FARMOWNERS

General Instructions

The Farmowners Policy provides property and liability coverages. This program contains the rules, classifications and premiums for writing a Farmowners Policy.

Rule I Eligibility

1.1 The owner-occupant of the farm, or

1.2 The owner-occupant of the farm if the farm is tenant-operated under either the named-insured’s direct management or under the terms of a management contract or,

1.3 The owner or co-owner of the farm in a private or incorporated farming venture when the partnership or corporation is shown on the declaration. The major shareowner must also be listed.

1.4 Tenant Forms: May be issued to a tenant who is engaged in the farming operation.

Rule II Ineligible Risks

2.1 Vacant, seasonal, or unoccupied farms (excluding additional locations).

2.2 All nonfarm or Commercial risks including commercial operations, saw mills, and buildings used for commercial storage.

2.3 Farms where the principal business is raising and training horses for show or racing purposes.

2.4 Cattle dealers or sale barns.

2.5 Farms used for recreation.

2.6 Buildings in which unapproved heat lamps, portable salamander-type heaters, or similar devices are used.

2.7 All farm buildings having exposed cellular plastic insulation (polystyrene and urethanefoamed or rigid).

2.8 Dwellings where the only source of heat is wood. Exception – outside woodstoves, 50 feet or more from a structure.

Rule III Policy Forms and Descriptions of Coverages

The following are general descriptions of the coverages provided. The policy and forms should be consulted for exact contract conditions.

3.1 Section I Coverages – Mandatory Coverage A – Dwelling – See Homeowners Program for Underwriting Rating.

Fire and Lightning Windstorm and Hail Explosion Riot or Civil Commotion Aircraft Vehicles Smoke Vandalism and Malicious Mischief Theft Collision, Upset or Overturn Electrocution of Livestock Sinkhole collapse Volcanic action Earthquake & Flood Loss to Livestock Loading & Unloading of Livestock Equipment Breakdown

Rule IV Liability – Use Farm Liability.

4.1 Personal Liability (Farm) – Pays on behalf of the insured for damages due to bodily injury or property damage caused by an occurrence arising out of the farm premises and operations of the insured’s personal activities.

4.2 Medical Payments to Others – Pays medical expenses incurred by persons who are not insured's, if the bodily injury arises on the insured’s premises.

Rule V Binding Authority – You may bind an acceptable Farmowners risk up to $1,000,000.00. Risks in excess of these limits require advance authorization from the Company.

Rule VI Definition of Farm Property – Farm property consists of dwellings, barns, granaries, outbuildings and other structures used in connection therewith, and their contents, livestock, hay and grain in stacks, farm machinery, and equipment located on land used for poultry, truck, fruit, vegetable, livestock, dairy, or other farming purposes, when they are located inside or outside the corporate limits of cities, towns, or villages.

Rule VII Coverage A – Dwelling

Requirements and Guidelines

7.1 Market Value Homeowners Select Homeowners See Homeowners (HO-2 Rule VI) 7-Star Homeowners for minimum limits of coverage. Homeowners Tenant

7.2 Mobilehomes –May qualify as principal dwelling on a Farmowners Policy. Minimum limits of liability for a mobilehome - $10,000.00 (Use Broad Form Mobilehomeowners rate schedule).

04-06 FO-2 7.3 Secondary Residence – May be treated the same as principal residence if used by a member of the farming operation.

7.4 Farmowners – DOES NOT include appurtenant structures–Coverage B (All buildings must be included as Farm Structures).

7.5 The dwelling must have better than average construction and maintenance.

7.6 The dwelling must have modern electrical and plumbing systems.

7.7 No exposed urethane or styrene insulation.

7.8 If dwelling contains a woodstove or furnace, this unit must be properly attached to a masonry chimney with proper flue lining. Only one additional attachment per chimney is permitted. If woodstove or furnace is not properly installed, refer to the Company for approval before binding coverage.

7.9 Outdoor wood burner – when located in a structure; the structure, the stove and any personal items or equipment are not insurable.

