June 9, 2017 REQUEST FOR PROPOSALS (RFP)

1.0 INTENT

The intent of this RFP is to solicit proposals from qualified contractors for Burnet Middle School Sound Systems for Burnet CISD. Proposers are to be aware that the district will evaluate all proposals on the basis of what is considered to be in the best interest of the district and the patrons of Burnet Consolidated Independent School District and not price alone.

2.1 Burnet C.I.S.D. requests that all prospective contractors abide by the following timeline in order to expedite the bid process. The proposal is due on Thursday, June 15, 2017 and must be received by 2:30pm local time at the following location:

2.2 Late proposals will be returned unopened. The proposals should be sealed with the following label clearly visible on the outside:

2.3 Burnet C.I.S.D., at its sole discretion, reserves the right to reject any and all proposals.

3.0 SCOPE OF SERVICES REQUESTED

3.1 Burnet CISD will expect a lump sum format for the services sought under this request. This proposal will cover the entire scope for Burnet Middle School Sound System Project(s). This must be ready for use by the district. Each proposal should include but not be limited to, a detailed description of the recommended processes, equipment to be used and pricing for all labor and materials required for the installation to be contracted as well as contingency events. The Burnet Middle School Sound System Project(s) Specifications are detailed in this RFP (See Section 4.0). The contractor will be responsible for obtaining and paying for any and all applicable permits.

3.2 Proposals shall be based on sound, proven technologies that can be easily verified.

4.0 SPECIFICATIONS

4.1 Burnet Middle School Sound System Project(s)

4.1.1 The contractor must have successfully completed a minimum of 3 projects over the past 5 years.

4.1.2 This RFP with Specifications can be emailed or picked up from the Burnet CISD Facilities and Operations office at 802 N. Wood Street, Burnet Texas 78611.

4.1.3 Provide a one year written warranty covering labor and material for all installed work and loose components provided under this contract. The contractor shall be held to repair or replace, at the contractor’s expense, any equipment or materials found to be defective within one year from the date of substantial completion of the project.

4.1.4 All work will meet all local, state and federal codes governing such work and where required it will be the responsibility of the contractor to obtain any required permits and pay any permit fees. If the location of the work is not within an incorporated municipality, then all work is to meet the latest editions of the International Building Code, Fire Code, Electrical Code, Mechanical Code, and Plumbing Code.

4.1.5 Prior to receiving payment for the work under this contract, the contractor shall provide Burnet CISD with full releases of liens from all suppliers and subcontractors that provided labor and/or materials for this project.

4.1.6 Clean Up

4.1.6.1 Work areas will be maintained in a clean and orderly condition. All work related debris will be cleaned up and hauled away immediately after each work cycle.

4.1.6.2 Final clean up will be inspected and approved by the district prior to any acceptance by district as substantially completion.

4.1.7 General Requirements

4.1.7.1 Contractor will provide all labor, equipment and materials required to facilitate the successful completion of the work herein stated. All materials furnished must be new and the best of their respective kinds, unless otherwise specified.

4.1.7.2 Pricing will be for all labor and materials to complete the entire scope of work as defined herein and as may be implied in this and other sections of this RFP.

4.1.7.3 The district may extend or compress the requirements of services at the district’s sole discretion.

4.6 The Burnet CISD will not be responsible for any work done beyond the scope, detail and/or intent of information as stated on an authorized purchase order.

5.0 SELECTION PROCESS AND CRITERIA

5.1 The district will select the qualified Contractors that it determines best meets the needs of the school district by requesting proposals under the

5 5/7/2018 Burnet Middle School Sound Systems Competitive Proposals procedures of the Texas Education Code, Section 44.031(a)(2). The District will select the qualified provider by evaluating the proposals on the following criteria:

5.1.1 Vendor’s ability to offer a total solution;

5.1.2 The extent to which the goods or services meets Burnet CISD’s needs;

5.1.3 General reputation and performance of the qualified providers;

5.1.4 Long term cost and value to Burnet CISD to acquire the vendor’s goods or services;

5.1.5 Quality of the products proposed;

5.1.6 Substantial conformity with the specifications and other conditions set forth in the request for proposals;

5.1.7 Time specified in the proposals for the performance of the contract

5.1.8 Costs of application;

5.1.9 Any other factors the district deems necessary.

6.0 PROPOSAL FORMAT

6.1 All proposals should include the following information and be organized in a similar manner. Label sections so that information shall be found quickly.

