MINUTES BOARD FOR PROFESSIONAL ENGINEERS

CALL TO ORDER
Mr. Melvin Hotz, Chairman, called the meeting to order at 9:05 a.m.
ACTION ON MINUTES
Motion (I) was made by Ms. Yee, seconded by Dr. Szego, and unanimously carried by the Board to approve the Minutes of the May 15, 2002 meeting with corrections.
COMPLAINT COMMITTEE REPORT
Mr. Harvey provided the following report on the status of complaints and license reinstatement issues discussed by the Complaint Committee at its meeting on June 11, 2002.
00-PE-07: Defendant paid $3,000 fine. Thirty day suspension of license is now in effect. The Complaint Committee recommends that this case be closed.
01-PE-02: Consent Order was sent offering six months probation and the submission of quarterly reports. Reply has not been received. If reply not received by the end of June, the Complaint Committee recommends that license renewal be denied. Board for Professional Engineers Minutes – June 19, 2002 Page 2
01-PE-06: Defendant’s file has been forwarded to the Attorney General’s office for referral to the State’s Attorney. Defendant has been so notified. This case may be closed. 02-PE-09: No appeal has been forthcoming from respondent after he was notified that his license renewal was denied. The Complaint Committee recommends renewal of this respondent’s license be denied and the case be closed.
Two additional cases were reviewed by the Complaint Committee for late renewal of license. In the first case, the respondent’s license was lapsed for three renewal periods. The respondent had not signed or sealed any projects in the State of Maryland during this time and was continuously licensed in other states. The Complaint Committee recommends that the respondent’s license be renewed and that he be sent a warning letter.
The second case involves a respondent whose license was lapsed for two renewal periods during which time he signed 17 projects in the State of Maryland. The Complaint Committee recommends that the respondent’s license be denied for renewal and that he be offered a Consent Order and $2,000 fine.
Motion (II) was made by Dr. Szego, seconded by Mr. Evans, and unanimously carried by the Board to accept the recommendations of the Complaint Committee as stated above.
ABET COMMISSIONS REVIEW
In view of the Accreditation Board for Engineering and Technology, Inc.’s (ABET) new Commission, Computing Accreditation Commission (CAC), the Board decided to conduct a review to determine if it should accept graduates whose degrees are accredited by this Commission to take the Fundamentals of Engineering (FE) exam.
Ms. Hunt reported that she has been in contact with Daniel Hodge, Accreditation Director Accreditation Board for Engineering and Technology, Inc. (ABET), and provided the following information. Thre are four ABET Commissions: Engineering Accreditation Commission (EAC), formed in 1932, to accredit engineering programs; Technology Accreditation Commission (TAC), formed in 1964 to accredit engineering technology programs; Applied Science Accreditation Commission (ASAC), formed in 1983 under the name Related Accreditation Commission (RAC) to accredit programs closely related to engineering, e.g., Industrial Hygiene, Safety, Surveying (the name of this Commission was changed from RAC to ASAC in 2001); and Computing Accreditation Commission (CAC), formed in 1985 to accredit Computer Science programs under the Computing Sciences Accreditation Board (CSAB). This Board was separate from ABET. In 2002, this Commission was fully integrated into ABET and CSAB ceased to accredit programs.
Board for Professional Engineers Minutes – June 19, 2002 Page 3 Mr. Hodge advises that some states do permit graduates of TAC-accredited programs (as well as graduates of EAC-accredited programs) to take the Fundamentals of Engineering (FE) exam; however, this is not uniform across the nation. He further states that generally graduates from ASAC-or CAC-accredited programs should probably not be routinely considered for the FE exam, but this would be a Board decision.
After discussion, the Board determined that the Engineers’ Law states that the Board accepts programs “approved by the Board.” The Board has adopted EAC-ABET standards. Ms. Hunt noted that Computer Engineering has not been moved over to EAC. She will make further recommendations to the Board after additional study on this issue.
LEGISLATIVE INITIATIVES
Ms. Trust reported that she was informed by the Department that the Engineers’ Law Clean-up bill, which was withdrawn last year, will be resubmitted for consideration in the next legislative session.
