2007/08-022 CSEA Memorandum of Understanding (MOU) 15 MOU by and between the Mt. San Jacinto Community College District and the California School Employees Association, Chapter 767 concerning the Administrative Assistant to the Vice President of Student Services and the Administrative Assistant to the Vice President of Instruction positions. The Administration recommends approval.

4.2 BUSINESS SERVICES 2007/08-023 Membership 16 All new District paid memberships are brought before the Board for approval. The Administration recommends that the Board of Trustees approves the American Association of Hispanics in Higher Education (AAHHE) membership.

2007/08-024 Child Development Contract Signature Authorization 17 The Administration recommends that the Board of Trustees approve and certify the signature authorization.

2007/08-025 Approval of Payroll, Purchase Orders, Contracts, and Commercial Warrants 18 The Board of Trustees must authorize and approve all expenditures of the District to comply with applicable education and public contract codes. The Administration recommends approval.

2007/08-026 Contract Agreements 19 The Administration recommends that the Board of Trustees provide authorization to execute the contract agreements.

2007/08-027 Chancellor’s Office Tax Offset Program 21 By contracting with the Chancellor’s Office Tax Offset Program (COTOP), the District can recover outstanding student obligations such as student loans, financial aid overpayments, student fees, library fines and personal checks written with non-sufficient funds. The Administration recommends approval.

2 5.0 OPEN AGENDA 5.1 BUSINESS SERVICES 2007/08-028 Authorization to Form a School Facilities Improvement District 22 The Administration recommends that the Board of Trustees authorize the Interim Vice President of Business Services to research the required process to form a School Facilities Improvement District within the MSJCCD, in particular Trustee Area I.

2007/08-029 Adoption of the 2007-2008 Budget 24 The District has calculated actual ending balances and adjusted revenue and expenditures after the adoption of the Tentative Budget in June. These revisions are included in the budget presented for adoption. The Administration recommends that the Board of Trustees adopt the 2007-2008 budget.

5.2 SUPERINTENDENT/PRESIDENT 2007/08-030 Board Policy Manual – Revisions and Additions 25 MSJC subscribes to The Community College League of California, in partnership with Liebert Cassidy, a California law corporation, Policy and Procedure Service. The MSJC policies included in this item have been revised and updated as required by changing laws and regulations. The Administration recommends approval.

2007/09-031 Mt. San Jacinto College Institutional Progress Report – October 2007 26 MSJC’s accreditation was reaffirmed by the Accrediting Commission for Community and Junior Colleges, Western Association of Schools and Colleges on January 31, 2006. The college was required to submit a progress report on recommendations 2, 3, and 5. The report is due October 15, 2007. The Administration recommends approval.

6.0 COMMENTS OF INDIVIDUAL, GROUPS, DELEGATIONS Public comments may address any item of interest to the public, other than agenda items, that are within the subject matter jurisdiction of the college. Comments shall be limited to five (5) minutes per speaker and twenty (20) minutes per subject unless further time is granted by the Board of Trustees.

7.0 INFORMATION AGENDA 7.1 SUPERINTENDENT/PRESIDENT A. Donations to the Foundation 27 Each month the Mt. San Jacinto Foundation reports to the Board of Trustees a list of people and organizations that have made donations of money or items of value to the Foundation.

3 7.2 HUMAN RESOURCES A. Student Services Reorganization 29 Student Services is in the process of reorganizing the department to support the continued enrollment growth throughout the District. In addition to the information previously provided to the Board, a brief summary of the planned actions are addressed in this item.

B. Police Personnel 30 MSJC’s continued enrollment growth and increased operational hours has made it necessary to augment our police coverage. The October board agenda will include a request for two additional campus security officers and one additional sworn police officer.

C. Sports Information Officer 31 The Athletic Department is proposing a new part-time classified Sports Information Officer to maintain student and team statistics, meet reporting requirements that are due to the Commission on Athletics, assume responsibilities for the athletic web page content, write press releases for our 10 intercollegiate teams and create media guides and recruitment materials.

D. CTA Bargaining Proposal for Academic Year 2007-08 32 Pursuant to GC 3547, the District was provided the attached Faculty Association (CTA) proposal to open negotiations for the academic year 2007-2008.

BACKGROUND

A. Alternative Schedules

Pursuant to Education Code Section 88026, which states in part that the governing board may “exempt specific classes of positions from compensation for overtime in excess of eight hours in one day, provided that hours worked in excess of 40 in a calendar week shall be compensated on an overtime basis and that such exemption shall be applied only to those classes which the governing board…specifically find to be subject to fluctuations in daily hours not susceptible to administrative control.” Additionally, the District and California School Employee Association (CSEA) have met and conferred on the District’s implementation of this Education Code Section, and have agreed to maintain open communications regarding the specific classifications affected and the rationale for the alternative schedules.

