminster Planning District Zoning Bylaw, be read a second time. CARRIED Bylaw 18-2014 LPDC - Zoning Bylaw 670-14 FORLAND – That Bylaw No. 18-2014, being a bylaw to adopt the Lloyd- minster Planning District Zoning Bylaw be read a third time, adopted, sealed, and signed by the Reeve and Administrator. CARRIED

NE 11-50-25-W3 Utilize Approach/Parallel Rd. Allowance 671-14 NOBLE – That the request of Baytex Energy Ltd. (Baytex) to utilize an existing approach for access to 9D16-11-2C13-13-50-25-W3 and parallel the road allowance with a wellsite extension be approved subject to the following standard conditions:  The approach must be constructed to the R.M. of Britannia Minimum Approach Standard;  No permanent structures of any kind shall be put within 150 feet from the center of the road allowance;  The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional costs as a result of the surface lease occupying the property;  The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the property;  Baytex shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Baytex on the demised premises. CARRIED

SW 17 to SE 18-51-25-W3 Cross/Abut Road Allowance 672-14 NOBLE – That the application of Husky Oil Operations Ltd. (Husky) to cross a road allowance from SW 17-51-25-W3 to SE 18-51-25-W3 with a pipeline right-of-way and utilize a temporary workspace within proximity & abutting a road allowance be approved on the following conditions:  Husky must enter into a Pipeline Crossing Agreement;  No permanent structures of any kind shall be put within 150 feet from the center of the road allowance;  The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional costs as a result of the surface lease occupying the property; R.M. of Britannia #502 November 12, 2014 Regular Meeting 4

 The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the property;  Husky shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Husky on the demised premises. CARRIED

SaskPower SW 25-50-26-W3 673-14 NOBLE – That the request of SaskPower to provide electrical service by boring a municipal road and trenching in the road allowance of SW 25-50-26-W3 be approved on the condition that SaskPower is responsible for the lowering or relocating of the line in the event of future road construction. CARRIED

SaskTel NW 07-50-26-W3 674-14 FORLAND – That the request of SaskTel to install new cable and provide service to NW 07-50-26-W3 (Project #975449.0010) be approved. CARRIED

NE 21-50-26-W3 Utilize Approach/Proximity to Rd. Allowance 675-14 FORLAND – That the request of Husky Oil Operations Ltd. (Husky) to utilize an existing approach for access to 09-21-50-26-W3 and construct a padsite within proximity to the road allowance be approved subject to the following standard conditions:  The approach must be constructed to the R.M. of Britannia Minimum Approach Standard;  No permanent structures of any kind shall be put within 150 feet from the center of the road allowance;  The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional costs as a result of the surface lease occupying the property;  The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the property;  Husky shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Husky on the demised premises. CARRIED

NE 17-50-26-W3 Abut/Parallel Rd. Allowance 676-14 FORLAND – That the request of Husky Oil Operations Ltd. to abut and parallel a road allowance within NE 17-50-26-W3 be tabled until the next Regular Meeting of Council. CARRIED

NW 13-51-27-W3 Construct Approach 677-14 COLLINS – That the revised request of Husky Oil Operations Ltd. (Husky) to construct an approach for access to 2A12-13-3A5-14-51-27-W3 be approved subject to the following conditions:  Husky must enter into a Memorandum of Understanding (MOU) to build ½ a mile of road allowance from approach south to Twp. Road #512;  The approach must be constructed to the R.M. of Britannia Minimum Approach Standard;  No permanent structures of any kind shall be put within 150 feet from the center of the road allowance;  The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional R.M. of Britannia #502 November 12, 2014 Regular Meeting 5

costs as a result of the surface lease occupying the property;  The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the property;  Husky shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Husky on the demised premises. NW 33-51-25-W3 Construct Approach 678-14 SCHINDEL – That the request of Harvest Operations Corp. (Harvest) to construct an approach for access to HZ 2D15 & 2A15-4-52-25-W3, be approved subject to the following conditions:  The approach must be constructed to the R.M. of Britannia Minimum Approach Standard and is to be placed directly across from A4-4 (location on north side) for a safer sightline;  Request for proper staking of approaches in the future;  No permanent structures of any kind shall be put within 150 feet from the center of the road allowance;  The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional costs as a result of the surface lease occupying the property;  The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the property;  Harvest shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Harvest on the demised premises. CARRIED

