I. From the 5/2/13 CIB Minutes:

NEW PROJECTS 7. LaVerkin City (Washington County) LaVerkin City presented a funding assistance request for a $300,000 loan for 20 years at 1.5% interest and a $300,000 grant (total $600,000) for water line replacement and street repairs in Silver Acres Subdivision. This project consists of repairing a failing water line in the subdivision to include installation of a new water line, testing the underground improvements, and restoring the roadway asphalt, curb and gutter.

This subdivision was developed in the 1970’s and apparently sub-par materials were used. As a result, every year there are numerous breaks, water leaks and sinkholes have developed. This project was first presented to the HUD Community Development Block Grant Program (CDBG), but did not receive funding. The public hearing on this project only mentioned the CDBG application; there was no mention of applying for CIB money.

The technical review provided by Nathan Hall noted that the applicant’s average monthly water bill is currently above the 1.75% MAGI guideline for water projects. However, the Board determined to review the application as submitted by the applicant.

Chairman Walker had questions about why a public hearing was not held regarding CIB funding and the fact that this is a subdivision. There was also a concern about the engineering fees.

Jeffery Holt wondered if the homeowners should pay a fee to maintain the roads.

Dennis Drake stated that he doesn’t feel the subdivision maintenance is a big issue, but not having a public hearing is an issue. The public needs to be aware if a loan is pending. LaVerkin Town – Water System Improvements June 13, 2013 page 2

Dennis Drake made and Michael Milovich seconded a motion placing this project on the Pending List as a $300,000 loan for 20 years at 1.5% interest and a $300,000 grant (total $600,000). A Public Hearing must be held and there must be clarification on the engineering fees before this project can move to the Priority List to be considered for funding. The motion carried unanimously.

II. On 5/24/13 the CIB staff received an e-mail letter from LaVerkin Town outlining their actions regarding the issues outlined above and revising the application’s budget information.

I. From the 1/1/13 CIB Minutes:

NEW PROJECTS 6. Long Valley Sewer Improvement District (Kane County) Long Valley Sewer Improvement District presented a funding assistance request for a $2,500,000 loan for 30 years at 0.0% interest and a $4,000,000 grant (total $6,500,000) to reline lagoon No. 4 with a clay liner, adding an additional lagoon, repairing damaged transfer structures and broken pipes and providing new pipes and connections to include 32,000 linear feet of 8” sewer pipe, 8,000 linear feet of 4” sewer pipe, 66 service connections, 100 sewer manholes, river and highway crossing and subsequent road repair.

After some discussion the Board placed this project on the Pending List for consideration at a future CIB meeting.

Issues and concerns raised during the discussion are as follows;

1) The District is requested to explore the possibility of project financing through other sources, particularly the Utah Board of Water Quality (BWQ). 2) Due to the cost of the project and the limited number of system users, it appears the District will have difficulties in servicing a loan for all or a majority of the requested $6,500,000.00 financing. Therefore the District is requested to explore the possibility of financing all or a portion of the project as a general obligation (G.O.) Bond.

Michael McKee made and Robert Bessey seconded a motion placing this project on the Pending List for consideration at a future CIB meeting. The motion carried unanimously.

III. On 5/6/13 the CIB staff received an e-mail from the Long Valley Sewer Improvement District outlining revisions to the application including information regarding participation by the Board of Water Quality on this project.

Vernal City (Uintah County) Vernal City presented a funding assistance request for a $1,078,000 loan for 30 years at 0.0% interest and a $3,232,768 grant (total $4,310,768) to replace 28,800 feet of 60 year old 20” mortar lined deteriorating raw water line with new 24” plastic pipe from the de-sander near the Ashley Spring to an existing ductile iron pipe near the mount of Dry Fork Canyon.

The Board asked the applicant if they could take all loan for this project, particularly in light of Vernal’s relatively low MAGI number as shown in the analysis by Michael Georgeson.

After some discussion the funding request was modified to a $2,155,000 loan for 30 years at 0.0% interest and a $2,155,768 grant (total $4,310,768).