Ms. Trust advised that the Land Surveyors’ Board has proposed a law change for the 2003 legislative session to eliminate the Limited License. Similarly, there have been various discussions at NCEES level and it appears that many states have also decided to delete the Limited License from their statutes. Ms. Trust stated that since the Engineers Board has previously discussed the possibility of eliminating the Limited License, this may be a good time for the Board to take action, in keeping with uniformity with the Land Surveyor’s Board. After discussion, Motion (III) was made by Mr. Evans, seconded by Mr. Harvey, and unanimously carried by the Board to eliminate the Limited License from the Professional Engineers’ Law, Section 14-316. This section would be eliminated entirely.
Ms. Trust will incorporate this change in the Engineers’ Law Clean-up bill for the FY 2002 Legislative Session.
CITATION TO MR. ROBERT EVANS, P.E., BOARD MEMBER
Assistant Secretary, Mark Feinroth, presented Board Member Robert Evans with a Governor’s Citation for five years of devoted service to the Professional Engineers’ Board. Mr. Feinroth thanked Mr. Evans and stated that he has served the Board and the people of Maryland with exceptional professionalism. Mr. Evans thanked Mr. Feinroth and stated that he would have stayed on with the Board had it not been for work obligations.

Letter from Earl R. Reed, P.E., dated May 30, 2002
The Board reviewed a letter from Earl R. Reed, P.E., City of Frederick, dated May 30, 2002, requesting the Board’s opinion on what constitutes the “practice of engineering,” and who legally can “practice engineering,” as pertains to certain employees of the City of Frederick. After review and discussion of Mr. Reed’s letter, the Board determined that in some instances employees of a municipality may be exempt from licensing requirements that would otherwise be applicable if services were rendered by individuals employed by private entities. Further, unless the City of Frederick has a local law in place in the form of an ordinance, resolution, etc., that specifically requires certain positions to be filled by a professional engineer, the City of Frederick employees may perform engineering services without a professional engineer’s license as long as they are supervised by a licensed professional engineer. Ms. Trust will respond to Mr. Reed.
Letter from the Army Corp of Engineers
Ms. Trust reported that she had received a letter from the Army Corp of Engineers stating that someone at the State, although unable to name which office, had advised them that the County had to stamp and seal in-house documents. Ms. Trust will reply to this correspondence and advise the Army Corp of Engineers that the State Law does not require employees of the Army Corp of Engineers to seal in-house documents.
NEW BUSINESS
Exam Update
Ms. Wingo reported that pass/fail letters for the Fundamentals of Engineering examination were sent out on Friday, June 7. Results for the Principles and Practice of Engineering examination were just received and will be processed and sent out by Wednesday, June 26.
Chairman’s Report
Mr. Hotz reported on the following:
The Design Board Chairmans’ Meeting was held on June 5, 2002. Topics of discussion were the Surveyors’ Board plan to propose a law change to delete Limited Licenses, and a proposal to members from each Design Board to develop an agenda and information Board for Professional Engineers Minutes – June 19, 2002 Page 5 for a training workshop for county officials and permitting agencies in October 2002, for the Maryland Municipal League’s fall meeting.
The April NCEES examination Report No. 5 should be distributed by next month. Our Board has elected to receive the reports for distribution to the schools. At the May Board Meeting, the Board discussed the possibility of inviting the Deans of the Engineering Schools to a Board meeting at which time Report No. 5 would be given to them. Mr. Hotz suggested inviting an NCEES staff member to give a presentation at the meeting on the use of the Fundamentals of Engineering Examination for “outcome assessment.” He further suggested that the Board hold the meeting at one of the universities and invite the Engineering Department heads as well as the Deans, and asked the Board Members to talk to the various Engineering School Deans to locate a possible meeting location. Mr. Hotz stated that Report No. 5 is an especially valuable report because the Deans can evaluate their school’s outcome against the rest of the country. The Board will discuss this issue at future meetings and outline a meeting plan.
Mr. Hotz stated that the Board should continue to review: 1) experience credit for advanced degrees (more than one year); 2) a requirement for a college degree for those applying for licensure under Section 14-305(d); and 3) the possibility of beginning to plan for continuing education for license renewal.
Mr. Hotz attended a Task Force meeting on examination security as liaison to the NCEES Board of Directors. He reported on various issues related to exam security, such as, cheating in examinations, individuals paid to steal examination information, and devices used to copy the examination.