NE 19-52-27-W3 Abut/Parallel/Proximity to Rd. Allowance 679-14 CRUSH – That the request of Husky Oil Operations Ltd. (Husky) to abut, parallel, and be within proximity to a road allowance with a facility, identified as padsite 09-19-52-27-W3, be approved subject to the following conditions:  Husky must enter into a Road Maintenance Agreement;  All truck traffic must head north to Highway #3;  The approach must be constructed to the R.M. of Britannia Minimum Approach Standard;  No permanent structures of any kind shall be put within 150 feet from the center of the road allowance;  The R.M. of Britannia No. 502 shall have the right to backslope if necessary for road construction purposes on the surface lease and shall not incur any additional costs as a result of the surface lease occupying the property;  The R.M. of Britannia No. 502 shall have the right to acquire land covered by the lease to create additional right of way for road construction and/or maintenance purposes and shall not incur any additional costs in obtaining the right of way as a result of the lease occupying the property;  Husky shall agree to indemnify and save harmless the R.M. of Britannia No. 502 from and against all loss, costs, charges, damages (including the R.M. of Britannia No. 502) and expenses which the R.M. of Britannia No. 502 may suffer or sustain as a result of the operations by Husky on the demised premises. Purchase Land 680-14 NOBLE – That the Municipality proceed with purchasing land from Mr. Merle Hoegl, located beside the Hillmond Landfill, for use by the Public Works Department. CARRIED

681-14 SCHINDEL – That the Municipality hire Ms. Wanda Boon as the new R.M. Administrator, effective December 1st, 2014, under the conditions as outlined in the attached Letter of Employment. CARRIED

Fire Service Agreement 682-14 CRUSH – That the Municipality sign the Fire Service Agreement with the R.M. of Wilton. CARRIED

4-Mile Paving 683-14 SCHINDEL – That the Authorization to Proceed, from Clifton Associates Ltd., to provide engineering consultation for the paving of Grid #774 (4-Mile Rd.), from the NW 24-50-27-W3 to Highway #17, and the paving of Range Road #3281, east of Sec. 24-50-28-W3, for an estimated cost of $230,640.00 be approved. In favour: Light, Noble, Schindel, Crush Opposed: Forland, Collins, Tippe CARRIED

Voting Delegates 684-14 NOBLE – That Council appoint Councillor Dale Crush and Councillor Kim Schindel as voting delegates for the 2014 SARM Mid-Term Convention being held in Saskatoon, SK on November 13th & 14th, 2014. CARRIED

Snow Removal 685-14 FORLAND – That the Municipality continue with the same flagging system as last winter for snow removal for private laneways. CARRIED

Concentrated Haul Meeting 686-14 CRUSH – That the Municipality hold a Concentrated Haul meeting on the third Wednesday in January 2015. CARRIED

WestBay Estates 687-14 NOBLE – That Council acknowledges receipt of the letter from the residents of WestBay Estates regarding the campground located on Lot #25. CARRIED

Bylaw 20-2014 Sewer/Water Bylaw 688-14 TIPPE – That Bylaw No. 20-2014, being a bylaw to provide for the setting of sewer and water rates, conditions, and operations, be read a first time. CARRIED

692-14 SCHINDEL – That the Municipality aquire road right-of ways on Sections 13- 52-26-W3 and 18-52-25-W3 adjacent to Range Road #3260. CARRIED

December Meetings 693-14 SCHINDEL – That Council set the December Regular Meetings of Council for Wednesday, December 3rd and Wednesday December 17th, 2014. CARRIED

Accounts for Approval 694-14 CRUSH – That the following Accounts for Approval, a list of which is attached hereto and forms a part of these minutes, be approved for payment and signed by the Reeve and Administrator: 1. General Cheques 25469 – 25548 and Online Pymts. #74-82, totaling $348,563.66. 2. Payroll Accounts for the Month of October 2014, totaling $192,042.23. CARRIED

Correspondence 695-14 TIPPE – That the Correspondence, a list of which is attached hereto and forms a part of these minutes, has been reviewed by Council and may be filed accordingly. CARRIED