In accordance with the cited Education Code and the agreement between the District and the CSEA the following alternative work schedules and classifications are hereby submitted. The specific classifications, working these alternate schedules will be exempt from overtime for hours worked in excess of 8 hours in any single workday but would receive overtime for any hours worked in excess of 40 for the calendar week.

Schedules: All schedules include either an hour or one-half hour unpaid lunch break.

New Positions – Business Services

1. Network Technology Supervisor, MVC/SJC 40 hours per week/12 month position

The computer infrastructure at Menifee gains in complexity as buildings and services are added. The numbers of supported desktop computers increase with the addition of faculty and staff working from the campus. This position is necessary to ensure quality of computer and data services and to supervise information technology personnel at the Menifee campus.

9 2. Facilities Assistant I, MVC 40 hours per week/12 month position

This position is needed due to an increase in student enrollment at the Menifee Valley campus, of 17.1% in Fall 2006 and an additional 13.13% in Fall 2007. Also, the completion of the Business & Technology Center, the Faculty Office Modular and the Classroom Modular facilities in Fall 2007 for a total of 38,100 additional gross square feet. A Custodial position is required in order to provide a safe and clean learning environment for students, faculty, and staff and to ensure that the District meets State of California mandates for facilities usage.

3. Facilities Assistant III, MVC 40 hours per week/12 month position

This position is needed due to the increased student population at the Menifee Valley campus which has amplified the amount of trash and other items typically responded to by a grounds worker such as food and liquid spills, tripping hazards, etc. The increase of hardscaped and landscaped areas relating to the new facilities noted above as well as the addition of a soccer field has enlarged the service area of the two existing grounds workers beyond what is manageable.

Memorandum of Understanding and Agreement by and between Mt. San Jacinto Community College District and California School Employees Association, Chapter 767

BACKGROUND:

Whereas Government Code section 3540.1 defines a confidential employee as…”any employee who is required to develop or present management positions with respect to employer-employee relations or whose duties normally require access to confidential information that is used to contribute significantly to the development of management positions.”

Whereas the District and CSEA understands and agree that, the Administrative Assistant to the Vice President of Student Services and the Administrative Assistant to the Vice President of Instruction will have access to or possess confidential information.

Therefore, by affixing their signature to the attached MOU, the CSEA expressly and without reservation of rights agrees that these positions are not within the scope of the parties’ collective bargaining agreement and excludes them from the Unit as classified positions.

SUPERINTENDENT/PRESIDENT’S RECOMMENDATION:

It is recommended that the Board of Trustees confirm the re-designation from classified hourly position to confidential positions described in the attached MOU.

BACKGROUND:

By contracting with the Chancellor’s Office Tax Offset Program (COTOP), the District can recover outstanding student obligations such as student loans, financial aid overpayments, student fees, library fines, and personal checks written with non-sufficient funds.

The COTOP program requests the Franchise Tax Board to offset (deduct) the amount owed to a District from the student/debtor’s personal state income tax, lottery winnings or other state refund. Any amounts offset are remitted by the Franchise Tax Board to the Chancellor’s Office, which authorizes the State Controller to disburse the offset amount, minus a 25% administrative fee, to the participating local districts.

The District has participated in this program since fiscal year 2000-2001.

SUPERINTENDENT/PRESIDENT’S RECOMMENDATION:

It is recommended that the Board approves the District’s continued participation in the COTOP program for 2007-08.

BACKGROUND:

It is requested that the Mt. San Jacinto Community College District Board of Trustees authorize the Interim Vice President of Business Services to research criteria needed to form a School Facilities Improvement District within the Mt. San Jacinto Community College District, in particular Trustee Area 1. Trustee Area 1 comprises the largest geographical area of the MSJCCD and includes the San Gorgonio Pass cities of Banning and Beaumont. The Pass area communities have been and are strong proponents of a local Mt. San Jacinto College site. MSJC Administration has been invited to both the Banning and the Beaumont Chambers of Commerce to present to community members and the chambers an outline of necessary criteria to develop a Pass area college presence. The Pass area support group (Friends of MSJC) consists of public officials, chamber members and citizens who have expressed the strong desire to back a special bond election in support of a campus development on our existing land in the Pass area. This group has asked MSJC administration to request authorization from the Board of Trustees to form a School Facilities Improvement District and proceed with an election to issue bonds for use to construct MSJC educational facilities within the School Facilities Improvement District. Any such election would be held within the boundaries of the School Facilities Improvement District and any bonds approved would be repaid from taxes levied only within such territory.

All information required for this process will be brought back to the Board for further information and direction.

