The regular meeting of the Board of Supervisors, held at the Township Municipal Building, was called to order by Chairman Greg Happ at 7:30 P.M. Present were Vice Chairman Duane Rape, Supervisors John Nowicki, Brian Giles and Fritz Retsch. Also present were Manager Walter Beighey Jr., Secretary Patricia Pfaff, Treasurer Elois Nadzak, Chief Ronald Leindecker, Road Foreman Tom Milligan, Engineer Jim Culler, Amy Moldovan, Stephen Wolff, Robert Tatko, Mike Guraly, Buddy Meade, Tom Applequist, Katelynn Ziter, Chris Ziter, Dan Swartz, Albert E. Horn, Lisa Lewis, Lisa Bauman, Dave Bauman, Don Hadfield, John Hayes, Debbie Ruckert, Ken Ruckert, Chris Koop, Larry Hough, Casey Bowers, Melva Devin and Tom Devin

PLEDGE The Pledge of Allegiance was recited.

MINUTES Motion by Rape, seconded by Giles, to approve the minutes of the July 11, 2017, meeting as written. Vote of 5 to 0 in favor.

BILLS Motion by Nowicki, seconded by Retsch, to pay the bills from the General Account, July 12th through July 31st for $62,639.59 and as of August 1st for $160,933.14 with the signing of the checks following the meeting. Vote of 5 to 0 in favor.

PUBLIC Chairman Happ advised that if anyone had any comments on the COMMENT Township’s MS4 (Municipal Stormwater) or on the proposed Pollutant MS4/PRP Reduction Plan this would be the time to speak. There were no comments or questions on either plan.

RUCKERT Debbie and Ken Ruckert, 1513 Pine Run Road, reported they have contacted the Township office twice because of a drainage problem at their driveway. She said to date, no one has come to take care of it or returned their call. Road Foreman, Tom Milligan, said the problem is coming from their neighbor’s property. He explained that when the road was paved 20 years ago, the Township agreed to install the pipe at his driveway due to the high grade caused by the paving. He said there was an agreement that after the pipe was installed, it would be the property owner’s responsibility to maintain it. Tom said he spoke to the neighbor last year and told him that if he would locate the pipe, the Road Department would come clean it out. Mr. and Mrs. Ruckert were not aware of this. It was suggested that they talk to their neighbor and ask him to locate the pipe.

HEARING Motion by Rape, seconded by Retsch, to authorize the Solicitor to PENNENERGY advertise a Public Hearing to be held on August 22, 2017, at 6:30 COND USE p.m., for PennEnergy’s Conditional Use Request and to advertise a Supervisor's Meeting August 1, 2017 Page 2

Special Meeting for general purposes immediately thereafter. Vote of 5 to 0 in favor.

SPECIAL Motion by Rape, seconded by Giles, to authorize the Solicitor to MEETING advertise the proposed Zoning Ordinance for enactment at the August 22, 2017, Special Meeting. Vote of 5 to 0 in favor.

COUNTY Chairman Happ reminded the Board of County Convention on August CONVENTION 10th at the Community College of Beaver County.

EAGLE SCOUT Motion by Retsch, seconded by Rape, to send a congratulatory KANSCHAT letter and certificate to Jordan Kanschat, for receiving the prestigious honor of Eagle Scout. Vote of 5 to 0 in favor.

EXONERATE Motion by Rape, seconded by Nowicki, to sign Cheyenne BITTENBEND Bittenbender’s request for exoneration of taxes in the amount of $1,742.53 for property located at 224 Bud Lane, Penn Hills Mobile Home Park. Repository of Unsold Properties parcel number 69-155- 0170-924, Art and Kari Stewart is the reputed owners. Vote of 4 to 1 in favor. Retsch voting NO.

POLICE Supervisor Rape advised a contract agreement has not yet been CONTRACT reached with the Police Bargaining Unit. He explained that the CHIEF Police Chief’s contract rides piggy back with the Bargaining Unit and that whatever the Bargaining Unit receives the Chief automatically receives. He informed the Board if they wanted to reopen the Chief’s agreement, they are required to notify him three months in advance.

Supervisor Rape made a motion to notify Chief Leindecker that the Board of Supervisors are going to reopen his contract. Motion FAILED for lack of second.

