CRIMINAL ACTION PRE-TRIAL ORDER

The attached "Criminal Action Pre-Trial Order" shall apply upon the arraignment of every criminal defendant entering a plea of Not Guilty. IN THE SUPERIOR COURT OF WILCOX COUNTY STATE OF GEORGIA

IN RE: Criminal Cases

STANDING PRE-TRIAL ORDER

In all criminal cases, upon arraignment and a plea of ANot Guilty@ having been entered by the Defendant, IT IS HEREBY ORDERED AS FOLLOWS:

1. DISCOVERY: If Defendant has elected to have Article I of Chapter 16 of Title 17 apply to his or her case as provided by O.C.G.A. ' 17-16-2(a), all applicable discovery shall be served by both the State and Defendant within 30 days from the date of arraignment.

2. MOTIONS: The State and Defendant shall file all pre-trial motions, including demurrers, special pleas and motions requesting mental or psychological evaluation, within 10 days from the date of arraignment. If the opposing party wishes to file a written response to any motion or pleading, all responses are due within 10 days after the motion filing deadline. Any party filing such motion or pleading shall provide the Court with a copy of same when filed. Jackson-Denno hearings will not be routinely conducted by the Court unless the admissibility of Defendant=s statement is challenged by motion in writing.

3. MOTION HEARINGS: All motions filed pursuant to Paragraph 2 of this Order shall be scheduled with/by the Court so as to prevent any unnecessary delay.

4. STATUS CONFERENCES: The Court shall hold a status conference on each defendant=s case at the next regularly scheduled call of the criminal trial calendar immediately following the date of arraignment. The State and Defendant should be prepared to inform the Court as to any matters remaining to be resolved prior to the placing of this case on the trial calendar ready list. Defendant shall attend the status conference unless otherwise directed by the Court.

A copy of this Standing Pre-Trial Order shall be provided to each defendant or his/her attorney at the time of arraignment.