Rule VIII Farm Personal Property

Requirements and Guidelines

8.1 Blanket Farm Personal Property – Minimum coverage is $25,000.00. Must be property used in the daily operation of the farm. Blanket coverage may be written as a Complete Blanket or a Classified Blanket.

8.2 Scheduled Coverage – No minimum.

8.3 Personal Property – If not located in the dwelling or attached garage, must be scheduled.

8.4 Farm implements valued over $10,000.00 should be equipped with an approved A.B.C. rated fire extinguisher.

8.5 Farm Personal Property – May be written as scheduled or blanket. It is permissible to write both on an individual policy.

8.6 Insured Real or Personal Property – May be surcharged up to 100% of rates (the Company retains option).

8.7 Increase of Dairy Cattle – Farm Personal Property forms limit coverage to $3,000.00 per head. Should higher limits be requested it must be stated on the application, and also a memo to the underwriters. Coverage will be added using form ML – 304A.

8.8 Leased, Rented, or Borrowed Equipment or Livestock.

A. Leased, Rented, and/or Borrowed items must be scheduled.

B. Property coverage provided for only the leased, rented, or borrowed items. (Make, serial number, and I.D. number required). 04-06 FO-3

C. Liability coverage is provided for only the items leased, rented, or borrowed. Coverage is restricted for only the specific items.

D. These items cannot be added to the Blanket.

Rule IX Blanket Farm Personal Property – Insure to Value

Blanket Farm Personal Property requires that the insured shall maintain insurance at 100% of the actual cash value of the total inventory. If at time of loss, the insurance is not 80% of the inventory or higher, the loss payment will be reduced accordingly.

When the inventory is properly done at the time of writing, considerable fluctuation can take place in the value of the Blanket Insurance during the year at no penalty to the insured at the time of loss.

Although 80% is the minimum ratio of insurance to value, Blanket Coverage must be written at 100% of value of inventory. This gives the insured a margin of safety and permits an inventory increase of 25% without penalty. Example: An inventory of $100,000.00, minimum insurance is 80% or $80,000.00. Insured to the full $100,000.00 value, will permit an increase to $125,000.00 without penalty.

Blanket Coverage must have an inventory list attached to new or renewal policies.

The Company’s Blanket Insurance is designed so that all personal property may be insured, not just the items most likely to be damaged-thus the lower premium.

The Company reserves the right to reject Blanket Coverage on certain risks.

Coinsurance Clause Formula

Recovery Amount = Amount of Insurance Carried Loss Sustained 80% of A.C.V. of Property

Example: Insured suffered loss of $10,000.00. The A.C.V. of the property under Coverage E is $100,000.00 and the insured is carrying $50,000.00 of insurance:

Recovery Amount $50,000.00 $10,000.00 $ .80 ($100,000) or $80,000

Recovery = 62.5% or $6,250.00

Rule X Ginseng Roots or Seed in Storage – Coverage E – Must be scheduled

Requirements and Guidelines

10.1 Ginseng Roots – List number of pounds and the desired insured value per pound.

10.2 Ginseng Seed – List number of pounds and value per pound.

10.3 There will be a $200.00 earned premium for each policy period. 04-06 FO-4

Rule XI Barns, Buildings & Structures

Requirements & Guidelines

11.1 Type I

A. Buildings must be fully utilized for their intended purpose.

B. Buildings must have better than average construction and maintenance.

C. Buildings must have continuous mortared masonry or concrete foundation and concrete floor. Buildings must be framed on poles of minimum six inches diameter at ground line, set a minimum of four feet below ground level and not more than 8 feet apart.

D. Buildings must be fully enclosed. (If open sheds are attached, appropriate premium shall apply).

E. Buildings designed and used for housing cattle, which contain certain type openings, may qualify for Type 1, contact underwriter - Company Option.

F. Pole buildings with gravel or dirt foundations and floors. -Structures must be 20 years old or newer -The structure must be insured to 90% of replacement value. (A replacement cost estimator is required to qualify this structure for Type 1.)

