A. Calendar i) Fall 2017 meeting dates: Aug 21, Sept 11 & 25, Oct 9 & 23, Nov 6 & 20, Dec 4

ii) Spring 2018 meeting dates: Jan 8 & 22, Feb 5 & 26, Mar. 19, Apr. 2, 16 & 30 Please note the there are many District holidays, which will be observed on a Monday in the Spring. This has affected our Representative Council meeting schedule.

iii) General Membership meeting—Sept 18? President Ausubel would like to have a general membership meeting. It will be scheduled once the Negotiator Town Hall meeting dates have been identified.

iv) Association calendar—teamup.com or samepage.io President Ausubel would like to maintain an Association calendar on teamup.com to be used by members of the Representative Council.

v) Survey Monkey--$228/year Vice President Elsdon moved and Treasurer Cosand seconded the motion to renew Survey Monkey. The motion has carried.

B. Grievance officer nominee (1 year term)—Bruce Osburn President Ausubel has nominated Bruce Osburn to serve out his (President Ausubel’s) term as Grievance Officer. Vice President Elsdon moved to approve the nomination. Representative Cameron seconded the motion. The motion has carried.

C. Membership chair nominee (1 year term)—Luke Gunderson President Ausubel has nominated Luke Gunderson for the position of Membership Chair. Representative Osburn moved to approve. Representative Hijaz seconded the motion. The motion has carried.

i) Compensation/Association release time President Ausubel would like to provide one equated hour as compensation for the Membership Chair. Due to the time commitment required for this position, he also suggests that CCFA compensate the Membership Chair one additional equated hour (1.5 hours per week). Representative Creel has moved that the CCFA Membership Chair position be compensated by CCFA one equated hour. Representative Hijaz has seconded the motion. The motion has carried.

D. Health and Safety Rep Nominee—Bret McMurran Representative Creel has moved to approve Bret McMurran as CCFA’s representative to The Health and Safety Committee. Representative Osburn seconded the motion. The motion is approved.

E. PAC At-large: Bret McMurran Representative Creel has moved to approve the appointment of Bret McMurran to the position of at-large representative to the CCFA Political Action Committee.

F. Equity team: LGBTQ+, Human Rights, and Women's Issues reps? The California Teachers Association (CTA) has proposed the formation of Equity Teams. Each local level Equity Team is composed of three representatives specializing in Human Rights, LGBTQ+, and Women’s Issues. They are all non-voting representatives. President Ausubel would like the Rep Council to consider who might serve in these positions. Also, CTA will offer funding for conference attendance, etc. to support these positions.

G. E-board? President Ausubel has asked the Representative Council to provide him with items Appropriate for the CCFA President’s report to the Governing Board.

H. Presidents Conference

I. CFA Settlement with ACCJC (attached) A significant outcome of the California Faculty Association (CFA) settlement with the Accrediting Commission of Community and Junior Colleges (ACCJC) is that student Learning outcomes are no longer required as a component of faculty evaluation. However, our 2014-2017 Collective Bargaining Agreement includes student learning outcomes as a part of faculty evaluation. As a result of the settlement, ACCJC will now award colleges a full, seven year accreditation as opposed to provisional accreditations. Provisional accreditations required a re-evaluation the year following the accreditation visit.

J. Chaffey management structure (attached) President Ausubel has distributed the Chaffey Community College District management structure.

K. CTA negotiations Workers with the CTA almost went out on strike recently. They negotiated until the last Possible moment and then settled. The unions represent staff and clerical support employees. CTA is concerned that the practice of fair share fees will soon end. The Association anticipates a 40 percent loss in income if that occurs, which means it will need to accomplish the same goals with fewer resources.

II. Officers' Reports

A. Vice President i) IS Rep to replace Rob Rundquist (one-year term) There will be two special elections in fall 2017. First, Representative Creel has put out a call to replace Representative Rundquist. Second, Representative Connelly will put out a call to replace Representative Calebotta, who will be on sabbatical in spring 2018. In addition, Representative Calebotta does not plan to serve as representative of Language Arts for another term. Another election will take place in Spring 2018 to replace him.

