Hawkquest Waiver of Liability

It has been explained to me that the HawkQuest experience in which I or my child will be participating will involve hiking in the field and engaging in observation of animals in the wild. The birds or animals which I or my child will be observing have not been domesticated. I acknowledge that this activity involves a risk of physical injury to any individual either as a result of the hiking or as a result of the birds or animals; and that wild animals, including wild birds, irrespective of their usual past behavior and characteristics, may act or react unpredictably at times based upon instinct or fright, which reaction may cause injury to me or my child. I expressly assume the inherent risk described above on behalf of myself or my child and waive any claim we might state against HawkQuest or its volunteers as a result of physical or psychological injury incurred to me or my child as a result of participating in this activity.

In consideration for being able to participate in this event, I, for myself and/or my child, release and discharge from liability and give up all right to make claim either directly or indirectly, against HawkQuest and all other participating sponsors, organizers and promoters, hosts, their officers, directors, employees, agents and any other persons connected with this HawkQuest experience, for any personal injury or property damage arising from my and/or my child’s participation in, or presence at this HawkQuest event. In the event that my child should make any claim notwithstanding this release, I agree to indemnify and hold harmless HawkQuest and its volunteers from any claim or judgement including all cost of defense and attorney’s fees.

NOTE: While HawkQuest, a non-profit Colorado Corporation, is licensed by the Colorado Division of Wildlife and the U.S. Fish and Wildlife Service, neither entity shall be responsible for any injuries that might occur during my or my child’s participation in this HawkQuest event and this waiver shall apply to them as well.
