Defendants: The Hinsdale Mining and Development Company, a defunct South Dakota corporation, Daniel L. Plies, and all unknown persons who claim any interest in the subject matter of this action. Complaint: Application for Determination of Abandonment. Plaintiffs seek a determination that the water right described herein has been abandoned due to an extended period of nonuse and request that the right be cancelled and that any further diversions based on the cancelled water right be permanently enjoined. Abandonment of a water right is a water matter within the jurisdiction of the water court. In Case No. 3516, upon the application of the Hinsdale Mining and Development Company, L. F. Hulen lessee, the Montrose County District Court decreed a storage water right to The Lake San Cristobal Reservoir on January 9, 1928, for 426,278,160 cubic feet of water “for the purpose of diverting and applying same for the generation and production of electrical power” (the 1928 Storage Right). The decreed location of Lake San Cristobal Reservoir is “on the S½ Section 10; S½ Section 15; S½ Section 38; SW¼ Section 27; NE¼ Section 28; SE¼ Section 21, Township 43 North, Range 4 West, New Mexico Principal Meridian in Hinsdale County, Colorado.” A copy of the relevant portion of the decree is attached to the Complaint. In Case No. 3516, the Montrose County District Court decreed a direct flow water right to The Lake City Power Company’s Pipe Line on January 9, 1928, for the development and the production of electrical power (The Pipe Line Right). Water stored under the 1928 Storage Right must later be diverted and used through the Lake City Power Company’s Pipe Line for the production of electrical power. Upon information and belief, no storage or diversion for the generation and production of electrical power has been made under the 1928 Storage Right for at least sixty years. The Pipe Line Right was cancelled on grounds of abandonment, without protest, on March 13, 1975 in Case CW-(74)361. Allowing cancellation of the water right for the Lake City Power Company’s Pipe Line, and the fact that the Pipe Line has not been in existence for a period well in excess of ten years, demonstrates intent to abandon the 1928 Storage right. The owner of the 1928 Storage Right and the Pipe Line Right, The Hinsdale Mining and Development Company, a South Dakota corporation, was incorporated in South Dakota on May 25, 1907 for a 20-year term of existence. An amendment to the Articles of Incorporation was filed on May 16, 1927 to extend its term of existence for a 50-year period. Its corporate charter was canceled on July 1, 1970 for failure to file annual reports as required by law. On February 5, 1980, the Colorado Water Conservation Board obtained a natural lake level decree with a priority date of May 12, 1976 (amended by decree dated March 21, 1991) controlling the entire volume of water in Lake San Cristobal, “a natural lake”, to protect the natural environment to a reasonable degree (Case No. W-3366). No fact or condition exists that excuses the nonuse or shows the owner's intent not to abandon the 1928 Storage Right. Upon information and belief, Defendant Daniel L. Plies claims an ownership interest in the 1928 Storage Right. Based upon the extended period of nonuse, the cancellation of the Pipe Line Right as a result of a finding of abandonment, the fact that the owner of record ceased operations more than 50 years ago and ceased to exist 40 years ago, the absence of any fact or condition that excuses the nonuse or shows the owner’s intent not to abandon the water right, the Plaintiffs request that the Court declare the 1928 Storage Right abandoned and further request that the 1928 Water Right be cancelled and that any further diversions based on the cancelled water right be permanently enjoined. The RMBL Well will be used for the same purposes and in the same location. Applicant’s intent is to add an alternative point of diversion for the remaining 0.467 cfs of their decreed. 0.5 cfs for the Gothic Pipeline right to the RMBL Well. There are no other water rights diverted through the Gothic Pipeline. In addition to the Gothic Pipeline, in Case No. 82CW206, RMBL was granted an absolute decree for 0.5 cfs of water for hydro-electric power from Gothic Spring, with appropriation date of July 25, 1978 and adjudication date of December 31, 1982. This use is non- consumptive, and is not affected by the change sought herein. Water rights to be used for augmentation: The water right decreed to Blue Mesa Reservoir out of the Gunnison River in Case No. 80CW156 for 940,755 acre-feet with priority date of November 13, 1957, for domestic and municipal, irrigation and stock watering, industrial, hydropower, piscatorial, wildlife, recreation and other purposes. The initial point of survey of Blue Mesa Dam is located at a point on the right abutment being the intersection of the center line of the axis of the dam and of the center line of the outlet works tunnel, whence the SW corner of Section 31, Township 49 North, Range 4 West, N.M.P.M. bears North 78º36ʹ44ʹWest a distance of 3,207.07 feet. Applicant will enter into a water service contract with the United States of America for one acre-foot of water stored in Blue Mesa Reservoir. The Blue Mesa decrees have been used for all their decreed purposes. The Gothic Pipeline and Johnson Spring Well rights pumped through RMBL Well. RMBL Well will pump water, in addition to the “normal” pumping, to supply RMBL, and discharge it back to the East River in the amounts