SUPERINTENDENT/PRESIDENT’S RECOMMENDATION:

It is recommended the Board of Trustees authorize the Interim Vice President of Business Services to research the required process to form a MSJCCD School Facilities Improvement District.

BACKGROUND:

In the spring of 2000, Mt. San Jacinto Community College District subscribed to The Community College League of California, in partnership with Liebert Cassidy, a California law corporation, Policy and Procedure Service. The CCLC service provides member districts a comprehensive list of policies and procedures/regulations each district should have on record, samples of each of those board policies and samples of each of the administrative procedures/regulations, and both new and updated policies and procedures as required by changing laws and regulations.

The MSJC policies included in this item for board action have been revised and updated as required by changing laws and regulations. The policy updates and changes have been through the shared governance process and approved by College Council. An information item was placed on the August 8, 2007 Board Agenda and copies of the changed policies were provided to the trustees for their review. A summary of the revisions and additions to the board policy is attached.

BACKGROUND:

January 31, 2006, Mt. San Jacinto College’s accreditation was reaffirmed by the Accrediting Commission for Community and Junior Colleges, Western Association of Schools and Colleges (ACCJC). The Commission certification required MSJC to submit a progress report which requires that the institution provide information, evidence, and analysis regarding the resolution of the issues to which it was directed by the Commissions’ Action Letter of January 31, 2006. The focus of this progress report is Recommendations 2, 3, and 5. The progress report is due to the ACCJC on October 15, 2007 to be followed by a visit of Commission representatives.

An information item was placed on the August 8, 2007 Board Agenda and copies of the report were provided to the trustees for their review. The document has gone through the shared governance process and is being prepared for publication. The final document will be submitted to the Accrediting Commission upon Board approval and available for distribution thereafter.

The following information is in addition to information previously provided to the Board regarding the re- organization of the Student Services division. The following is a brief summary of the planned actions that were taken.

Dean 1. (Dean of Student Support Services: Athletics, Outreach, and Student Life) - This position is moving from an Associate Dean to a full Dean level position to reflect the expanded scope of responsibility for this position. Due to the size of the district and student enrollment growth, this position will now take on responsibility for Student Outreach in the Hemet/San Jacinto area, as well as the Pass area. Additionally this position will be taking on student life and conduct responsibility for the SJC campus. All other duties formerly associated with this position will continue.

Dean 2. (Dean of Student Support Services: Counseling and Guidance) - This position currently exists as a dean and is only having program responsibility shifted to better manage programs and meet student needs.

Dean 3. (Dean of Student Support Services: Categorical Programs and ASB/Student Life) - This position is moving from an Associate Dean to a full Dean level position to reflect the expanded scope of responsibility for this position. Due to the size of the district, the complex nature of our expanding categorical programs, and enrollment growth, this position will now oversee several of the state and federal categorical programs. This position will also oversee the ASB activities for the district and assist with student life and discipline. This dean will also handle special projects and community relations.

Dean 4. (Dean of Student Support Services) - This position currently exists as a dean and is only having program responsibility shifted to better manage programs and meet student needs. A goal of this shift in responsibility is to allow this position to better focus on student outreach into the Southwestern portion of the district.

(It should be noted that the position and resources affiliated with the DSPS Director’s position will be maintained with an interim solution while staffing for that area is further assessed for optimal future effectiveness.)

MSJC’s continued enrollment growth and increased operational hours has made it necessary to augment our police coverage. Currently we are unable to provide adequate sworn police or campus security coverage to support our District needs.

Upon review of the college schedule, incidents on and around our campuses, the immediate need for 7 day per week coverage and our ability to respond to critical incidents or disasters, I will be requesting action to provide one additional sworn police officer and two campus security officers on the October board agenda. This action will allow the MSJC Police Department to provide sworn officer coverage five days a week, 16 hours a day and campus security coverage 7 days a week from 7:00 a.m. to 10:00 p.m. daily. On alternating weekends sworn officers will also rotate on an on-call response basis.

Due to current staffing needs Chief Segawa is forced to personally cover one of the existing shifts, which effectively limits him to a specific campus for a single shift. This will allow Chief Segawa to provide district-wide coverage for police operations, disaster planning and training.

Funds are available and have been budgeted for this position.

The Commission on Athletics new statistical reporting requirements for community college athletic teams requires a great deal of time and effort in order to report and maintain accurate student and team statistics. Given the demands of our coaching faculty, it is neither practical nor efficient to hold them responsible for this task. Therefore, the Athletic Department is proposing a new part-time, 32 hours per week, classified Sports Information Officer position to meet this challenge.

In addition to the above task, the Sports Information Officer will be responsible for the Athletic Department web page content management, Athletic Department press releases covering the college’s 10 teams, and creating media guides and recruitment materials for prospective students/athletes.

Funds are available and have been budgeted for this position.
