VIRGINIA BOARD OF NURSING INFORMAL CONFERENCES January 14, 2016

TIME AND PLACE: The informal conferences held before an Agency Subordinate of the Board of Nursing were convened at 9:00 A.M., on January 14, 2016 in Hearing Room 5, Department of Health Professions, 9960 Mayland Drive, Suite 201, Richmond, Virginia.

AGENCY SUBORDINATE: Jane Elliott, RN, PhD

STAFF PRESENT: Brenda Krohn, RN, MS

OTHERS PRESENT: Tammie Jones, Adjudication Specialist

CONFERENCES SCHEDULED: Sharon Alls, RN 0001-193817 Ms. Alls appeared.

Ms. Alls was informed a recommended decision will be made and mailed to her within ninety days. This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall become a Final Order thirty days after service of such order on Ms. Alls unless a written request to the Board for a formal hearing on the allegations made against her is received from Ms. Alls within such time. If service of the order is made by mail, three additional days shall be added to that period. Upon such timely request for a formal hearing, the Order shall be vacated. CONFERENCES SCHEDULED: Coreen Hillman, RN 0001-242581 Ms. Hillman did not appear.

Based upon information provided by Ms. Jones, Dr. Elliott ruled that adequate notice was provided to Ms. Hillman.

A recommended decision will be made and mailed to Ms. Hillman within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall be a Final Order.

1 CONFERENCES SCHEDULED: Philissa Taylor-Plunkett, RN 0001-188804 Ms. Taylor-Plunkett did not appear.

Based upon information provided by Ms. Jones, Dr. Elliott ruled that adequate notice was provided to Ms. Taylor-Plunkett.

A recommended decision will be made and mailed to Ms. Taylor-Plunkett within ninety days.

CONFERENCES CONTINUED: Brittany Kelly, CNA 1401-137338 Ms. Kelly did not appear.

Based upon information provided by Ms. Jones, Dr. Elliott ruled that adequate notice was provided to Ms. Kelly.

A recommended decision will be made and mailed to Ms. Kelly within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall be a Final Order. CONFERENCES SCHEDULED: Carrie Spinner, LPN 0002-080248 Ms. Spinner did not appear.

Based upon information provided by Ms. Jones, Dr. Elliott ruled that adequate notice was provided to Ms. Spinner.

A recommended decision will be made and mailed to Ms. Spinner within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall be a Final Order. CONFERENCES SCHEDULED: Kristen Marshall, LPN 0002-084070 Ms. Marshall appeared accompanied by her husband, her daughter and her attorney, Margaret Hardy.

Ms. Marshall was informed a recommended decision will be made and mailed to her within ninety days. This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall become a Final Order thirty days after service of such order on Ms. Marshall unless a written request to the Board for a formal hearing on the allegations made against her is received from Ms. Marshall within such time. If service of the order is made by mail, three 2 additional days shall be added to that period. Upon such timely request for a formal hearing, the Order shall be vacated. CONFERENCES SCHEDULED: Maureen Akoko, LPN 0002-077287 Ms. Akoko appeared accompanied by her friend, Joe.

Ms. Akoko’s CNA case will be closed due to insufficient evidence of a violation of the Nurse Practice Act or the Board of Nursing laws and regulations. CONFERENCES SCHEDULED: Michael Perrotta, LPN 0002-091195 Mr. Perrotta appeared.

Mr. Perrotta was informed a recommended decision will be made and mailed to her within ninety days. This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall become a Final Order thirty days after service of such order on Mr. Perrotta unless a written request to the Board for a formal hearing on the allegations made against her is received from Mr. Perrotta within such time. If service of the order is made by mail, three additional days shall be added to that period. Upon such timely request for a formal hearing, the Order shall be vacated. CONFERENCES SCHEDULED: Adrian Kestner, RN 0001-213064 Ms. Kestner did not appear.

Based upon information provided by Ms. Jones, Dr. Elliott ruled that adequate notice was provided to Ms. Kestner.

A recommended decision will be made and mailed to Ms. Kestner within ninety days.