Michael McKee made a motion placing this project on the Priority List for consideration at the February 2, 2012 funding meeting as a $2,155,000 loan for 30 years at 0.0% interest and a $2,155,768 grant (total $4,310,768). The motion failed due to a lack of second.

After additional discussion the funding request was modified to a $4,311,000 loan for 30 years at 0.0% interest with a deferral of the first payment until 2015.

I. From the 11/3/11 CIB Minutes:

NEW PROJECTS 7. Panguitch City (Garfield County) Panguitch City presented a funding assistance request for a $137,000 grant to make improvements to the city park and rest area on Highway 89 at the north end of the City to include a welcome center/public rest stop with restrooms, an information center and improvements to the existing city park, skate park and pavilion and handicap accessibility. These improvements will include paved parking with curb, lane widening on Highway 89 for turn lanes, sidewalks, handicap ramps, upgrades to the pavilion and picnic facilities, fencing and playground equipment at the ball park complex.

The applicant has contributed a lot of their own funding for this project. CIB’s participation is 15% for this project.

The Board asked if the $500,000 grant from Federal Highways Administration is fully committed and the applicant stated yes.

I. From the 9/1/11 CIB Minutes:

NEW PROJECTS 6. Kane County Water Conservancy District (WCD) (Kane County) Kane County WCD presented a funding assistance request for a $3,500,000 loan for 30 years at 1.0% interest and a $3,500,000 grant (total $7,000,000) to install 21,550 feet of 6”, 8” and 12” water supply line from Strawberry Valley to Zion View area, 85,000 feet of distribution pipe within the Zion View subdivision and a 500,000 gallon water tank buried on Forest Service lands north of the existing subdivision with associated vault and control building.

The applicant stated this is a new public water system which will replace three badly deteriorated private systems. The Board asked the applicant if they would take over water rights for this project. The applicant stated yes.

The Board noted the project request exceeded the Board’s $5 million total participation soft cap. The Board also noted the majority of homes in the project area are secondary or summer homes. The Board also suggested taking this request as a full loan.

After additional discussion the Board modified the funding request to a $7,000,000 loan for 30 years at 2.5% interest.

Robert Bessey made and Michael McKee seconded a motion placing this project on the Priority List for consideration at the October 6, 2011 funding meeting as a $7,000,000 loan for 30 years at 2.5% interest. The motion carried with 9 Aye (Bessey, McKee, Milovich, Peatross, Jarrett, Adams, Holt, Ellis, Drake) and 1 Nay (Simpson). Bruce Adams made and Mike McKee seconded a substitute motion to fund this project as a $6,000,000 loan for 30 years at 0.0% interest and a $1,000,000 loan for 30 years at 2.5% (total $7,000,000). The motion failed with 2 Aye (Adams, McKee) and 6 Nay (Milovich, Jarrett, Simpson, Ellis, Peatross, Holt).

The Board then voted on the original motion to fund this project as advanced to the Priority List. The motion carried unanimously

III. From the 2/2/12 CIB Minutes:

REQUESTS FOR SPECIAL CONSIDERATION 1. Kane County Water Conservancy District (Kane County) On 10/6/11 the Board approved the Kane County WCD’s project as a $7,000,000 loan for 30 years at 2.5% interest to install a new culinary water system for the Zion View Estates subdivision north of Kanab, Utah.

On 1/5/12 the CIB staff received a request from the Kane County Water Conservancy District seeking time on the Board’s 2/2/12 agenda to discuss the possibility of revising the loan terms from 2.5% interest in the original authorization, to a requested 0.0% interest.

Bruce Adams made and Dennis Drake seconded a motion to approve Kane County WCD’s request to reduce the interest rate to 0.0%. All other terms and conditions of the original approval will remain the same. The motion carried with 8 Aye (Adams, Drake, Jarrett, Bessey, Peatross, Holt, Ellis, McKee) and 1 Nay (Simpson).
