Ordinance of the Marin County Board of Supervisors

ORDINANCE NO. 3604 ORDINANCE OF THE MARIN COUNTY BOARD OF SUPERVISORS AMENDING THE ZONING MAP FOR THE PROPERTIES LOCATED AT 47 North Knoll Road (034-081-02, 034-081-01) 110 Linden Lane (047-191-50, 047-191-51, 047-191-52, 047-191-53) 263 North San Pedro (180-181-26)

The Board of Supervisors of the County of Marin hereby ordains as follows:

SECTION 1. FINDINGS

I. WHEREAS, the Marin Housing Authority has requested Zoning amendments on three Marin Housing Authority properties to reflect the existing residential density. Each of the three properties is already developed; however, the existing residential uses are not consistent with the Marin County Zoning Map.

II. WHEREAS, the Marin Housing Authority is not pursuing any new development on these properties, these Zoning Map amendments would rectify the current legal non-conforming status that could present a barrier for future refinancing.

III. WHEREAS, the Marin County Planning Commission held duly noticed public hearings on February 11, June 24, and July 8, 2013 to consider redesignating and rezoning these properties and hear testimony in favor of, and in opposition to, the proposed actions and recommended that the Marin County Board of Supervisors adopt the proposed zoning map amendments for the three above-mentioned Marin Housing Authority properties to reflect the existing residential density.

IV. WHEREAS, the Marin County Board of Supervisors held a duly noticed public hearing on September 17, 2013 and continued the hearing to September 24, 2013 to consider redesignating and rezoning these properties and hear testimony in favor of, and in opposition to, the proposed actions and consider adoption of the proposed zoning map amendments for the three above-mentioned Marin Housing Authority properties to reflect the existing residential density.

V. WHEREAS, the Marin County Board of Supervisors finds that these Zoning Map Amendments have been evaluated in the Supplemental Environmental Impact Report to the 2007 Countywide Plan for the 2012 Housing Element, and the existing residential density on each property’s development was contemplated by the 2007 Countywide Plan.

SECTION II: ACTION

NOW, THEREFORE, BE IT RESOLVED that the Marin County Board of Supervisors declares that the lots located at 47 North Knoll Road, and further identified as Assessor’s Parcels 034-081-01 and 034-081-02 as depicted in Exhibit A of this ordinance, are rezoned to RMP-25 (Residential Multiple Planned – 25 units per acre maximum density).

Ordinance No. 3604 Zoning Map Amendments Marin Housing Authority Properties September 24, 2013 Page 1 of 2 BE IT FURTHER RESOLVED that the Marin County Board of Supervisors declares that the lots located at 110 Linden Lane, and further identified as Assessor’s Parcels 047-191- 50, -51, -52, -53 as depicted in Exhibit A of this ordinance, are rezoned to RMP-45 (Residential Multiple Planned – 45 units per acre maximum density).

BE IT FURTHER RESOLVED that the Marin County Board of Supervisors declares that the lot located at 263 North San Pedro Road, and further identified as Assessor’s Parcel 180-181-26 as depicted in Exhibit A of this ordinance, is rezoned to RMP-20 (Residential Multiple Planned – 20 units per acre maximum density).

SECTION III: EFFECTIVE DATE

This Ordinance shall be and is hereby declared to be in full force and effect as of thirty (30) days from and after the date of its passage, and shall be published once before the expiration date of fifteen (15) days after its passage, with the names of the Supervisors voting for and against the same in the Marin Independent Journal, a newspaper of general circulation published in Marin County.

SECTION IV: VOTE

PASSED AND ADOPTED at a special meeting of the Board of Supervisors of the County of Marin held on this 24th day of September, 2013, by the following vote:
