MINUTES OF COLLIN COUNTY BAIL BOND BOARD

February 23, 2006

The regular meeting of the Collin County Bail Bond Board was called to order by Assistant Chief Deputy Randy Clark on Thursday, February 23, 2006 at 12:00 PM at the Collin County Sheriff’s Office, Detention Briefing Room, 4300 Community Ave, McKinney, Texas.

MEMBERS PRESENT:

AGENDA:

1. Approval of January Minutes. Minutes for January were reviewed. Motion made by Judge Oldner to approve minutes. Seconded by Judge Stevenson. Motion carried. 2. Discussion/Action regarding renewal application for Wynn Dillard d/b/a Doc’s Bail Bonds. Mr. Dillard was present and addressed the board from the podium. Judy Blazier advised that Mr. Dillard was clear with regard to the Clerk’s Office. Mr. Davis advised that the application was in order. Mr. Weaver made a motion to approve the application for a 3-year renewal. Judge Lewis seconded. Motion carried.

3. Discussion/Action regarding license expiration dates. Mr. Dillard addressed the board and suggested that the board consider making it standard that all licenses expired on the last day of the month of issuance. After discussion regarding whether the Occupations Code would permit such action, Judge Stevenson made a motion that the item be tabled until the March meeting so that Mr. Davis could provide the board with research regarding the matter. Judge Oldner seconded. Motion carried.

4. Discussion/Action regarding proposed local rule regarding Ethics and Disclosure of Financial Interest. The board was provided with drafts of proposed local rules and discussed some further revisions to the drafts. Mr. Weaver made a motion to table the item until March. Mr. Dillard seconded. Motion carried.

5. Discussion/Action regarding proposed revision to Application, Renewal Application and Local Rules and Regulations requiring the $500.00 renewal/application fee must be in the form of either a Cashier’s Check or Money order payable to the Collin County Clerk. Chief Clark and Ms. Callies discussed with the board the benefits of accepting only cashier’s check or money orders for fees. Mr. Dillard advised that he didn’t think that cashier’s checks or money orders would be a problem. Judge Oldner made a motion to revise the language of the documents to reflect that only cashier’s checks or money orders will be accepted. Judge Stevenson seconded. Motion carried.

6. Discussion/Action regarding new requirements for issuance of Certificates of Deposit to Collin County for bail bond security. Ms. Dugger advised the board that, in an effort to comply with the Patriot Act, several banks out of the area have recently been requesting personal information from employees of the Clerk’s Office before the issuance of Certificates of Deposit. Ms. Dugger advised that the employees will not provide the information and there have been recent instances of newly approved companies experiencing some delays in the issuance of the CD’s and the Clerk’s Office wanted to make the board aware of the issue. No action was required or taken.

Judge Oldner excused himself from the meeting.

7. Discussion/Action regarding legal options and issues in litigation styled Mike Armstrong vs. Collin County Bail Bond Board, Cause No. 380-00758-05. Mr. Davis advised that the matter is on appeal and he will file a response upon the receipt of Mr. Armstrong’s appellate brief. No action was required or taken.

8. Discussion/Action regarding legal options and issues in litigation styled Patrick Kinnard d/b/a Bail Bonds Unlimited as agent for Continental Heritage Insurance Company, Cause No. 416-3361-03. Mr. Davis advised that he participated in oral arguments on January 24 and is awaiting an opinion from the Dallas Court of Appeals. No action was required or taken. A motion to adjourn was made by Judge Stevenson. Seconded by Ms. Sheldon. Motion carried. There being no further business the meeting was adjourned until March 30 23, 2006.