G. To add replacement cost coverage-refer to FO rate page.

H. Inflation guard (4% annually) will be applied to all Type 1 buildings with replacement coverage. Exception, Insured may request limits remain constant.

11.2 Type II

A. Minimum amount on barns $40,000.00, on other structures $2,000.00.

B. Structures must be of average construction and neat appearance around buildings.

C. Buildings not used for the purpose for which they were constructed.

D. All concrete and metal silos (silage must be insured as part of the personal property).

11.3 Type III

A. Barns and buildings not eligible for Type I or II.

B. Barns and buildings used for commercial purposes, if acceptable. 04-06 FO-5

C. Vacant barns and outbuildings, if acceptable by the Company, up to 100% surcharge applies.

D. Outdoor wiring and/or submersible pumps. D 11.4 Steel Buildings Classification – For a building to qualify for the steel building rate, it must have continuous concrete foundation, be of all steel construction with no glass, and a minimum value of $20,000.00. All structures meeting these requirements will qualify.

11.5 All farm buildings that are insured must be substantially built and in good repair.

11.6 Any permanent or portable heating system in any farm building must be inspected and approved by the Company before coverage will be provided.

Rule XII Rebuilding Clause – Applies to all Coverage E structures except when Replacement Cost coverage is on the structure. This limits the amount of loss to 50% until the structure is repaired or rebuilt. All dwellings are excluded from the rebuilding Clause.

Rule XIII Roof Limitation – Coverage on roofs of structures is limited to 15% of the stated coverage for the structure. On Quonsets and hoop-type roof structures – contact the Company.

Rule XIV Optional Endorsements – The deductible shown on the declarations applies to all optional coverages, unless otherwise stated.

14.1 Falling Objects

The policy may be extended to cover loss by falling objects. The building or structure must be described on the application; however, we do not pay for loss to:

A. The inside of a structure, or the property inside, unless the falling objects has first damaged an outside wall or the roof by impact.

B. The object which falls; or

C. Fences or outdoor equipment.

D. The rate for this coverage is $.60 per thousand (Company option).

14.2 Farm Extension Package A. Broad – Coverage for Outdoor Private Power and Light Equipment, Agricultural Machinery and Equipment Rental Reimbursement, Barn Glass Breakage, Refrigerated Milk Spoilage, Farm Extra Expense, Attack of Livestock, Accidental Shooting of Livestock, Drowning of Livestock, Collapse, Breakage of Glass, Borrowed, Rented or Leased Farm Machinery, Vehicles and Equipment, Emergency Removal of Produce, Lightning or Electrocution Loss to Livestock, Silo Unloader Collision, Ordinance and Law, and Pumps and/or Water Systems. Bulk milk tanks, bulk feed tanks, barn cleaners, pasteurizers, boilers and silo unloaders. The premium is $.85 per thousand. Minimum policy premium of $50.00. No deductible applies. 04-06 FO-6

14.3 Farm Operation Records – Coverage is provided for expenses incurred to research, obtain necessary data, replace, reproduce or restore farming operation records damaged or destroyed by a peril insured. Additional premium is $4.00 per thousand of coverage.

14.4 Glass Coverage – Coverage for breakage of glass being a part of the cab of mobile farm equipment, type of equipment, year, make and model, serial number and limit of liability must be listed. Additional premium is $10.00 per thousand. Minimum premium is $10.00. List equipment being covered on application.

14.5 Irrigation Equipment – Optional Endorsements (must be scheduled)

A. Collision of Irrigation System with Another Object All items must be scheduled. Rates of $.87 per thousand.

B. Replacement Coverage for All Irrigation Equipment Must be owned by the insured and written to Replacement Cost. (Irrigation well may be excluded) See rates per deductible.

