AN ORDINANCE PROHIBITING THE ESTABLISHMENT, OPERATION AND PROLIFERATION OF VIDEOKE BARS, MUSIC LOUNGES, PUB JOINTS, DISCO HOUSES, MOTELS, INNS, AND OTHER SIMILAR BUSINESS ESTABLISHMENTS WITHIN A TWO HUNDRED (200) METER RADIUS DISTANCE FROM RESIDENTIAL AREAS, CHURCHES, SCHOOLS, HOSPITALS, POLICE STATIONS, COURTS AND GOVERNMENT INSTITUTIONS UNDER THE JURISDICTION OF THIS CITY AND PROVIDING PENALTIES FOR VIOLATION THEREOF

WHEREAS, R.A. 7160, otherwise known as the Local Government Code of 1991, explicitly provides that, “every local government unit shall exercise the powers expressly granted, those necessary implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;

WHEREAS, records show that violence in modern societies is increasing with the commission of property and drug related crimes, as individuals become prone to resort to whatever means necessary to secure desired goods or items;

WHEREAS, our present times have become more and more depraved that family units in residential areas and other concerned institutions are under attack by wicked, unscrupulously enterprising and profit-oriented businessmen who take pleasure in sexual exploitation and other perversions;

WHEREAS, it has become imperative that a legislative fiat be enacted by this administration to prevent the family units and other concerned institutions within the prohibited Two Hundred (200) meters radius of this city from further exploitation and perversions.

NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the members of the City Council of Taguig duly assembled in this session.

SECTION 1. TITLE – This ordinance shall be referred to as, “AN ORDINANCE PROHIBITING THE OPERATIONS OF VIDEOKE BARS AND OTHER ESTABLISHMENTS OF SIMILAR NATURE WITHIN THE PROHIBITED 200 METERS RADIUS AREAS OF TAGUIG”,

SECTION 2. OBJECTIVE – This Ordinance shall have as its primordial purpose the observation of the sanctity of a family home as a basic institution and to curb the further exploitation and perversions against women by way of entertainment and which ten to disturb the community, annoy its inhabitants, and adversely affect the social and moral welfare of the community;

SECTION 3. SCOPE – This Ordinance shall apply to existing business establishments such as Videoke Bars, Music Lounges, Pub Joints, Disco House, Beer Houses, Night Clubs, Motels, Inn and other business similar in nature within Two Hundred (200) meters radius away from residential areas, churches, schools hospitals, police stations, courts and government institutions of the city;

SECTION 4. DEFINITION OF TERMS – as used in this Ordinance the following terms are hereby defined as follows, to wit:

a. PUBLIC NUISANCE – one that affects a community or neighborhood or any considerable number of persons, although the extent of annoyance, danger or damage upon individuals maybe unequal.

b. RESIDENTIAL – one that is used serving or designated as a residence or for occupation by resident; adapted to or occupied by residences as residential quarter.

c. PERVERSION – a deviant sexual practice.

d. GENERAL REPUTATION – in evidence, testimony concerning the repartee in which a person or place or premises regarding the condition therein.

e. ABATEMENT – the abatement of a nuisance is its removal.

f. DENS – a squalid or vile abode or place.

g. PARLORS – a somewhat private room in a hotel, club, or the like for relaxation, conversation etc. which shall include lounge and steam bath services, with added sex services for a fee.

h. VIDEOKE BARS – shall include mini-restaurant and carenderia/canteen with videoke machines whether serving liquors or not.

SECTION 5. the City Mayor, the City Treasurer or any person acting in behalf of the said officials are prohibited from issuing permits, temporary or otherwise, or from granting licenses and accepting payments for the operation of business enumerated in Section 3 hereof;

SECTION 6. GRACE PERIOD – Owners and/or operator of establishments engaged in or devoted to, the business enumerated in Section 3 hereof are hereby given one (1) year from the date of approval of this ORDINANCE within which to wind up business operations or to transfer to any place outside Taguig City or to convert said business into other kinds of business allowed within the area;

SECTION 7. PENALTY CLAUSE – Any person violating any provision of this ordinance, shall upon conviction, be punished by imprisonment of one (1) one year or a fine of Five Thousand (P5, 000.00) Pesos, or both, at the discretion of the court, PROVIDED, that in case of juridical person/entity, the President, the general Manager, or person-in-charge of operation shall be liable thereof; PROVIDED FURTHER, that in case of subsequent violation and conviction, the premises of the erring establishment shall be closed and padlocked permanently; and the videoke machines used thereby confiscated.

SECTION 8. SEPARABILITY CLAUSE – If any provision or part thereof is declared invalid, the remainder shall not be affected thereby;

SECTION 9. REPEALING CLAUSE – All laws, rules and regulations, ordinances and resolutions or part thereof inconsistent with this ordinance are hereby repealed or modified accordingly;

SECTION 10. IMPLEMENTING CLAUSE – Upon approval hereof, it shall be incumbent upon the office of the Mayor to issue the needed implementing rules and regulations to effective enforce this ordinance;

SECTION 11. EFFECTIVITY CLAUSE – This Ordinance shall take effect upon its approval and publication in any newspaper of local circulation within the Municipality and after its compliance with the requirements as provided for by law.
