DOCK/RACK STORAGE RULES AND REGULATIONS

1. Slip and rack storage assignments are available ONLY to owners and renters of the South Seas residential condominium units.

2. South Seas Club will assign slips or storage racks according to availability. A CURRENT, SIGNED LEASE MUST BE ON FILE ALONG WITH A COPY OF THE BOAT REGISTRATION AND PROOF OF INSURANCE. Subleasing or reassignment of a lease by a lessee is prohibited.

3. Present lessee has priority of lease renewal of the facility currently leased for a future period. This priority expires 30 days after the end of the Lessee’s current lease. If Lessee wants to lease a specific slip or rack for a specific time period, payment must be made in full to hold that slip or rack.

4. There will be NO REFUNDS under any circumstances other than the sale of the owner’s condo. Refunds will be pro-rated as of the date of the real estate closing. Also, splitting of months for slip or rack rental or pro-rated rentals is prohibited.

5. Dock facilities are designed to accommodate boat lengths according to the limitations shown below. Boat length will be defined as being the total length of the boat including the motor in its lift position, bow pulpit, and any other accessories added to the bow or stern. Class C slips are reserved for boats that will not fit into a Class A or B slip. Refer to the respective illustration on file of the appropriate class slip for details of the slip usage area.

Class A slips – Up to 25 feet LOA Class B and C slips - In no case may any boat resting in a slip extend beyond three feet past the end of a finger pier in a B or C class slip.

6. When demand for boat slips or kayak/canoe, etc. storage exceeds the current number available, a waiting list of unit owners’ names will be established. When a boat slip or landside storage rack becomes available, owners will be contacted in the order on the waiting list and will have 24 hours to either accept the slip or rack assignment or pass. The rental fee for the facility must be paid at that time to hold the slip or rack storage. Page 1 of 3 7. All boats are to be positioned in a slip bow-in. Spring lines (lines attached to a port and/or starboard midpoint cleat extending fore and aft) or other lines are to be attached to the boat to keep it from contacting the boardwalk or extending past the permitted slip usage (envelope) area. Bow and stern lines should be crossed (if possible) to accommodate for extreme high or low tide conditions. Lines shall be of sufficient diameter and in good condition to properly secure the boat in the slip. 8. No tires will be allowed as bumpers on pilings. No items may be permanently attached to pilings or finger piers. 9. Trash containers for boaters are located outside the Club office. Do not place trash in the containers on the grass, nor use the barbeque facilities or chickees by the boat docks as these are for the residents of South Seas East and South Seas North ONLY. 10. Vehicles of boat owners may not be parked in the lots of East or North unless the owner is a resident of a unit in one of these Associations. Access to the boat docks is by way of the South Seas Club office patio. Do not walk across the lawns of East or North to reach your boat slip. 11. Storage of boats or kayaks is prohibited on the floating docks. No boat is to be left unattended at any of the floating docks. 12. Docks and finger piers are to be kept clear of all loose objects such as buckets, towels, nets, etc. If storage is necessary, utilize dock box or boat. South Seas Club management reserves the right to access dock boxes and modify dock lines if it is deemed necessary by management to maintain safe conditions. Dock boxes shall not be used to store hazardous materials or liquids. Use of a dock box shall run concurrent with the slip lease period. South Seas Club may require a lessee to place a dock box key with Club management to permit inspection of dock box contents. 13. Cleaning of fish is only permitted from the back of a boat or at an approved cleaning station. Debris tubes are located at the end of finger piers and shall be used to dispose of the fish remains. Cleaning fish on a dock box is prohibited as it may damage the boxes, and it causes pelicans to gather around the Boardwalk. 14. Commercial fuel delivery to boats is prohibited. 15. Lessee shall not relocate a ladder or modify electric or water supply lines or fixtures or drill holes in the deck boards. Dock ladders are to be kept in the upper position when not in use and fresh water washed after contact with salt water. 16. It is the responsibility of the boat owner to properly secure or make provisions to prevent their boat from damaging the South Seas Club facilities during hurricane, high wind, storm surge, or other hazardous weather conditions. It is strongly recommended that boats in the water be relocated to a landside storage facility prior to the predicted arrival of hazardous weather or high wind conditions to prevent damage to the docking facilities or boat. Any damage to the South Seas Club facilities resulting from a boat damaging the docks, boardwalk, pilings or rack storage will be the responsibility of the boat owner to repair in accordance with specifications of the South Seas Club. Page 2 of 3 17. Use of Boat Lift and Pressure Washer

a. Use of the boat lift and pressure washer is by appointment only and may not be used when the South Seas Club office is not open. b. The use of the lift will be limited to boat cleaning, propeller replacement and similar light work that will not cause the release of fuel or oil into the water. c. Pressure washer must be set on the finger pier on either side of the lift when in use. d. Safety cones need to set on finger piers. e. User to lower the lift to a level just above the normal high tide water line after it is cleaned and washed down with fresh water. f. Users are responsible for any damage to lift, dock or pressure washer. g. South Seas Club or employees are not responsible for any damage to a boat due to the use of these facilities and user will be charged for any damage to the facilities or equipment.

18. Floating Docks – The four (4) floating docks (“A Dock” adjacent to SSEast, “B and C Docks” adjacent to SSC Office, and “D Dock” adjacent to SSNorth) are to be used for transfer of equipment and passengers. Long term or overnight tie-up is prohibited.

“B Dock” is to be used for launching and retrieval of kayak, canoe and other type small watercraft. Long term tie-up or on dock storage is prohibited.

19. Kayak, Canoe, Sailfish Storage – These type watercraft are to be stored on the rack facilities adjacent to the SSC Business and Amenities Office. It is the responsibility of the watercraft owner to properly secure the boat to the storage facility. The South Seas Club is not responsible for damage or theft of these watercraft.

20. Water hoses are to be coiled on the line hook above the hose bibb water supply when not in use.

21. Electric service lines are to be properly secured to the slip and/or boat to prevent contact with the water. Owner electric lines are to be of proper size for the expected load.

22. Violation of these rules or unsafe practices of a lessee will be addressed by the South Seas Club Marine Facilities Committee and the Board of Directors and may result in termination of lease privileges.

23. A South Seas Club Slip Lease Agreement must be executed prior to occupancy or use of a slip or a landside kayak, canoe, or sailfish storage facility.