C. Replacement Coverage for Specified Items of Irrigation Equipment. Rate $9.50 per thousand.

14.6 Extra Expense – Coverage for extra expense incurred as a result of an insured loss in order to continue normal farming operations. Operations, which have been interrupted as a result of a loss or damage to Coverages E, F & G insured under the policy. The additional premium is $4.00 per thousand of coverage limited to 25% per month.

14.7 Loss of Income – Coverage for loss of earnings resulting from an insured peril, to Coverage F & G Farm Personal Property and Coverage E Farm Buildings and Structures insured by the policy. The additional premium is $4.00 per thousand of coverage limited to 25% per month.

14.8 Mt. Morris Special Endorsement

A. Borrowed Farm Machinery, Vehicles and Equipment – We provide coverage for borrowed farm machinery, vehicles and equipment for the loss by the perils insured. The limit of liability is 5% of the Farm Personal Property with a $5,000.00 maximum coverage.

B. Added Animal Perils – Excluding sheep and poultry. We provide coverage against the death of livestock resulting from:

1. Accidental Shooting – Except by you, member of your family, employees of the insured or persons residing on the insured’s premises.

2. Drowning – Only livestock over 30 days of age.

3. Attack – By wild animals or dogs. 04-06 FO-7

C. Collapse – Of a building on Personal Property when collapse is part of the coverage.

D. Refrigerated Food Products – We provide up to $250 coverage on loss resulting from the interruption of electrical services due to damage to power generating or transmission equipment.

No additional premium for Special Endorsement.

14.9 Peak Season Inventories – Farm Personal Property – Peak Season coverage may be written to provide above normal coverage for periods of 30 to 180 days. The additional premium is determined by pro- rating the rate for Coverage F Scheduled Farm Personal Property. Minimum premium is $20.00. List items and months being covered on application.

14.10 Replacement Cost Coverage Farm Buildings Coverage, Eligibility :

A. Buildings must be built or remodeled to like new condition.

B. Buildings must be classified as Type I and structures that qualify for the steel building class with Broad Form Perils.

C. Buildings must be fully utilized for their intended purpose.

D. Buildings must be insured to a minimum of 90% of their Replacement Cost (Agricultural Cost Estimating Form must be submitted for each building).

E. Replacement Cost Coverage need not be written for all insured buildings. Those buildings to which Replacement Cost applies will be indicated on the declarations.

F. Rate for Replacement Cost Coverage is: Total Type 1 Building Rate $4.00 Broad Form Perils ML-323 + $ .80 Replacement Cost Rate + $ .15 Cost per thousand = $4.95

14.11 Special Form Coverage – This endorsement is limited to buildings that qualify for type I rates. With respect to Coverage E, the perils section of the farm coverage is replaced by the following: We insure the property for risks of direct physical loss, unless the loss is defined under the exclusions applying to Coverage E, under the general exclusions. The rate for this coverage is $1.20 per thousand (Company option).

14.12 Transit Coverage – Information needed is as follows:

14.13 Weight of Ice, Snow or Sleet Coverage – The policy may be extended to cover loss by the weight of ice, snow or sleet to Coverage E, F& G. Type I buildings & personal rate is $.80 per thousand. Type II buildings and personal rate is $1.00 per thousand. Coverage cannot be bound between December 1 st and March 31 st without prior approval by the Company. The roof must have a pitch of 4/12 or steeper.

14.14 Intake of Foreign Materials – Covers direct physical loss caused by/or that results from foreign objects that are picked up and taken into covered farm machinery. Blanket premium is $.75 per thousand. Scheduled equipment must be identified by make, model & serial number. Scheduled premium is $7.50 per thousand. $40.00 minimum premium per policy. $1,000.00 deductible applies to this endorsement.

14.15 Farm Personal Property – Replacement Cost on Partial Loss – Premium included in base rate.

This endorsement provides Replacement Cost Coverage for partial losses to Farm Personal Property (Blanket and Scheduled). We will pay the cost of repairing the damaged property with materials of equivalent kind and quality to the extent practical, without deduction for depreciation. We will not pay more than the actual cash value of the item or items damaged.

