[4364-2] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 7320, AS AMENDED, CODE OF LAWS 12 OF SOUTH CAROLINA, 1976, RELATING TO THE 13 SELECTION AND DUTIES OF THE EXECUTIVE DIRECTOR 14 OF THE STATE ELECTION COMMISSION, SO AS TO 15 REQUIRE THE EXECUTIVE DIRECTOR TO PUBLISH ON 16 THE COMMISSION’S WEBSITE ACTS OR JOINT 17 RESOLUTIONS OF THE GENERAL ASSEMBLY AFFECTING 18 THE ELECTION LAWS OF THIS STATE TOGETHER WITH A 19 BRIEF EXPLANATION, IF NECESSARY, OF EACH SUCH 20 ENACTMENT, TO PROVIDE THE CRITERIA FOR THE 21 SELECTION OF THE ENACTMENTS REQUIRED TO BE 22 PUBLISHED, AND THE DURATION OF THE WEBSITE 23 PUBLICATION. 24 Amend Title To Conform 25 26 Be it enacted by the General Assembly of the State of South 27 Carolina: 28 29 SECTION 1. Section 7320(C) of the 1976 Code, as last amended 30 by Act 265 of 2012, is further amended to read: 31 32 “(C) The executive director shall: 33 (1) maintain a complete master file of all qualified electors 34 by county and by precincts; 35 (2) delete the name of any elector: 36 (a) who is deceased; 37 (b) who is no longer qualified to vote in the precinct 38 where currently registered; 39 (c) who has been convicted of a disqualifying crime; 40 (d) who is otherwise no longer qualified to vote as may be 41 provided by law; or 42 (e) who requests in writing that his name be removed;
[4364] 3 1 (3) enter names on the master file as they are reported by the 2 county registration boards; 3 (4) furnish each county registration board with a master list 4 of all registered voters in the county, together with a copy of all 5 registered voters in each precinct of the county, at least ten days 6 prior to each election. The precinct copies shall be used as the 7 official list of voters; 8 (5) maintain all information furnished his office relating to 9 the inclusion or deletion of names from the master file for four 10 years; 11 (6) purchase, lease, or contract for the use of such equipment 12 as may be necessary to properly execute the duties of his office, 13 subject to the approval of the State Election Commission; 14 (7) secure from the United States courts and federal and state 15 agencies available information as to persons convicted of 16 disqualifying crimes; 17 (8) obtain information from any other source which may 18 assist him in carrying out the purposes of this section; 19 (9) perform such other duties relating to elections as may be 20 assigned him by the State Election Commission; 21 (10) furnish at a reasonable price any precinct lists to a 22 qualified elector requesting them; 23 (11) serve as the chief state election official responsible for 24 implementing and coordinating the state’s responsibilities under 25 the National Voter Registration Act of 1993; 26 (12) serve as the chief state election official responsible for 27 implementing and enforcing the state’s responsibilities under the 28 Uniformed and Overseas Citizens Absentee Voting Act 29 (UOCAVA), as set forth in the U.S.C., Title 42, Section 1973ff, et 30 seq; and 31 (13) establish and maintain a statewide voter registration 32 database that shall be administered by the commission and made 33 continuously available to each board of elections and to other 34 agencies as authorized by law; and 35 (14) publish on the commission’s website each change to 36 voting procedures by act or joint resolution of the General 37 Assembly, or by ordinance of a political subdivision of the State, 38 relating to the election laws of the State together with a brief 39 explanation, if necessary, of each such enactment. Enactments and 40 any accompanying explanations published on the commission’s 41 website pursuant to this item must remain on the commission’s 42 website at least through the date of the next general election.” 43
[4364] 4 1 SECTION 2. This act takes effect upon approval by the Governor 2 and applies to applicable legislation affecting voting procedures 3 enacted or ordained that take effect after 2013. 4 XX 5