6.2 Provide the following main headings and respond with all the following information.

6.2.1 Proposal Bid Form

6.2.1.1 A proposal form is attached within the specifications.

6.2.2 Explanation of techniques and methods.

6.2.2.1 Give a detailed description of how your firm will address the scope of work requested as proposed.

6.2.2.2 List any sub-contracted areas of services required under this proposal.

6.2.3 Experience

6.2.3.1 Demonstrate your company’s knowledge and expertise with projects of a similar nature. Provide four (4) references that have used your company’s products and services complete with names and phone numbers of contacts.

6.2.4 Other Benefits

6.2.4.1 Provide any other benefits that your company shall create or provide as part of this project.

7.0 Pricing (Bid Form)

7.0.1 All prices will include any applicable charges and any required permitting.

7.0.2 The District is exempt from Federal Excise Tax, State and Local Tax. Do not include taxes in the proposal. If it is determined that tax was included in the proposal, it will not be included in the tabulation or any award of contract. Tax exemption certificates will be furnished upon request.

7.0.3 Pricing will be communicated on the proposal response form as lump sum pricing for all services requested with no exclusions.

8.0 Contract Provisions

8.1 In addition to provisions defining a sound and competent procurement contract, Burnet C.I.S.D. will require the following contract provisions or conditions in the final contract. These provisions will apply if approval to proceed is granted through the simple issuance by the District of a purchase order and a letter granting notice to proceed just as if these provisions were part of a more formal contract document.

8.1.1 The contract will allow for administrative, contractual or legal remedies in instances where contractors violate or breach contract terms, and it will provide for such sanctions and penalties as may be appropriate.

8.1.2 The contract shall contain suitable provisions for termination by the district and will include the manner by which it will be affected and the basis for settlement. The contract shall describe conditions under which it may be terminated for default as well as circumstances beyond the control of the contractor.

8.1.3 The contract shall contain a provision requiring compliance with executive order 11246, entitled “Equal Employment Opportunity”, as amended by executive order 11375, and as supplemented in the Department of Labor Regulations (41 CFR Part 60)

8.1.4 .The contract shall include a provision for compliance with the Copeland “Anti-Kickback” Act (18 USD 874) as supplemented in the Department of Labor Regulations (29 CFR, Part 3). HB 914, passed by the Texas Legislature, and went into effect on January 1, 2006. This legislation requires vendors who propose or contract to do business with Burnet Consolidated Independent School District to complete and submit a vendor form, Form CIQ, to disclose a person’s affiliations or business relationships that might cause a conflict of interest to Burnet CISD. This extends to officers of the school district and the officer’s parents, spouse, and children. In addition, this legislation includes employees recommending contracts or consultants recommending contracts.

Specific information pertaining to this legislation can be found on the Texas Ethics Commission website at www.ethics.state.tx.us/whatsnew/conflict_forms.htm.

8.1.5 The contract shall include a provision for compliance with Section 103 and 107 of the Contract Work Hours and Safety Standards Act (40 USC 327-330) as supplemented by the Department of Labor regulations (29 CFR, Part 5).

8.1.6 The contract shall recognize and agree to comply with mandatory standards and policies set by or on behalf of Federal, State or Local authorities as may be require under this project.

8.1.7 A payment bond maybe required for projects over $25,000.00 in cumulative value and a performance bond is required for projects with a cumulative value of $100,000.00.

8.1.8 Contractor agrees that it will cause work which is to be performed at the premises to be done in such a manner and by such Contractor Employees so as to maintain harmonious labor relations with the other contractors and/or labor employed by district at the Premises. Contractor shall work in conjunction with all other trades and cooperate with the district's representative in charge of the job by keeping all work areas clean and free of debris on an ongoing basis and, upon completion, shall clean the same thoroughly and remove any and all rubbish and debris resulting from such work.

8.1.9 Before entering into an agreement with the district, a person or business must give notice to the district if the person or an owner or operator of the business has been convicted of a felony. The district may terminate an agreement with a person or business if the district determines that the person or business failed to give such notice or misrepresented the conduct resulting in the conviction. The district must compensate the person for services performed before the agreement terminated. Education Code 44.034

9 5/7/2018 Burnet Middle School Sound Systems 8.1.10 The Contractor will be responsible for performing criminal history background checks on any employee assigned to work on district property. If the company obtains criminal history record information indicating that a person it employs or intends to employ has been convicted of a felony or a misdemeanor involving moral turpitude, the company may not, without the permission of the Board, employ that person.

8.1.11 Insurance

8.1.11.1 General Liability

8.1.11.1.1 $1,000,000.00 per occurrence

8.1.11.2 Workers Compensation – provide to limits required by State of Texas requirements.

8.1.11.3 Builder’s Risk – provide in the amount of the contract sum.

8.1.11.4 Include proof of insurance with proposal submission.