14.16 Reporting Form Coverage – Eligibility is limited to livestock and poultry. The amount of coverage requested must be submitted to the home office before the 10th of the month.

14.17 Identity Fraud Expense Coverage – Available for expenses resulting from identity fraud of the insured. Coverage includes:

A. costs for obtaining, reproducing, notarizing, or sending affidavits or other pertinent documents;

B. costs for telephone calls;

C. research fees;

D. lost earnings, not to exceed a maximum of $250 per day, per insured, or a total of $5,000 for lost earnings of all insureds;

E. loan application fees for reapplying for a loan; and

F. attorney fees to defend lawsuits, remove criminal or civil judgments, or challenge information provided in a consumer credit report. $5,000 Minimum Limit - $15.00. Limits may be increased for an additional premium of $3.00 per thousand.

14.18 Raw Milk Endorsement- This endorsement compensates the insured when the insured notifies the Company that the milk in their bulk tank is contaminated. The milk must remain in the tank until an on site inspection is completed by the Company agent or milk plant. Maximum payment is 50% of the value of the contaminated milk. (No additional premium charge)

Rule XV Deductibles – A policy may be issued with one of the following deductible options at the premium credit or surcharge shown:

Rule XVI Horses, Mules, Donkeys, Hinnies, Llamas, Elk, and Deer must be scheduled, unless prior approval is obtained from the Company.

Rule XVII Horse Boarding – Coverage for Physical Damage to Animals Owned by Others

17.1 Animals must be scheduled

C. Coverage amount desired “binding to $5,000.00 per animal”

17.2 This coverage (provided only when a limit of liability and a premium charge are shown for the coverage on the declaration) is described in the farm forms attached to this policy.

17.3 Underwriting Guidelines – May be added to Farmowners, Country Pac, or Fire and Extended policies.

17.4 Option Available

Transit Coverage for Horse Boarding – Information needed is as follows (Contact Company):

Horse Boarding – Property rate per thousand of coverage $10.60 @ $500 deductible.

18.4 Coverage – Classified Blanket – Farm Personal Property – Classified Blanket Farm Personal Property must be divided into four classifications. Coverage is provided when an amount of coverage and a premium is shown for each class. The 80% co-insurance applies to each class.

18. 7 Farm Dwelling – Use Homeowners Rates that apply to location of dwelling.

18. 8 Mobilehomes – Schedule as structure. Rate $14.60 per thousand. 18. 9 Farmowners Tenant – Use Homeowners Tenant Form (See Homeowners Program).

18.10 Ginseng Roots and Seed - $10.10 per thousand and $500.00 deductible applies.

18.11 Irrigation Equipment – Irrigation equipment must be scheduled.

18.12 For coverage on electric motors and electric panels (if no supporting irrigation equipment), the rate is $15.30 per thousand with a $500.00 mandatory deductible. Equipment must be insured to Actual Cash Value.

RULE XIX Equipment Breakdown Coverage

19.1 Premiums included on all Farmowners – No Charge

19.2 Coverage- provided for loss to Covered Equipment. Equipment Breakdown Coverage will eliminate potential gaps in coverage. Common coverages includes: a) Mechanical breakdown b) Artificially generated electric current c) Steam boilers d) Other steam equipment & water heating equipment e) Expediting expenses f) Pollutants g) Spoilage h) Computers in the dwelling i) Data Restoration j) Utility Service Interruption k) Irrigation systems

19.3 Additional Coverage-provided under the farm property policy for loss of earnings or rents and extra expense. Coverage is limited to $25,000 per occurrence, policy deductible applies

19.4 Deductibles- Farmowners deductible applies unless specifically stated.

19.5 Exclusions-Coverage for mobile equipment is excluded.

19.6 Conditions- for Environmental, Safety & Efficiency Improvement is included. We cover the additional cost to replace with equipment that is better for the environment, safer and/or more efficient. Our liability does not exceed 125% of what the cost would have been to replace with equipment of like kind and quality. RULE XX Organic Farms