August 21, 2017 Page 4 Visit http://www.ccfa.us/ for more information on CCFA Last spring, Vice President Elsdon and former President McMurran were in communication with the District regarding a possible violation of the 50 percent law. This is a state law mandating that every California community college must expend at least 50 percent of its budget on instruction. Vice President Eldsdon and former President McMurran have requested written documentation from the District that the law was not violated.

B. Secretary: Paula Snyder Representative Osburn has moved to approve the May 1 minutes. Representative Cameron seconded the motion. The motion has carried with three abstentions.

C. Treasurer: Diana Cosand i) Treasurer Cosand has written a check to President Ausubel in the amount of $1358.37 for previously approved Membership expenses (e.g., cups, calendars, etc.) and a check to Vice President Elsdon in the amount of $733.13 for the CCFA May 2017 graduation party held at El Torito.

D. Membership Chair: TBD Three financial workshops will be held this fall. All are on a Friday.

iv) April/May '18 CCFA Quakes night? President/Membership Chair Ausubel received a call from the minor league baseball organization, the Rancho Cucamonga Quakes in regard to the possibility of a CCFA Quakes night.

v) CCFA event sponsorship and/or scholarship? Dean Ted Younglove (School of Math and Science) recently provided a pizza dinner for his part-time faculty. President/Membership Chair Ausubel noted that there were more than 100 people in attendance; mostly part-time faculty, but also some full-time. He suggests that CCFA might want to pay for this for every school at the beginning of the academic year. Vice President Elsdon suggests that the District and CCFA split the expenses evenly.

vi) Two new PT members; two full-time members are now deans There are eight new members of CCFA; six are full-time and two are part-time.

vii) 2017-2018 dues totals: $1065 (FT) and $204.95 (PT) Union dues paid to the Chaffey College Faculty Association (CCFA), the California Teachers Association (CTA), and the National Education Association (NEA) have increased by a small margin. While CTA and NEA dues are not kept locally, CCFA dues are held locally and help to fund CCFA activities.

F. Negotiators: Sue Herman, Greg Creel, Rod Elsdon and Shelly Eckvahl Town Hall meetings will be scheduled for the fall term. The Representative Council has been asked if the meeting times used in Spring 2017 should be repeated (college hour and then a late afternoon)? A Representative suggests that at least one town hall should be held on a Friday. Negotiator Herman suggests that a town hall be scheduled for 5 to 6 p.m.

G. Grievance Committee: Jon Ausubel, Paula Snyder and TBD: Investigations; Statway A few investigation interviews scheduled through Human Resources and conducted by an independent investigator were held during the summer.

Statway is a series of courses that is being held at Fontana High School and taught to Fontana High School students. Students have dual enrollment at their high school and Chaffey College. The fall 2017 course currently being taught has not been approved by the Curriculum Committee. The individual initially hired to teach the class is a teacher employed by the Fontana Unified School District. Since CCFA learned of this situation, the teacher has now been hired by the Chaffey Community College District. Plus, the course will be team taught by an existing Chaffey College faculty member.

C. 16-week Calendar There is a push to move forward with the 16-week calendar for 2018-19. Dr. Shannon, however, noted that other colleges have taken more time to make this transition. The Governing Board must approve the move and then details must be negotiated.

A. Demand to Bargain—Distance Ed.

B. Solar Construction Parking stickers will be distributed to cover the duration of the solar panel construction. Part-time faculty may park wherever they would like, but full-time employees must park in designated parking lots. Vans and golf carts will be available to shuttle employees between parking lots and various campus locations.

C. Involuntary Transfer—RoseAnn Osmanian This item is for informational purposes. Employee, RoseAnn Osmanian was transferred from the Library Multidisciplinary Success Center to the Writing Center, which is on the lower level in the Library. While technically the transfer was involuntary, it was a positive move. Involuntary Transfers can be done quickly and easily while also benefitting the affected employee.