Supervisor Rape asked the Board what their reason was to not want to reopen the Chief’s contract. He said that they have no idea what the Bargaining Unit will receive if they end up going to arbitration. He said he feels this is an injustice to the residents.

MONTHLY Chief Leindecker read his department’s monthly report for July REPORT 2017, which included the number of police calls, vehicle maintenance, arrests and citations issued.

TRAINING The Chief reported that the department is currently participating in a multi jurisdiction training being held at the Freedom School District.

BKFD P.J. Moldovan, Big Knob Fire Department, submitted to the office a written report for July 2017, which included the number and type of calls they responded to.

PRFD Mike Guraly, Pine Run Fire Department, read their monthly report for July 2017, which included the number and type of calls they responded to. Supervisor's Meeting August 1, 2017 Page 3

BKFD Manager Beighey advised that Big Knob Fire Department would like ALARMS to talk to the Supervisors regarding the continuous problems with the commercial fire alarms. The Board also mentioned that they would like to meet with Big Knob Fire Department to discuss the alarm situation and also the use of the SUV that they purchased. It was agreed to have two supervisors meet with them on August 11th at 10:00 am.

ROAD DEPT Road Foreman Tom Milligan advised that Conway Borough did not TRUCK purchase the 2002 Chevy 3500 truck. 2002 Motion by Giles, seconded by Retsch, to place the vehicle on Municibid with a starting bid of $500.00. Vote of 5 to 0 in favor.

INTER’L Tom reported that he picked up the International Truck from TRUCK Hunter’s. He said they replaced EGR cooler and head gasket. Hunter’s is to supply the Township with a detailed list of what was done to the vehicle. Manager Beighey reported that Solicitor Paul Steff said to go ahead and drive the truck and a letter will be sent to Hunter’s advising them of our displeasure with all the problems that we have had with the truck and what Hunter’s responsibility is.

PAVING Tom updated the Board on all the road paving projects that were completed in the past two weeks.

LINE Motion by Rape, seconded by Retsch, to obtain quotes for road PAINTING striping on the following roads; Blackswoods, Fezell, one half of Klein, Miller, Teets and Pine Run for a total of 8.57 miles. Vote of 5 to 0 in favor.

LOAN Manager Beighey asked the Board if they wanted him to apply for the loan for only the new building at $720,000.00 or if they wanted him to include another $50,000.00 in the loan amount for stormwater management portion of the project. Motion by Nowicki, seconded by Retsch, to authorize the Engineer to write a stormwater program for the new building and include it in the loan. Vote of 5 to 0 in favor.

CROWS RUN Road Foreman Tom Milligan, wanted it on record that when the Crows Run Road Project is completed, that he does not want the Township to take over any additional roads.

ENGINEER Township Engineer reported on his review of the following:  PennEnergy’s proposed Grange Road Improvement Project.  PennEnergy’s Provisional Conditional Use Application for a Freshwater Impoundment on the Fritsch Farm.  Submitted written comments on his review of the Young/Muron Consolidation Plan.  The Smith/Gardner Subdivision & Consolidation Plan – submitted written comments. PLANNING Motion by Rape, seconded Nowicki, to approve the Smith/Gardner SMITH Subdivision, contingent upon the finalization by the surveyor. GARDNER Vote of 5 to 0 in favor.

YOUNG/MURON Motion by Rape, seconded by Nowicki, to approve the Young/Muron Consolidation Plan contingent upon favorable comments from the Beaver County Planning Commission. Vote of 5 to 0 in favor.

RECREATIONLisa Lisa Bauman, Chairman of the Recreation Board, reported on what a COMMUNITY success Community Day was. DAY

TOILETS Motion by Retsch, seconded by Nowicki, to authorize the purchase PARKING of two toilets for Green Valley Park from Double Rocky Mountain at a total cost of $90,045.70 with the payment to be taken form the gas lease fund and wait until a later date to construct the parking lot. Vote of 4 to 1 in favor. Rape voting NO.

Supervisor Rape said that he agrees the toilets are a good idea, but with the budget and the money as is, he cannot support it.

ZONING The Supervisors received a copy of July’s monthly building permits and Zoning report.

BOARD Supervisor Retsch thanked the Recreation Board, office staff and COMMENTS anyone who was involved with community day. He said what a successful day it was.

ADJOURN Motion by Retsch, seconded by Nowicki, to adjourn. Meeting adjourned at 8:30 p.m. Vote of 5 to 0 in favor.