necessary to replace depletions to the East River Canal No. 2 when the East River is under water right administration. Complete statement of plan for augmentation. The domestic supply for RMBL is presently provided by two separate systems– a year round system (Johnson Spring Well) and the summer system (Gothic Pipeline). The year-round water system supplies RMBL’s permanent residents and the summer system supplies RMBL’s permanent and summer personnel. Most of RMBL’s wastewater is treated through septic tanks and leach fields that are located throughout the RMBL property. The return flows from these leach fields accrue to either the East River or Copper Creek. The remaining wastewater is collected in several vault toilets on the property and trucked to the East River Regional Wastewater Treatment Plant, the discharge from which occurs to the East River above the East River No. 2 Canal. RMBL’s total water usage during the period 1999 through 2010 averaged approximately 592,000 gallons or 1.82 acre-feet annually. The water usage through the summer system amounted to an average 458,370 gallons or 1.41 acre-feet annually. That use occurred during an average of 92 days annually beginning on about June 6 and continuing through about September 4, and ranged from approximately 0.93 acre-feet in 2008 to 1.97 acre-feet 2005. A complete summary is at Table 1 attached hereto. During the same period, the average monthly water usage ranged from 366 gallons per day when only the year-round system was operated to 5,403 gallons per day (3.75 gallons per minute on a continuous basis) in July and August. Table 2 reflects the monthly usage. With wastewater treatment through septic tanks and leach fields and the East River Regional Wastewater Treatment Facility, the consumption in RMBL’s water usage should not exceed 10 percent of the water usage. Consequently, the actual water consumption or “well-head depletions” in RMBL’s engineer’s analysis from RMBL’s water usage will not amount to more than 10 percent of the well pumping. Columns 5 through 7 in Table 2 show the monthly well-head depletions in an average year. Overall, the well-head depletions will amount to about 59,205 gallons or 0.182 acre-feet annually. Using the spreadsheet version of the Analytical Stream Depletion Model developed by Schroeder (1987), RMBL’s engineer determined that the stream depletions from RMBL’s well pumping will be delayed over a fairly long time period. Approximately 53 percent of the depletions will occur within three months of the pumping, 69 percent within 6 months, 85 percent within 12 months, and 99 percent within 36 months. Columns 8 through 10 in Table 2 show the monthly stream depletions that will occur in a steady-state situation after three years of operation. The steady-state monthly stream depletions range from 2,429 gallons (79.9 gallons per day) in May to 10,052 gallons (330.5 gallons per day) in August. Based on an analysis of the period 1989-2010, RMBL’s engineer estimates that the critical year with respect to the Gunnison Tunnel was 1994 when the out-of-priority stream depletions amounted to 19,682 gallons (0.06 acre-feet) over 64 days, and the critical year with respect to potential calls from East River Canal No. 2 was 2007 when the out-of-priority stream depletions amounted to 12,903 gallons (0.04 acre-feet) over 43 days. The depletions to the Gunnison Tunnel will be replaced during a call from that facility by releases from Blue Mesa Reservoir at the discretion of the Division Engineer. The depletions to the East River Canal No. 2 will be replaced by pumping from the RMBL Well and discharging it directly to the East River. The replacements should be made daily or as otherwise directed by the Division Engineer and in the following amounts for each day of valid call: When the educational and research facilities are operating: June 305 gallons per day July 305 gallons per day August 435 gallons per day September 488 gallons per day When the educational and research facilities are not operating: September 390 gallons per day These amounts of replacement water will be sufficient to replace the out-of-priority stream depletions from both RMBL’s normal well pumping and the additional replacement pumping. These replacements will keep the East River “whole” during the periods of call. Relatively small additional stream depletions will occur as the result of this replacement pumping later when downstream water rights are either satisfied or not diverting. The Amended Application is filed to correct the location of Almont Resort Well B. REQUEST FOR FINDING OF REASONABLE DILIGENCE: Almont Resort Well #1, Almont Resort Well #2, Almont Resort Well A, Marston Ditch/Almont Resort Enlargement, and Almont Resort Pond No. 2 are the structures for which diligence is sought. In connection with the Plan for Augmentation approved in Case No. 02-CW-160, conditional water rights for each of the structures were awarded in the amount of 15 gpm for irrigation and domestic uses (for Wells No. 1 and No. 2), 15 gpm for irrigation and commercial use (for Well No. A), 5 acre feet for domestic, irrigation, augmentation, piscatorial, recreation and fire protection uses (for Almont Resort Pond No. 2), and 2.0 c.f.s. for domestic, irrigation, fire protection and filling of Almont Resort Pond No. 2 (for Marston Ditch/Almont Resort Enlargement). Almont Resort Well B is located in the NW1/4 SE1/4 of Section 22, T51N, R1E, NMPM, 2,045 feet from the South line of Section 22, and 2,536 feet from the East line of Section 22.