Appendix A

CFT reaches settlement with accrediting agency

“Fair accreditation practices will be the norm going forward"

San Francisco—In an important step toward fairer accreditation practices in California’s community colleges, the California Federation of Teachers (CFT) has reached agreement with the Accrediting Commission for Community and Junior Colleges (ACCJC) to settle its long- standing lawsuit against the agency.

The agreement, which lays out a number of important accreditation policy changes—some of which have already occurred—states that, “These changes have institutionalized many of the remedies which were initially sought by the plaintiffs at the time of the filing of this case.”

Originally filed in September 2013, following the ACCJC’s reckless decision to terminate the accreditation of City College of San Francisco, the CFT’s lawsuit sought an injunction to keep the college open, and to force the agency to stop violating its own rules and the rule of law. That injunction was granted through a separate lawsuit filed by San Francisco City Attorney Dennis Herrera in San Francisco Superior Court, and in that lawsuit ACCJC was found to have broken several laws in its decision to terminate CCSF’s accreditation.

The CFT’s lawsuit addressed broader concerns than Herrera’s, seeking to end years of punitive, arbitrary, inconsistent and expensive actions by the Commission. The behavior brought to light by the CFT led many observers to decry the Commission’s lack of transparency and “culture of fear,” culminating in sharp criticism by the Chancellor’s office, the Board of Governors, the State Auditor, elected leaders in San Francisco, Sacramento, and Washington D.C., and sanctions by the U.S. Department of Education.

Last year, however, a number of changes in Commission leadership—including placing its controversial president, Barbara Beno, on administrative leave—ultimately led to fruitful discussions between CFT and the ACCJC. The Settlement Agreement includes the following changes:

• Not to interfere with community colleges’ collective bargaining process;

• the commission’s executive committee would recommend deleting accreditation standard III.A.6, requiring student learning outcomes (SLOs) to be used as a component of faculty evaluation;

August 21, 2017 Page 8 Visit http://www.ccfa.us/ for more information on CCFA • to adopt a policy to ensure at least three active duty faculty members are assigned to each college evaluation team;

• to adopt a policy establishing clear criteria by which the ACCJC may extend for “good cause” the two year period for a college to comply with accreditation standards as to which it has been found deficient;

• in determining a college’s financial stability, to apply its indicators consistently from college to college, and refrain from directing colleges what specific steps must be taken to achieve that stability;

• to reaffirm accreditation for 7 years with a follow up report for colleges with minor compliance issues, instead of the recently-adopted eighteen month period of reaffirmation; and

• to strengthen conflict of interest safeguards for commissioners and evaluation team members.

The settlement also establishes a dispute resolution procedure that begins outside of court in the event that CFT believes the ACCJC is not living up to its commitments.

CFT president Joshua Pechthalt said, “This agreement represents a sea change in the ACCJC’s operations in a number of significant ways. We believe that as a result of this settlement, fair accreditation practices will be the norm going forward.”

Jim Mahler, president of the CFT’s statewide Community College Council, said, “In fast- tracking these reforms, the ACCJC’s leadership has indicated the seriousness with which they view the settlement and their intent to implement it. We look forward to strengthening and improving the educational opportunities for the community college system’s two million students, no longer distracted by the accreditation problems of the past.”

CCSF faculty union president Tim Killikelly said, “On the heels of ACCJC finally granting City College of San Francisco full accreditation, and putting Compton College on a firm path to reaccreditation, this settlement is a vindication of our union’s decision to fight back against the illegal and unfair actions to which we had been subjected, and for the literal future of the college. This struggle took a big toll. What the agreement should mean is no one else will ever again have to go through what we at City College went through.”

“The campaign for fair accreditation in California led by the CFT has been incredibly successful. We hope this agreement signals a new direction for the accreditation process and the California community college system. Nonetheless, we will remain vigilant in holding ACCJC accountable. We believe this agreement and our vigilance together will help ensure a robust and fair accreditation system for California.”
