ORDER

Comes now the State of Indiana by James Luttrull Jr., Prosecuting Attorney for the 48th

Judicial Circuit, and having filed its Motion to Request Issuance of a Protective Order and the

Court being duly advised, does now GRANT the State’s motion and hereby orders:

1. That a copy of the video recorded interview of the alleged victim shall be made available to the defense;

2. That no additional copy of the recording nor any portion of the recording shall be made by the defendant, the defendant’s attorney, investigator, expert or any other representative or agent of the defendant without the permission of the Court, following notice to the State and opportunity to object;

3. That said copy shall not be used for any purpose other than to prepare for the defense in this above-reference action and shall not be publicly exhibited, shown, displayed, used for educational, research, or demonstrative purposes, or used in any other fashion, except in judicial proceedings and/or disciplinary proceedings in the above-referenced action;

4. That said copy may be viewed only by parties, their counsel and their counsel’s employees, investigators and experts and only those persons may be provided copies of any transcript or substance of any portion thereof except in judicial and/or disciplinary proceedings related to the above-reference action; 5. Any and all copies of these recordings and any transcripts, which are not entered into evidence, shall be returned to the Grant County Prosecutor’s Office or kept in a secured manner by defense counsel. In the event that these recordings are returned to the Prosecutor, they shall be retained with the case file pursuant to Indiana law, unless required for use in a judicial and/or disciplinary proceeding related to the above-referenced action.

6. That except as provided in paragraph 5, this order does not terminate upon resolution of this matter but remains in effect until contrary order of this Court.
