FARIBAULT COUNTY BOARD OF COMMISSIONERS OFFICIAL PROCEEDINGS JANUARY 20, 2009

The Faribault County Board of Commissioners met pursuant to the recess of January 6, 2009 at the Courthouse in the City of Blue Earth at 9:00 a.m. on January 20, 2009. The following members were present: Butch Erichsrud, Bill Groskreutz, Tom Loveall, John Roper, and Tom Warmka, Commissioners. Central Services Director Brenda Ripley and County Attorney Brian Roverud were also present.

The meeting was called to order by Chair Loveall.

The pledge of allegiance was recited.

Erichsrud/Warmka motion carried unanimously to approve the synopsis and official proceedings of the January 6, 2009 regular meeting.

Groskreutz/Warmka motion carried unanimously to amend previous motion to accept the corrected synopsis and official proceedings of the January 6, 2009 regular meeting

Groskreutz/Warmka motion carried unanimously to approve the agenda of January 20, 2009 with additions.

The calendar was updated. No member of the public appeared to make comment.

Public Works Director John McDonald met regarding office business. No contractors were out this week. The road around Elmore Academy will be redone in 2009-2010. Discussion was held on the 2008 transportation bill.

McDonald wanted to remind motorists to be aware of snow plows on the road.

Warmka/Erichsrud motion carried unanimously to approve request from M. Durkee, J. Franzen, D. Hanson, and J. McDonald to attend a one-day bridge safety inspection seminar in Owatonna.

Groskreutz/Warmka motion carried unanimously to appoint the following: David Olsen of Frost to a three-year term on the Board of Adjustments; Kerry Doyle to a three-year term on the Extension Committee; Jim Heckman of Wells and Scott Robertson of Winnebago to a five-year term on the Local Redevelopment committee.

Zoning Administrator Bruce Blakesley met regarding a conditional use permit.

Warmka/Erichsrud motion carried unanimously to adopt Resolution 09-PZ01-03 granting a conditional use permit to construct a livestock waste lagoon in Pilot Grove Township to Marc Bell. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

R E S O L U T I O N CONDITIONAL USE PERMIT MARC BELL SECTION 4, PILOT GROVE TOWNSHIP

WHEREAS: Marc Bell applied for a conditional use permit under the Faribault County Zoning Ordinance requesting a permit to construct a livestock waste lagoon in the A-2 General Agriculture District, located at the following described property:

the North Half (N ½) of the Northwest Quarter (NW ¼), Section Four (4), Township One Hundred One (101) North, Range Twenty-eight (28) West, Pilot Grove Township, Faribault County, Minnesota.

WHEREAS: The Planning Commission finds:

a. That the conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity, and is compatible with the existing neighborhood;

b. That the establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding vacant property for uses predominant in the area, conforms to the Comprehensive Land Use Plan of the county;

c. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided;

d. The soils conditions are adequate to accommodate the proposed use; and

01-20-09 - 9- e. The use is of the same general character as other conditional uses in the Agriculture District and will not be detrimental to the general health and welfare of the county.

f. That proper facilities are provided which would eliminate any traffic congestion or traffic hazard which may result from the proposed use.

NOW THEREFORE BE IT RESOLVED: The Faribault County Board of Commissioners approves the conditional use permit for a livestock waste lagoon located in the A- 2 General Agriculture District with the following conditions:

1. A maintenance fee of $50.00 every two years shall be paid as long as the conditional use is in effect starting January 5, 2011.

The conditional use permit is non-transferable.

Warmka/Erichsrud motion carried unanimously to approve a loan subordination agreement for Michael & Heidi Schiltz of Elmore Township of $6,201.18.

Warmka/Groskreutz motion carried to pay bills as presented. Warmka voted no.

Groskreutz/Erichsrud motion carried to amend payment of bills removing the payment of $1,725 to Minnesota Counties Insurance Trust for Faribault County Economic Development Agency insurance payment and $7,610 to Minnesota Counties Insurance Trust for insurance on Fair Board premiums, with the revised bill payment total of $594,853.77 as follows:

COUNTY REVENUE FUND $ 184,884.91

PUBLIC WORKS FUND 222,066.45

HUMAN SERVICES FUND 169,973.33

COUNTY LIBRARY FUND 6,901.58

HUNTLEY SEWER DISTRICT 3,507.50

DITCH FUNDS 7,520 .00

$ 594,853.77
